please elaborate...the DOJ actually came after him for perjury. he must have been into some serious shit to have this happen...

so he tried to purchase a firearm legally..checked NO...they denied him AND arrested and charged him??

np...

they really wanted him for his dealings with the marching powder.
they could never get a controlled buy on him.
he is a convicted felon who was buying a black powder rifle under the primitive arms exemption.
he did as you suggested and "just answered no" on the form(cuz he is stupid)
never got the gun(just changed his mind).
seven years later he gets into a bar fight in florida. he was sitting in the holding tank when they started bandying about the term "fugitive hold"
could not bond out when he tried.
a few hours later the marshals had him on a plane.
they kept him incommunicado for two weeks trying to get him to roll on this contacts.
he ended up at yazoo's minimum camp for 5.
federal perjury.

i realize this is an intricate situation with more variables than checking no but, lying on the form is just one way they could get at you .

they have to make us felons some how... if your non violent and have a mj card in a legal state its alot harder to make you a felon.... unless they make something that 90% of the people possess illegal for having a card... Now everyone is a felon again...

Not sure why this is such a shock. They're enforcing federal law that has been in place for decades. All of you gun owners (myself included) broke the law when you signed the form to get your license and asserted that you do not use illegal drugs of any kind. That's the bottom line. Yes, it sucks, no, I don't agree with it since the requirements for a firearm license do not preclude applicants from drinking liquor, but them's the breaks. Just playing devil's advocate here, don't shoot the messenger. :tiphat:

What Federal Law overrides an AMENDMENT TO THE CONSTITUTION...?

Only REPEAL of said AMENDMENT is my understanding...

This comment is wrong on several fronts.

First, not everyone has to fill out a 4473. Private sales from person to person are completely legal in my state without a background check and without a 4473. How exactly did I lie on a form I never filled out nor was ever required to fill out? I don't have a "firearm license" nor do I need one to own a gun in the USA. Also, mmj is not an "illegal substance" under state law. If the ATF wants to be more specific then they should amend the form.

Exact question: e. Are you an unlawful user of, or addicted to, marijuana or any depressant, stimulant, narcotic drug, or any other controlled substance? Answer is NO because mmj is legal here and Im not addicted.

This should infuriate the gun lobby. If the NRA doesn't act against this I'd be shocked and very dismayed.

I would hope so, but I just can't see them sticking their necks out for abunch of "stoners". And this is coming from an NRA lifetime member. :(

It just goes against their image of "Wholesome America".

First they came for the Communists but I was not a Communist so I did not speak out. Then they came for the Socialists and the Trade Unionists but I was not one of them, so I did not speak out. Then they came for the Jews but I was not Jewish so I did not speak out. And then they came for me, and there was no one left to speak out for me.

i watched my brother do 5 calendar in the fed @ yazoo for checking the wrong box.
he never even received a firearm!!!
picked him up 5 years later on some unrelated shit and had a federal o.t.t.i.c.

To late I checked no or I would not have got my .45. We do what we must.

Poopy hit the nail on the head. I don't think it's a matter of if, but when.. Medical card holders are just an easy group to start with, they already have them on a database to work from... they will find plenty of other reasons to put you on the no-buy list. They are just getting started.

I have talked to the NRA grass roots division twice now. they don't care at all. I even went as far as to call them sheep, and a joke to the defense of the second amendment. I told them shame on them.

FFL holders have long been unable to sell to individuals who are users of marijuana.

There are no exceptions in federal law for marijuana purportedly used for medical purposes, even if such use is sanctioned by state law.

Federal law prohibits individuals from owning firearms if they are an unlawful user as drugs. As long as medical marijuana is illegal on a federal level, individuals who choose to use it cannot own firearms.

I told her she was wrong, and explained how. no answer back yet.

It is time for us to bombard the NRA grass roots division until they get the point and speak up. There is 30,000 ICMAG members, with at least 5,000 of us on here daily. GET ON THOSE LETTERS NOW!
