I have no idea mainly because we have not compiled the information but if I do get cited for violating measure a 1. I will come into compliance and have this verified by an independent 3rd party so as not to stack fines 2. I will call for administrative hearing 3. I will sue the county for not allowing me time to come into compliance as mandated by state law. I will even try the libertarian argument in my hearing to see if it works but the threat of large fines on my properties is a deterrent from just saying fuck them and doing what I want to do. Like I said I'm not afraid of a five thousand dollar bill for administrative hearing cost it's our due process and we should all exercise it.

so much to get into but so little time.

so a friend was visited last week, issued a $500 fine just one violation for growing. he had his smart pots planted early but not that many. anyways, they told him they would call him prior to coming back. well they just showed up unannounced this morning, didn't say shit to anybody, just drove in, hopped out, saw the garden was empty, and left.



also i recently learned through the shasta movement that a federal judge in oakland recently ruled that the warrants were not valid and a bunch of other shit that sounds like its in our favor, but i havent been able to track that info down right now. tankerton this applies to what you just said because apparently in the ruling it said they need to give proper amount of time to come into compliance and 72 hours is not enough.

im in the middle of a whirlwind of bullshit right now over the next few days, but once it calms down a bit I'm gonna get back into this.


does anyone know when the next BOS meeting or measure A update is? where can citizens show up and voice their complaints directly to the BOS. and i would love to have a debate with all those measure A supporting idiots. really wish i was more active last year politically, but better late then never.

I just read that case and I don't really see henderson's ruling stating that the warrants were illegal rather they had no warrants at all and were abating the day they came

I think we should all stat sending Bill Connelly certified letters asking why he is subjecting his district to constitutional violations and warranties entry to properties demanding that he instruct staff to stop
 
I agree tank but right now they have issued 0 hearings even to those who have requested one which makes me wonder. They are either waiting to or aren't going to at all I don't know.

Also the 30 minute call is very important. My good friend was arrested in March and if he had videotape that showed code enforcement showing up ten minutes after they allegedly called instead of the required 30 his entire case would be dismissed. He also asked me to put out the word that if anyone has any raw video of code enforcement and sheriff doing criminal style searches it would help his case immensely.

That's awesome that you guys requested one, bravo!!! I applaud anyone who is doing this and the fact that they don't have it set up yet is going to work in your favor if you need to sue them. Their is no way it is legal to charge someone a grand a day to wait to be provided with due process.

For service of administrative warrant they are required to call you 30 minutes before the actually serve it. If they don't and you can prove it that search is invalid. It's time to invest in solar cameras for your gates and security cameras for your home.

also they are supposed to give 30 minute call for 2nd visit of abatement?

they literally just showed up at my homies spot this morning for the 72 hour abatement, no call at all. he was sitting there waiting and wondering why no one was calling. they drove in, saw the field was empty, and left right away without talking to anybody. fucking weird..

edit- wow wtf they are supposed to call 30 min before the inspection warrant? have you asked rob about that? when they showed up for the inspection warrant they didn't call anybody at all, only thing they did was mail a copy of warrant to property owner the next day. rob didn't mention anything about that?

is there a more aggressive lawyer in our area who is taking on the fight? i like Rob and i like his secretary even more =), but he is just a liaison who recommends playing by their book and taking it easy. id like to maybe get a 2nd lawyer on the team who is willing to charge into their offices and is open to suing the county for all their wrongdoings. i want them to fucking fix my god damn storage container now its totally open to theft!! what if i had thousands of dollars of tools in there that got stolen because they broke my damn latch and now i can't even fucking relock it.

I don't know exactly how that part works what I do know is they came to my friends house, when they said they wanted to search the greenhouse he told them to piss off without a warrant, they came back 5 days later 10 minutes after calling with an inspection warrant, they searched the greenhouse and handcuffed him when he protested about the search of his house and arrested him for 99 in gh and 300 plus clones 27 of which were rooted.

Did they finally come back to your one spot that didn't have anything there? How long was it between their initial visit and return? I'm still waiting on their return visit.

All of this was done under an administrative search warrant. He's hoping he can get a favorable ruling that all evidence was the fruit of the poisonous tree but otherwise it is going to trial. He's a pretty clean cut and straight shooting kid who was covered under a collective in LA so I like his chances either way.
 
So 2 confirmed inspection warrants.

What could / would they do? Arrest you for some bs charge just for being uncompliant?

Since there was no proof that the county came back to check if the plants were chopped, they could come back anytime during the season and if you re plant you would face fines from the first day you were cited, which means no season for people who got a check already or possibly face +100k in fines.
I agree its time to sue the county for anything even if it falls on county employees individually, at least it will have them second guessing the next time they hop a gate to serve a bunk inspection.
Whats up with the meetings? If they are closed, maybe an open format could be started that could get more people involved? I was at the grocery store this weekend and overheard a couple men in their 60's talking about property rights being violated, they didn't look like growers to me, but were clearly upset over it. Its time to get involved in the community and stop being completely underground if we want to be around next year without constant harassment.

tess- theres been more than 2 inspection warrants. i dont know the exact number but at least 3 confirmed in one area i know. two resulting in criminal charges, one for 40lbs and 300 plants and the other for a BHO lab. there was another one in concow area (bho lab, people from wisconsin) and another one in palermo over a high plant count i believe.

in general they are not charging people unless you have 1. BHO lab 2. dozens of dried LBs 3.guns 4. over 100 plants

tank- so inspection warrant spot as visited for inspection request, and they didn't serve a warrant until a whole 30 days later. however they did come and serve inspection requests on several neighbors just 2 days before warrant executed, one we believe was to get a better look of the property maybe they saw something that gave them enough probable cause. I'm still waiting on affidavit of warrant.

GH spot had a confirmed neighbor complaint over 3 months ago over some BS that happened at the neighbors property. so one person gave them a general complaint saying something like "that whole side of the hill is grows" blah blah. they came to gate in may, honked and left, then nothing for 3 weeks. then a chopper shows up and flew everybody's gardens here, including the GH. they came back one week after that to serve citations at the neighbors spots.

I'm telling you guys BRENDA LINDER. She is out of fresno and she is a bulldog. I know she has her hands full but she might be at a minimum be willing to sit down and give us some advice. She has been dealing with this for over a year now in fresno and some of her suits are coming up the pipelines now. Their 1000 plant first day fines make their ordinance way more libelous but also more incentive to accept the lawsuit settlement when the county eventually does settle. I have read some of her comments in news articles and social media and she seems like she knows areas of these ordinances she could attack but is always looking for solicit able plaintiffs to sue.
