Butte County

the funny thing is that what those santa ana cops did is happening in butte county! many reports of code enforcement/sheriff making condescending rude remarks, breaking into storage containers and dismantling gates, insulting people who stand their ground, intimidation with 6+ officers to serve warrants, etc.

anyways there was a recent victory in fresno! the judges ruling sides with the property owners! STAND YOUR GROUND! lets fight and get back that fine money! IF ANYONE IS SERVED A CITATION AND FINE, GO TO COUNTY AND SHOW THEM THIS FROM THE FRESNO CASE!

"However, even assuming counsel’s argument that the Fifteen Day Notice to Abate was an administrative citation, [appellant] would still be entitled to an opportunity to abate the plants prior to the imposition of administrative penalties."

"The Code does not authorize the imposition of administrative penalties without notice or an opportunity to abate the nuisance even if there is a finding of an immediate danger to health or safety."
Federal Judge T. Henderson, also ruled that not giving the standard, 15 day notice, before fines or abatement, was a violation of the 4th & 14th amendments.

reposted so it can be at the top of page. so with this latest ruling, can butte county residents who paid the fines go appeal and get their money back??? once they realize they can't collect the $500 fines for citation, their entire budget is gonna go to shit. they will only be able to fine people if they dont abate after hearing process, and even then according to zeke it would just go as property tax lien, which means no cash revenue into their coffers. this is huge!! take away the money and they can't pay these mother fucking code enforcement dickheads.

I'm mostly wondering about all the people who have paid fines, i know at least 5 people who have. that right there would take $2500 back from their budgets. and if we send letters so all the victims of measure A who got fined, say bye bye to their revenue!

How would that process even work? the wireless connection that boosts my phone is shit right now so its hard for me to make calls. and its friday so most lawyers are gonna be out the office soon.

Taxes those assholes. Hopefully it's put there ass in check and they'll quit effn with people so much....and hopefully you guys get a chance to sue there ass for the cattle thing and property damages and all the crooked shit they do.

Well that's good to hear that the local federal judge is on the side of the patients. I hope you all forwarded that ruling to a certain person, in case he didn't already know. That's a step in the right direction guys!

I can't even imagine what's gun a happen in fresno, there probably gonna go bankrupt haha, I've seen in Yuba a few times where they've busted people and cut the garden and then ending up paying for the garden after they were found not guilty. It scared Yuba county so much that they'd arrest people and leave the garden 90 percent of the time cause they'd get there asses sued big time. Or they'd scare the grower so much they'd cut there own garden down themselves. But I'm just hoping that good news gets you guys back on track and hopefully ends the madness up there cause that's some straight Gestapo shit u guys got up there. Good luck!

so I'm trying to figure out what went down tuesday 6/9 when urbngroz saw 25 car caravan headed up forbestown. the measure A checks that day seem to not be related to it.

5/9
1 stop in gridley
1 stop in west oroville/thermalito
3 stops yankee hill on nelson bar rd
1 stop in kelly ridge on lodge view dr (wtf weird place to grow its a densely packed residential retirement community lol)
6 checks in berry creek
a call came in about a BHO lab and was referred to SEU, no location given

6/10
2 checks in cherokee, looks like same addys listed in weeks prior
1 check no location
2 checks in magalia in the nimshew area
3 checks unlisted (assuming magalia since it was same officer and short time between)

6/11 no checks

I came back up the mt about 30 min later and didn't see anyone, but they could have went anywhere. Maybe they had actual county business to tend but I doubt it because CE was with them.

On another note, if they don't have any real grounds to fine us it makes sense that they would use bully tactics to force us into the box.

my main guess would be they were out doing an operation in the national forest possibly, especially if forest service was with them. but nothing in the public logs that day showing anything on forbestown.

I wish there was some way we could look at their server data and take a look at all the IP addresses associated with the upload of complaints. It would tell us who is making them up.
