Smoking On Probation?

im not talking about medical. You should ask them to cite the law which states you cannot use recreational cannabis while on probation. Not medical but recreational

it depends on your probation terms. WHen i was on they didnt care if i drank (which i dont). They could tell, but they didnt care if i did, bc it wasnt part of the terms of my probaiton

Well usually regardless of the crime,it always says not to consume drugs and alcohol or to be in a place that sells alcohol.at least in the states I've been on probation in.Cali may be different

Okay, so I've taken 2 tests...must've passed because I haven't heard from my p.o.? I don't know if this is true, but someone told me that if the p.o. contacts you after a drug test, you failed..if you don't hear anything, that's a good sign that you passed? hmm...I dunno, it's getting easier not to smoke, but the temptation is still there.

Passed another at home drug test though..so that's nice

Hey. I have been doing a ton of searching for people's personal experience with using mmj while on probation while in possession of a current, legitimate purple card.

Needless to say, I am a bit frustrated and suprised that more people are not coming forward with their personal experiences. I am glad we are learning about hops5k's sitch and able to provide some insight but the real kicker is that he says his conviction involve marijuana. That is basically one of the stipulations in the law that prevent current card holders from using mmj in co.

My sitch is that I can't use drugs or acohol as a condition of my bond while on pretrial. So atm, the law does not apply to me, I'm not on probation yet. However I am facing a dui charge ( blew .09) strictly for alcohol and am most likely going to plead out. I posses the card, it's my third renewal, and fully intend to smoke after I am sentenced.

Puhhhlease can more people come forward with personal experiences... if you know someone that is facing the same dilemma, please encourage them to post on this forum. It is only through open communication and a demand for our rights to medicate with mmj that this law will be interpreted in favor of those people who are affected.

Fyi... I thank the system for showing me how much I love herb for what it is and not just to get high. I can llok at my friends buds for hours and still love growing the plant/ trimming without an overwhelming need to medicate... and that is after 22+ years of smoking roughly 2 grams a day. And it really is all about perspective and balance like anything else in life. People talk about withdrawal symptoms when they stop using. I sleep fine the very next day because I force my mind to focus on other things.

your PO is the important figure here. if you are in a lenient state, and he aint a prick (and you don't TREAT him like one) you are probably good to go. last time i was on probation, i just asked my PO "are you going to be at my house wanting me to pee in a cup?" she just shook her head and said "if you don't do something stupid and get arrested again, you won't have any problems with me. they need to legalize pot and quit complicating my damn life. what a waste of fucking time..." so i took a joint to every meeting with her & burned it on the way back home.

I am in Colorado, and he isn't a prick by any stretch of the imagination. I haven't even been tested in over a week now..kinda wondering what's going on here since it was just about every 6 days it seems for the first two..now, nothing since the 13th.

can they just take you off UA's without notifying you? That would be so cool.

Now it's getting really easy not to toke up..don't feel I need it as much, or just don't want it as much now. This clear headed feeling is all new to me man, it's like addicting...I bet I could get blazed off of like two hits now...sweet!

only way i passed probation was with a device called the Whizzinator". Before i found out about this thing i was always going back to Jail on a POV,but that was a long time ago. ur best best is like others stated just quit for a while and start stacking ur money..gl

Well like I said before, the first test they usually don't violate you because they almost expect people to be dirty their first visit to the Probation Office. So what they look for is the numbers to go down which shows abstinence. As long as the numbers go down then they continue to not violate you. If the numbers go up though then it's proof you used on probation and therefore you'll likely get violated.

I spent 5 years on probation in california for a MJ charge ... used my med card and puffed my way through the whole thing ... been over for a good many years now..... so glad Actually threw down some pretty nice grows while on probation. My advice is petition the judge

Who knows how long I'll be on UA's...so yeah, petitioning the judge might be a good idea, I dunno...how do I even do that anyways? What is it, like, I state that I need to medicate while on probation and why I need to?

My PO said something about it, but didn't get into detail...I'll ask him this week when I go.

Just start out by telling your probation officer that you need to medicate ... and have a doctors rec to do so . I never had to directly petition the court ... once my Probation officer saw my rec i was good to go.

Been kicking it with this girl I met at comm. service..we're in the same boat and can't smoke, but we get along great! She's really cool and we're going to see Zac Brown Band on Friday..should be awesome!

Maybe it has to do with the fact that I'm more motivated to do stuff without smoking herb, I dunno..been waking at 7am every day, writing, going to work, it's awesome to have a ton of energy and do stuff that is productive.

Hope my po is happy that I have a job and am not causing him any trouble...shit man, things are going good and it's been a kick ass summer so far and only getting better..should have my own place at the end of the month depending on the bills I have to pay, too, so that will be ultra nice

Yeah, I was kind of wondering sounds to me like you got a lot going right, You sound like a P.O.'s wet dream of a case. Staying out of trouble, not using, employed and has a fixed address? What's not to like?

don't know about where you are, but here in Tennessee you can go ahead and pay off your probation fees ahead of time & they'll call it even & release you from probation. this is not for ALL offenses, but i know a couple of folks that have done it. can't hurt to ask...

So a friend of mine told me that I should get prescription for Marinol to use on probation..since it's federally legal, I could use it and the drug tests would be either done or I could come up positive and nothing could happen. He did this for 3 years he told me and he said that they just took him off drug tests after that.

Is this true?

My attorney has never been able to accept the notion—often espoused by reformed drug abusers and especially popular among those on probation—that you can get a lot higher without drugs than with them.
