I see that they've served a few out in Forbestown. I hadn't noticed many flyovers in that area, but they may be expanding their area.

I saw the white helicopter flying off of Black Bart Rd. yesterday.

Just posted this in the yuba thread but thought you guys might want to see this as well because it is CALIFORNIA civil code of procedure.

Anyways, here's what hall need to know if they show up at your place, this is from a handout the lawyer gave us at the last meeting.

- property inspections in the code enforcement context are subject to constitutional prohibitions against unreasonable search and seizures.
- if the things or places to be searched are constitutionally protected, then a code enforcement official, absent consent or emergency, must obtain an inspection warrant before proceeding with an inspection.
- inspections warrant must be based on affidavit that specifically describes the place and things to be inspected and the purpose for the inspection. (CCM 1822.51)
- it's only good for 14 days and must be executed between 8am and 6pm.
- if prior consent of the responsible party has been sought and refused, 24 hour prior notice of the inspection mist be given. (CCP 1822.55-1822.56)

- penal code 373(a) for criminal enforcement authority for nuisance conditions.
- if it is a clear violation, according to the above code, they can charge you with a misdemeanor.*

- due process consideration;
- the minimal standard is adequate notice and opportunity to be heard on the issues before a fair and impartial hearing or body.

- the underlying premise behind adequate notice is that the citizen has a chance to defend the charges:
- before property interest are disrupted.
- before assessments of penalties are imposed.*
- or when a penalty or forfeiture might be suffered for the mere failure to act.

- where they have failed is that notice and opportunity to appeal must be in place before disturbing a property right.


It might be wise to copy and print that so you can cite the codes to CE and the sherriff if anything happens. That's your best initial deffense is to show them your not dumb and are law savy.

Your medicinal most likely counts as a "property interest."

What is going on in butte.

Sunfire did they make a flyer of some sort that you can just hand to over if they ever come stating all the info you just posted.

Yeah we got a flyer at the meeting, that's where I got all that. Just print out my post and that can be your flyer.

There was appellette court today for butte. Don't know the result though. Maybe tankerton will post soon.
 
Good luck I thought about it but I don't have an attorney. They would be here in no time.
I don't want to be the guy that gets the 150,000$ citation, or have them sue for it and get a lien on the place, or constantly worry about getting raided every single day (even though i have been already for two months)
you don't think they'll go through with their whole plan?

I heard from multiple sources there was appellette court for butte on monday. Idk though, that's what I was told by the guy I'd say to contact to ask lol!!

Did you look at the california civil procedural codes i posted?

It would be illegal to fine you or put a lien on your property without the due process. Yes CE in butte appears not give a fuck but they will continue that way until yall put em in check!!! You want an attorney? Pm me but I belive her in for was posted here before. She's takin new butte plaintiffs.

They are targeting you all as well which is illegal. Are they using the chopper and all this money to look for unpermitted structures, piles of trash, broken down cars, improper electrical or plumbing??? Equal protection violations everywhere.

Yall need to get on board with the lawsuits to ever see any change. It's clear as day they are fucken up left and right.

we will get a few cases funneled to the new lawyer, she will be able to attack the fine system in butte and hopefully beat them. butte won't have a large high publicity coalition like yuba just yet, right now we are taking the angle of separate cases one by one to tackle specific issues. i love the idea of class action style lawsuit but all the lawyers say no to that for now, just cases one by one and done on each plaintiffs own motivation. i currently cannot file a lawsuit, I'm playing with the county right now and seeing their permitting process, there are signs they are discriminating against me and won't issue me anything, which could be fodder for my own lawsuit down the road since i already have the land lawyers on retainer might as well blow that money. anyways, I'm going at it from the angle that I'm a law abiding property owner who wants to come into compliance, pay and acquire all permits legally. and if they decide to give that a hard time i would for sure say thats grounds for a discrimination lawsuit, which I'm talking with about my lawyer soon. until then i have to at least give butthole county a chance to let a property owner go through the process of fixing permit violations.

also still no word on inspection warrant, they are delaying and hiding information big time. everybody who has gotten inspection warrant NEEDS to join me and push them for affidavit, do it through a lawyer its only an hour or two of their time. island mountain managed to release half their warrant affidavit after the huge raid last month in the triangle, why can't they release a small code violation case!!!

did anyone notice an absence of any mord/bweb checks from 6/30-7/3, thats the entire week prior to 4th of july, only the raid in forbestown seemed to occur.
