Unless they are questioning you they are not obligated by law to Mirandize you. They would rather let you make "spontanious declarations" that they can use against you.

If they don't read you your miranda rights they can't use any "spontaneous declarations" against you, a lawyer will get that evidence thrown out.

Just wanted to chime in and say Krunch keep your head up. Glad to hear the lawyer is seeing holes in their procedures. Basically they're just trying to tax you for some money. I wish you could take a month off to relax after this, but as most of us know you've got to get back at it double time. Try and hit the gym to burn off that stress and get healthy. A good woman and a good meal can go a long way. Good things are coming.

The only time a policeman needs to read you your rights is when he is questioning you and has probable cause to believe that you have commited a crime.

If you choose to make statements or comments on your own, without being initiated by a policeman, they can and will be used against you. With or without Miranda.

Haven't been on for awhile. Just caught this. Sorry to hear this man. Alot of people at ICMAG have helped me get to where I am, whether knowing it or not and Krunch has certainly been a great inspiration. I have been told by MY attorney that Miranda rights and readings only need to be done if being questioned, and only affects statements you made.

I have been arrested a couple times w/o Miranda readings and was always told the same thing by my attorney

unfortunately, this happened to me also. cuffed/stuffed never heard one mention of miranda....and it never seemed to matter.

luckily, there are so many steps in your arrest (KB) that the donut storage modules MUST have f'd up somewhere.

When they pulled you over and they asked to search did you consent at that time?
That might not even matter because SB420 provides immunity from sales and transportation charges if you have a valid doctors rec.


This kinda trips me out though because they raided Dennis on Aug 4th at his house in SF...

nothing really to update. lawyer thinks we have an easy case, charges dropped, pot returned......excited about that....

couple things from the raid -

- they took all the seeds i was going to give away to seedbay. sucks, i took alot of time to separate the seeds from plant material. and the genetics were awesome, would of loved to see people try them...

- they took my bedsheets and half of my "white" clothes, underwear, socks and wifebeaters, would of been close to a full trash bag of whites, 40-60 lb's of clothes......

- i was very careful to never have anything that tied me to my residence. all it took was one bill in my car.......

I think Mass just passed something regarding searches when a cop 'smells' weed. Basically, he can not ascertain to the amount that is in the car, so just because he ~smells~ weed AND you are a cardholder, he does not have the right to search. Doesn't help in CA, but perhaps they have something similar? Not too up on your regs.

SB420, as I understand it, has been ruled invalid. Bills passed through the legislature alone are not allowed to overrule voter initiatives (prop 215). Good luck Krunch!
