Allright Butte County Its time for me to sign off from icmag for a while. I will still keep my account so feel free to PM me with any questions. Tri sierra get your posts to 50 and pm me I'm very interested in linking up with you and discussing things. I want to leave you with this though:

A. This is not a lost cause. If you live here, you love it, and you want to protect your property rights get involved.
B. Its time to get involved preemptively. If you have a garden and you haven't been visited Lawyer up and It is very likely you will be able to get to harvest.
C. If your not a grower or you know a non grower and have been visited we want to hear from you. There will be a fund set aside to specifically help non growers who's civil rights have been violated retain counsel.
D. Even if you don't have the full amount of money to retain a lawyer. Explain your situation and see if their is any paperwork that is suggested to file and our lawyer will figure out a per cost fee for you. They are very reasonable.
E. You do not have to talk or answer questions from code enforcement or sheriff or any one else even if you have been served an inspection warrant. It is absolutely recommended you don't say a word because anything you say can be used against you in a court of law. They are deliberately looking for evidence to arrest you for sales and cultivation even though they don't have a criminal warrant. You do however need to provide identification if you have it.
F. ***** Always have a video recording device on you and charged if you are at your farm. You have the absolute right to film your encounter and it is absolutely recommended*****
G. Keep your scripts in plain view at all times. Its better to keep things on the civil side of the law at all times.
H. Even if the convoy illegally enters the property and sees your setup you still have the right to tell them to leave if they don't have a warrant.
I. No county in California has the right to disturb your property through zoning ordinances without giving you due process first. That extends to your medical marijuana plants and anything else on your property.
J. We have a clear concise plan in place but you all need to buy into it. We will have a large group meeting next week where our attorney will make a presentation and you all will have an opportunity to ask questions. Time and place is undetermined but as soon as I know you'll know.

yea positive news today but action is still needed mostly in making the county growers aware of their rights and course of action to fight the countys illegal enforcement of measure A. Every time they execute a warrant or trepass/harass during their efforts needs to be documented and run past the lawyers to see if there is grounds for legal action. Please talk to your neighbors, friends, etc that have been affected by measure A and get their statements!

also to add onto tankertons points…

DO NOT ACCEPT AN INSPECTION WARRANT WITHOUT 24hr notification of warrant. If they show up to your gate with one of their phony inspection warrants, and they have not given you 24hr notification, then refuse the warrant and advise them of the 24hr requirement and to call your lawyer. If they still insist on entering, keep those cameras rolling.

Once served a warrant, use a lawyer to request the warrant affidavit, this is very important! Their probable cause is not up to standards of law and needs to be checked. The inspection warrants are blank and do not show the real probable cause, which needs to be viewed by the lawyer.

Request the administrative hearing through your lawyer as well. You only need to pay 1-2 hours of time (150-300$) which is very reasonable no need to pay thousands for retainer.

Talk with your lawyer about the hearing processs and exact timeline in person. There is a process involving at least 10-25+ days that will drag the process out, some people are past 30 days without any hearing. The lawyer will guide you through the hearing process once it goes to fine/penalty stage.

Dont be intimidated by the fines, there is lengthly process that can take 5 years before the county could ever collect, and they will need to pay county counsel to go to court to even collect. Recent court rulings have shown these fines to be illegal under CA state law.

all of the major bullet points need to be copied and pasted to the new website, then we can just funnel victims straight to the website so everyone can learn their rights and how to fight this.

oldcountry - i love that idea, I've been tempted to start mailing to the addresses as well however some are remote and not serviceable by mail so the only way is to get property owner info which could be sketchy depending on non tolerant landlords.

also one last thing, if you have tried to go to the county and obtain permits to fix any measure A related permit violations, and are encountering discrimination and a tough permitting process, then please PM me asap with details and we can see if legal counsel can help you through that as well. i am very interested in hearing other property owners experiences in dealing with developmental services.

alot of measure A checks are resulting in permit violations outside marijuana cultivation. These include requiring building permits, electrical permits, plumbing permits, etc etc.

my initial experience with the county is that they are not treating measure A related permit cases fairly, they are presuming guilt of permit applicants for growing marijuana when that is NOT their job! they are lying and pressuring applicants into doing fixes they dont need to. they told me "you have too many ACs in your shop you need to take them out so you can't grow marijuana anymore in there" which is total BULLSHIT intimidation and lies.

if developmental services (same department as code enforcement) gives you any BS lines about marijuana cultivation or you feel they are abusing their power, ASK THEM TO PUT THEIR STATEMENT IN WRITING, and then contact the lawyer.

yes spread the word to GET PICTURES OF HELICOPTERS, the YPC is going to file an FAA complaint against the yuba sheriff chopper for unsafe flights might as well do the same for butte sheriff.

Saw the same white plane yesterday flying 8's back and forth across from berry creek to Palermo. I left at 8am and came back at 5pm and he was still flying around. It has about 4 windows on each side of it.Maybe full of CE taking pics?

Same plane was spotted in 3 locations do that same thing in yuba. The same 3 places the larger blue and white chopper was hovering people's gardens. Coincidence? That plane did like 15 passes over my neighborhood using the same exact straight line back.and forth. It is not pilot license training. I've seen that plenty as I live close to the brownsville airport. The plane is too large for that too, something is going on, it's big enough to carry equipment, too big for joy riding unless they are rich and can afford the fuel and are clearly bored out their gord.

Last year, residents of Lodi, California noticed a tiny Cessna 182 moving in slow circles over their small town, just circling and circling for at least a month.

The Lodi News-Sentinel got a hold of a picture of the mystery plane, checked its tail number with the FAA and traced it to the Northwest Aircraft Leasing Corp. in Newark, Delaware. The listed address, reporters found, was a mail drop

Stay up on encryption folks, stingrays snap up everyone's data who connects. Not just the "target." Just more trampling of the constitution.

You have to be actually sending or receiving data wireless for them to intercept. They can't just pry into your hard drive with stingray but I bet they have the tech. To do that lol!

That's certainly scary though. I doubt the feds will actually get involved with all the smaller gardens but maybe net5 rented it out or got a department of.home land security grant. That's how they back door funds after declaring they won't fund enforcement to legal or medical states anymore.

Fisher, did you see the blue and white chopper over there about a weeks ago?

The one in yuba is bigger then that, atleast the one that was over my hood. same thing though 15 or so slow passes over the same area all day
 
I've seen the blue and white here in the flats going back the way black county copter was going on the same day. Looked like they were getting different visual angles.

Are you sure its not the same one? That looks identical to the one I've seen flying very low. It's passed over twice that I've seen already today but at higher altitudes this time.
