A month later and I never did a real notice nor did I get the return visit AFAIK. They did love flying me a few times a week though. Was hoping for some good video footage with CE.



I wonder what the legitimacy is of denying them based on their "72 hour abatement" notice going up on gates. Is the notice just "courtesy" or can the case be restarted from that initial process if they don't return within 72 hours?

I am in a similar situation with one of my properties. They jumped over the fence and went in the back way after they were denied entry through the main gate in May. the tennant removed the plants and then replanted in mid July. No flyovers that we are aware of until the day they were harvesting. We have no proof that they came back and comfirmed removal so I am anticipating a 120k plus fine. See you in court bitches

tankerton anyway to sue her for that, its practically documented in writing! if i found out someone did that to my property and i had to deal with code enforcement 4th amendment violations that were later found unwarranted i would sue the fuck out of that dumb **** for slander, false police calls, and whatever possible legality i could find.

the system is just way to open for abuse, if i really hate someone all i have to do is call code enforcement every day and have them hassled over fake marijuana gardens.

was there a measure A update at the last BOS meeting, wasn't it tuesday?

Thats what is crazy about measure a. Any other building department code violation complaint you HAVE to provide your name. Your name will be kept anonymous but if a court compels the county to provide the name of person who filed complaint its there. Those rules don;t apply to marijuana grows.

I don't know who that bitch is. I have no ties to Berry Creek. My idea for a lawsuit is to get 10 volunteers who are willing to take a complaint at their house, wire that house with full audio and video and set those bastards up. Although I am starting to wonder if a judge has refused to sign anymore inspection warrants as they are not entering peoples properties under inspection warrants any longer.

What % of gardens got hit with notices/raids ect this year, if you guys had to guess?

I doubt they even scratched the surface, which leads me to ask is rolling the dice and going for it next year too risky? Or a good play on the odds?

Seems like most if the raids, that I've read about ect, are on large over 99 plant gardens, and I have multiple friends in butte who had no troubles from county pigs at all this year...I want to go for it and try 12 big ones and a small dep in 2016, but am I being naive?

Half of them. Go big or don't come at all. If they start the fine process it has to be financially viable for you to keep your plants up and fight the fines

It's really not that hard. They send a recon plane to grid an area all day. Two days later helicopter flys low and confirms. Ticket in the mail or posted on gate. I have some friends who didn't'the get F'd with but a lot more who did

But that being said I raged 5 99 plant light depos and 2 99 plant 400 gal gardens and every single one got to harvest. One full season , 2 light depos got ticketed 2 others they showed up after we harvested and 2 caught no heat at all so i guess things worked out. FTP... Fuck the prohibitionists

Thank you, way to many eggs in the same county though. Next step is lobbying the Butte BOS to change their position on commercial mmj businesses. I really believe measure a will not be in place next year. It was not long ago that we had a very progressive marijuana ordinance and it would be hard for me to believe that Butte would want to leave all the tax revenue behind now that the state has regulations.

I don't know if the percentages even matter; what we've seen is that Measure A was ill-conceived with no legal basis and as such been mostly ineffective. The biggest thing Measure A has done is stop the annual proliferation of gardens - it's pushed gardens north to Oregon or to the south.

What Kathy proves is that Measure A is a massive taxpayer funded McCarthyism propaganda machine being driven by a handful of hardline Measure A supporters.

Kathy states she called in over 50 in July alone - now think if she did that every month. The anonymous complaint system is literally a handful of minions schooled at spotting gardens from satelittle images.

Now I believe and we are working on gathering evidence that the county was behind this. If we can prove this we have them dead to rights on conspiracy and they are all fucked

I agree that there are several more minions that have been schooled in driving complaints, and that it may have been at the behest of county officials. Collusion by the county may be difficult to prove though.

What is easy to prove to the general public is that Measure A isn't some overwhelming success in which the entire community has collectively pooled its resources and will. Kathy proves that Measure A is driven by a few over-zealous citizens whom manically and unconstitutionally profiled their fellow citizens, and that the county acted on this very profiling.

That's one of many reasons we are in court in yuba. They are creating a class and group of people and discriminating against them. The fact that they don't treat any other code violation any where near the same is a huge issue. Time to get a land use and zoning initiative together.

So.... my abatement hearing is concluded administratively. We had been anticipating a plus90k fine since we told them to piss off at the end of June. Hearing officer decided we were a nuisance but only fined us 6k. Guess they are sticking to the original written fine amount and not going for the 1000 dollar a day full Monty. I am ecstatic but I will still never pay those mother fuckers a dime. Onto superior
 
Does anyone think Butte will allow gardens now that the new medical marijuana regulations have passed? They can't posibbly double down on their failure, can they?
