Start a small business that deals with cash people it's not that freakin hard. Go to the business bureau and start a ficticious name. Go to a bank and open a business account, "So and so grass cutting" or "Chop You Up Barber Shop." . Then you can file a 1099 on your dope monies. Wise the phuck up..

Peace

That is the last thing somebody should do then you have just commited tax fraud which is a lot more serious then what he is already facing please people don't give advice like this to somebody unless you know 100% that it is something that will work it isn't hard for them to prove that your bs business is a fake and then your looking at like 20 years!!!

No...it's exactly what one would do....although the details of all above inaccurate...(1099's for independent contractors, Schedule C for business owners, fictitious name a DBA with ones county, not 20yrs for declaring and paying taxes on income, and so on.....)

Any lawyer worth a damn will get this money back fast. An illegal search/ That alone is enough. AND, it is NOT up to US to prove our innocence, it is the duty of the powers that be to prove you were in fact in violation of a law. there is NO LAW that states how much cash you can carry. Cops are just dirty thieves that try to steal your cash...then hope you go away and do not fight it. if you do fight it, you will get it back.

you do NOT have to prove where you got it; THEY must prove that it was from an illegal source, and since they cannot do that, they will lose after you get a lawyer and pay.

Sadly, MOST of these cases result when drivers talk to a filthy cop...and answer questions..and get led into admitting that you have cash. totally illegal searches are not as common as once thought. Cop want to win in court, and will try to get consent. Maybe your friend didn't tell you all the details? Maybe he DID answer questions..maybe he DID give consent...maybe the search was legal..who knows?

In any event, had that been ME, the cop would be facing a federal USC 18; 1943 civil rights lawsuit as well as any other hassles I could give him. never give up, and never give in. Screw thse filthy, nasty, thieveing cops..may they all get cancer of the brain and suffer the fate of the damned.

Not that is not true either because it's a civil matter then they don't have to prove their case because they is no risk of you going to jail over it in civil cases the law is you must prove your case only in cases that have the threat of a person going to jail does the government have to prove their case against you!

I have a friend of mine that was selling pot and wanted to pay taxes so he could build credit he bought a bunch of camera's and stuff and filed taxes he was later charged with tax fraud convicted and I believe he was sentenced to something like 12 years for it look up the sentencing guidlines on tax fraud it's pretty scary.

Most tax fraud penalties range from 1-5yrs, (prison not being the objective to begin with) and in smaller cases (drug) the majority of the time IRS never becomes involved.

I don't buy it.

Another amazing thing, people that believe you can go to jail for actually paying your taxes! Unbe-fucking-lievable!

HydroManiac, either your friend lied to you, or you misunderstood, or you're just making the whole thing up.

Well.......IRS does have it all covered......ie: Illegal income must be declared, it's income, (not would be evasion), but then it's also a crime (fraud) to lie on returns:smoke: (3yr max sentence), and then how it is approached also becomes factor (laundering laws and such......)

If one ever wants to use it, has to be banked, anything banked must be declared....and on and on.......

Doesn't seem to come into play with majority of drug cases.....(except all documentation or lack of helping in the process with their drug investigation.....)

Complex subject.......1,000 different approaches....(with some actually good..:smoke:)

People usually don't think carefully enough about cash and assets.....once you make the decision....can't be reversed.....(already documented, etc....ie: Someone reporting 20k a yr but owns a Diablo......someone banking 190k a yr but reports 30.....and on and on.......)

If your not banking it, means also no assets purchased with it......spending also has to be watched....and on and on and on.......

Documentation something most never pay enough attention to.........was a full warrant posted about a case (40 something pages) somewhere, which was essentially a "what not to do", in the sense he basically slipped on every single aspect....ie: They pulled his mortgage applications, credit card applications, job info0rmation, income information........all seemingly "insignificant" to him at the time, but all used to build the case.....

Here it is. "Related links", pdf, left side of page, middle page.

Something I would suggest everyone read for insight on investigation, process, and how documentation might affect one in future if not thought about at the time.

Having money is not too much of a problem if you have a job though, right?

As long as it is not ridiculous. A few months ago I had an unusual problem that lasted a few months, and I carried about $4000 or more around with me everwhere. I never worried about having to explain it's origin. Although, that sucks that you do have to prove money you have is earned. I guess according to the IRS it is Earned Income.
Well, like anything.....depends on situation.....specifics.....etc.....

Specifics like?
What are you driving? What do you do? What are you wearing? What is your job/business?.........

Vehicles?......:smoke: There's like........1,000 places to hide something that local would never find (and they'd have to be pretty hot for something to search that well, to get to that point to begin with......(again, variables of Interstate stop vs. a local......)

I'd say carrying one would be wise to carry the receipt from withdrawing it from the bank also :smoke:

Not to mention what is it......100's, crisp.....20's?..:smoke:......so...that';s a big thing right there........(20's, 10's, wrapped in bags vs. crisp 100's in a wallet....:smoke:.....)

Julian knows whats up..I'm not suggesting people cheat on their taxes. Your paying your taxes. Who does the IRS come after? The guys who make mills and don't pay shit.. They're not worried about the cat that pays his taxes on time for his little 50k a year home business. Plus you deal in cash so who can say what you made or owe but you. The ultimate goal is to be legit but you have to work your way towards that.

There are many ways to get around this problem. It takes a bit of law knowledge a pinch of business savy and two great big cajones. You can start a small business for about $250. Most small businesses don't even make money the first year so it's no pressure to even pay taxes at first. Unless you want to finance a Covette or Condo in the first year. You can't do it!!!! Also lawyers are some of the best friends a person with cash can have. You just have to ask the right questions. They won't tell you how to break the law but they will tell you how you can flex this shit out of it.

Last time I had a biz license in California, I had to pay taxes on $20K profit, even if I made $0 the first year, as they assume you're gaming their system I guess. Just a caution...

Well, again, lot of angles.....ie: getting an audit on claiming excess deductions and them finding criminal matters vs. getting exposed in drug investigation....

Most accountants have a large stable of people who work with cash :smoke:, so.....most would be able to help someone....:smoke:

What and how an endless topic, with endless scenarios....truly......I think something most people don't pay enough attention to....

Lot of all the issues depend on who and what you are, what your doing, how much cash is involved, and on and on....

When you see a bust on tv that they say is major, and the cops confinscated xx dollars, and the plant were worth xx dollars, and it looks like the person as been doing it for xx time, the IRS is going to come to you and say that you owe them the maximum for all of those assumptions. You may have to prove that you didn't make that much. In the mean time the cops and the IRS are after all of your assets. People that get busted often lose every single thing the own no matter how large or small it is. People that come out of prison have the clothes on their back.

Well if your busted you wheren't handling your business from jump street. I'm talking preventive maintainance. Long before the dung hits the fan. These measures should be in place. I'm just saying while we growers are tilling soil and puffing J's we should also be in the law library trying to keep ahead of the game. It's a fact if you have no proof of income and you get popped, the cops don't even have to wait for the IRS to gaffle you up. If you have some type of job and a small, however legitimate business you a least have some recourse to try and save some of your things if worst comes to worst.

Anyone know what pro poker players file on their taxes?

The 5th Amendment to the Constitution of the United States of America:

"No person shall be held to answer for a capital, or otherwise infamous crime, unless on presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

Take it to the Supreme Court...see where it gets you ;)

JJ this has been going on for a lot longer than the Patriot Act.

Yeah, the Constitution is toilet paper because of the Patriot Act. Pretty damn unlucky if you ask me, wrong place at the wrong time for your friend.
