it says you can't serve food prepared on site or any alcohol.

in many of these places they have caterers come in, food is prepared offsite and brought in

trying to find the full text so we can all know what the requirements will be.

as of NOW, there are NO requirements (hence the percieved NEED for legislation, by who other than legislators....)
no requirements other than don't get busted doing it.
POTUS club got raided with buy/bust, last 4.20 weekend
case was dropped iirc

i remember back when you could eat medicated foods, smoke, and purchase all at a single location, hb1284 got rid of all that by banning "onsite consumption" same bill that started all the badges and requirements, seed to sale tracking, everything concerning regulation started with 1284 in co.

if u wanted to be really liberal with the language.... it says you can't sell food prepared on site, but giving it away for free to members? don't say nothing about that.

in my experience a place would simply charge a small entrance fee (3-5$) for all entry on the days and times that food was available for free. (iBake style)

some of these clubs have already been operating for some time, and it seems that (aside for handing over a lump sum of $$$ to the state for "licensing") many have already been abiding by these rules, or actively avoiding falling into these kinds of rules;
example;
a place in cos uses a system where as a member you cn get a card that you load with credits, can be done online iirc. then you take the card to the spot and you can trade in those credits for food, weed, wax, dabs etc. (lazy lion style)

Excluding light snacks....

So if I went and rented a commercial property, and called it a Cannabis Club, that's it? Do I have to have members? Or even use it?

sure, i don't know, anything you can do to provide evidence that a club exists.
does it even need a permanent physical location? not until a bill is passes into law that says it must.

i think a big list of "member signatures" and perhaps some photos of gatherings (even camping vibes on private land, like Bontathon) should be enough to qualify is a "cannabis club"
the prevailing model UNTIL NOW has been "private members only" to cover your ass, meaning that not just anyone can just walkin off the street, unless accompanied by member.
problem is - if you really are private and members only, and operate on private land.... you really shouldn't need a license from the state imo.

these NEW licensed cannabis clubs will be open to public, so the whole "private members only" thing is kinda out the window i guess....

it's gonna be another goldrush over clubs now... state is poised to make a boatload just off application fees... again....

I think that they want to make sure that there is no cooking of food so cannabis infused meals can't be served, because if any left overs are taken of site it doesn't comply to their regs for edibles.

pretty sure serving medicated meals is ok, problem would be where they were produced... might have to be a MIP kitchen?
it's all about taking money for it,
you can't sell as a club, but you can allow consumption
so far that's my understanding

the new rules put cannabis clubs in the same licensing category as dispensaries and mips and opc's, as i read it, it includes clubs in the same category as new rec testing facilities, anyone buying rec herb might like to see that.

i'm saying that right NOW, before new rules come into play, you could make your kitchen appear to be a cannabis club in order to be grandfathered in...
should you, seafour, turn your kitchen into a cannabis club? hell no, i've seen that kitchen :D
but, getting gradfathered in would save someone thousands in licensing fees if they were wanting to go that route....

Its all bullshit control freak tactics probably counting to pass on the perceived laziness of stoners...
and no, my kitchen is small and full, but I do make edibles... which I could gift out making their bullshit null and void...

further, thats very vaguely writ... "establishment"

The gawddamned dictionary said:
es·tab·lish·ment
iˈstabliSHmənt/
noun
noun: establishment; noun: Establishment; noun: the Establishment

1.
the action of establishing something or being established.
"the establishment of a scholarship renews that personal interest of donors in students"
synonyms: foundation, institution, formation, inception, creation, installation; More
inauguration, start, initiation
"the establishment of a democracy"
archaic
a marriage.
plural noun: establishments
2.
a business organization, public institution, or household.
"hotels or catering establishments"
synonyms: business, firm, company, concern, enterprise, venture, organization, operation; More

So... literally... a household could apply... but based off what?
traffic?

If I have a big family that grills steaks very often and we smoke alot?
If I've got all the xbox games and friends come over often to smoke?

at what point is a new permit required? and with what inspections?

Is it only for an "establishment" to which permits (ie:alcohol/food service etc) already are applicable?

Its vague and it seems, as it is written, that it applies to my place... and probably all of yours as well...

...and I still cant figure out what problem they're trying to solve
unless that "problem" is simply "hey, figure out how can we make more money off of all this?"

Does anyone know a good lawyer that handles business/legal issues such as these?

i suppose industry standard is Rob Corry, duno if warren edson really practices anymore, but at one time he would take cases.
correy on the other hand will take your money anytime.... thats the best i can do right off the top of my head.

I'm sure he will, lawyers are good about that. Thanks.

Sent an email. Looks like his site is more geared for criminal defense.

I'm looking for counsel for issues such as the club discussion.

Cory's a waste of time and money, maybe if you got a legal case but most of these high profile weed lawyers are fucking clowns.
If you need a good (cannabis) business attorney and are not afraid to drop some money i can give you some names

It might not be a bad idea to put together a list of lawyers across Colorado who are doing work for counsel with Legal issues that are not just a criminal defense practice. I'm sure others are interested in starting up a legal company too, and finding counsel would be helpful for them too.

Im curious if out of state signatures would be good for said private clubs?

Id think that would be an ideal situation for out of staters.

Thanks CO government for "saving" us from unsafe home businesses that process concentrates, now artisans who've been reliable for years are cutting and running with people's money/shatter.

If you keep making laws until everyone is considered a criminal, they'll finally start acting like criminals.

Sent out some materials to be made into oil for myself and my wife, and now it looks like a pound of flower and 6 ozs of trim have just vanished, it's not like she has epilepsy and actually needs her medication daily, right?

Just got done telling someone this sort of thing was coming to an end thanks to the evolving industry, serves me right.
