MJ is not the only subject of this tactic is used by Judges either.

I agree. If a case is won then the plant limiting plan is out the door. That's why they don't fight much.
 
You're exactly right MJPassion. You have the right to grow your six rec and six med. It says in A64 a believe. Pueblo sheriffs are following that rule because busted someone with 320 some plants and let him keep his 99 plant count for med and his six for rec so they let him keep a total of 105 plants and cut the rest.

It's not so much judges as prosecutors. When the cops perform a dubious bust they pursue the case right up to the last moment & then decline to prosecute. They won't do that if they have a solid case.

If that turns out to be anybody reading this, have your lawyer insist that charges be dropped with prejudice so that they can't come back after you later. The judge won't make that decree unless you demand it.

I visited Pueblo yesterday.....beautiful landscape.

Heard from a new friend that Florida people are fucking it up.
I heard before moving out here there was a shitload of idiots form FL moving to Pueblo due to the cost of living being reasonable cheaper than the Denver metro area. To the point if you state your from the dangling infested penis of the US you get watched hard core due to the blatant ignorance to the laws pertaining to counts.

I grew up in Pueblo, have family there. It's fairly insular- not that the people are really that way but because there's not a lot of opportunity so not many people move in. You won't see many out of state plates off the highways like in metro Denver or Ft Collins or Colorado Springs. It's a small enough place that people notice more than in the big city.

It needs to be said that Pueblo County cops don't really play it straight, never really have. That & modern tech make Pueblo West sorta a death trap for growers. It's wide open country so they can thermal image a lot of places with ease using a $250 attachment for an iphone. That's illegal, of course, but nobody will ever know but them. Once they spot a suspected grower, they talk to the neighbors, see if you actually have a job. Nail down your routine. Check the place carefully for growing trash, illegal electrical mods, too much traffic, particularly out of state plates, so forth & so on. They'll talk to the cops wherever your friends are from after running their plates. When they find an opening, it's slamma-jamma.

It's not an easy place to hide.
 
Based off of my experiences that couldn't be farther from the truth Jhhhn. Cops here don't give a shit. If you've got your plant count they leave you alone. For instance, they've checked 107 grows and only busted the 24 that weren't within their plant count. Some had several 99 plant counts in one house and they let them keep it. As to them checking out houses with thermal guns that's also false or they are doing a terrible job because I know several people running 20 light grows that haven't got harassed because they keep their smell down and keep their yards up and don't have dread locks, wearing rasta colors everywhere they go and don't have people in and out of their house all of the time/weird hours of the night.
 
Pueblo county has an 18 plant limit but the Sheriff's know the ordinance is bullshit. Here's one example of many - Deputies who searched the home found 340 marijuana plants, some drying plants, and more than nine pounds of dried and packaged marijuana. They let Bryant keep 105 plants and 33 ounces of dried marijuana. They seized 239 plants, nine pounds of packaged marijuana, more than $20,000 in growing and processing equipment, and more than $6,000 in cash.

Same plants(cutting), but the temps have been 15-20 degree's cooler at night in the room with the 2 plants.

Agreed. Dunno much about the med side of things, but A64 clearly apportions plant counts per adult, not per household. Laws to the contrary are DOA in a courtroom.

Denver has a 12 per household ordinance our 3 adult household abides by simply because I don't need the hassle & the amount we produce fulfills our desires & then some. If it were otherwise, I'd move up to 18.

The whole notion will likely crumble the first time somebody says "you'll have to bust us to stop us". They'll just buffalo people who won't do that.

What will it take to FORCE the issue to be heard by a judge without the judge throwing the case out?

Case gets thrown out & there's no precedent set.
No precedent & enforcement of unjust, illegal laws continues.
This needs to be stopped in it's tracks before it even gets started.

there is an appeal process you go thru after the case is thrown out if you want to set the precedent

I thought a person could only get an appellate hearing if they didn't like their guilty verdict, or in the case of the prosecution, a not guilty verdict.

I thought a person could only get an appellate hearing if they didn't like their guilty verdict, or in the case of the prosecution, a not guilty verdict.
i'm not sure the details but i know you can appeal a case that has been thrown out

well its about time to vote hickenlooper out of office.

So who is going to run against him? A cannabis farmer perhaps for the next Gov., BUT who's going to interested in that intent? Who do you see as a better choice for the next Gov., perhaps we need to be starting a new movement... Who wants to be the next Gov.?
