Or maybe they just decided it was a waste of time because even if Trump came in he would just take the 5th (even though he's on video record multiple times saying that if you're innocent there's no need to take the 5th, only guilty people do that). Sure they could have tried to go after him for Contempt of Congress but they probably figured DOJ's got enough to indict him for such that adding such an insignificant charge by comparrison just wasn't worth wasting the court's time.
