the news article reads like a classic propaganda piece, yet 99% of the comments are anti measure A and in favor of property and grow rights.

the support exists out there, it just needs to be contacted, organized and mobilized…

this update is almost a good thing, lull them into complacency and think things are alright. and then the big surprise will hit them….

a weird call came in regarding a measure A check on santos ranch rd off hwy 32. says that after a measure A check the residents loaded up a trailer with plants and drove off and they were trying to dispatch units to catch it while driving.

also numerous reports of 2 choppers and a plane flying the area right east of Lakeside market, which is where they have been hitting alot, same ridge where the 2 busts were earlier this year.

they looked into car windows and ran the plates, but no actual search of vehicle.

it sounds like that one incident the code enforcement officers visually saw the trailer leave and since they were already at a neighbors doing another compliance check they request CHP or someone else pull it over.

New to ICMag, was recently encouraged to join and am happy to no longer be a silent observer. encouraging to hear that the oppressive enforcement in Butte could be coming to and end if we be band together and start putting our money in the right places. My family operates a small farm in butte that will be fallow this season because our psyche just could handle another round this year. We've been meeting with lawyers all spring and had finally landed on a firm operating out of SF but I am intrigued by this Pier 5 group Sunfire is referring to, I haven't heard of them. Would they be able to set up a coop/collective and prep our small farm for legalization licensing framework, how could we go about getting a consult? Going to try to stay active here so our farm can help, we Butte-rs gotta unite, together we can grow!

Pier 5 is where the grand wizard of canna law, Tony serra resides. He's no joke but extremely expensive and old. He has a team of underlings for are younger and fresher. Kali Gretch is with pier 5 and I know she's done work in butte before. I know I've shared that info before but maybe butte should consider getting some more help from a non local? We are getting another lawyer on board in yuba already. You all should start assembling the team as well.

I wonder what San Bernardino will say so butte county after they get bitch slapped with a wave settlement claims.

Mg you know people are growing full sun in SB/mojave desert people are getting busted with hundreds in landers and pinion all the time. I've seen Palm Springs outdoor without shade cloth anything is possible with lots of mulch,water and frowned upon I know ...soil moist.

the majority of those ones are Asians/Hispanics not that race makes a difference...but it is something I've noticed.

the deserts water situation isn't quite as bad as the LA basin

I know people that have had successful pulls in screenhouses and in full sun on a small scale(6)...one homie got rolled because a cop saw his screenhouse from the street, in a standard tract style neighborhood...that wasn't pretty...

last year during their big sweep in the desert I remember reading that they rolled a guy that had ONE plant!...

I wouldn't grow outdoors in SB county at all personally...

fwiw they have been using the code enforcement inspection warrant tactic on commercial grows in that area as well, since at least the beginning of last summer...

Oroville >> As the first year of Measure A enters the summer, the number of cases involving Butte County's regulation of the size of medical marijuana grows has hit 512.

As of Monday, the vast majority of the cases, 402, pertain to the size of the cultivation area, according to development services director Tim Snellings. He told the Board of Supervisors during Tuesday's meeting that most of the cases involve growing areas considerably larger than the sizes set by the voter-approved measure.

"This is 5,000 square feet instead of 50 square feet," Snellings said

Under Measure A, growing area dimensions in unincorporated Butte County are based on parcel size. Properties of a half-acre or less may have indoor growing areas of up to 120 square feet. Larger parcels may have indoor or outdoor grows, ranging from 50 square feet for properties less than 5 acres to 150 square feet for lots 10 acres or larger.

Thus far, 60 of the cases have resulted in citations, totalling $145,500 in fines. Officials have received $27,870.

There are 69 active cases and 73 cases pending review. More than 45 percent of cases are monitored but were in compliance at last check.

Officials have closed 52 cases, which include properties that removed their gardens or didn't have one. Snellings said some of these cases are residents who grew last year, but didn't in 2015.

Currently officials are receiving 40 to 50 new cases each week. Snellings expected that rate to continue through September as plants grow taller and begin to emit a stronger scent.

Types of cases

In addition to garden sizes, Measure A also amended the county codes to include requirements for properties with grows, such as having an occupied residence, renters having permission from landowners and a permitted water source or connection.

The residency rules is the second highest type of Measure A case, with 63 cases. There have also been 11 cases for no permits, seven cases each for grows in public view and inadequate setbacks.

Snellings said nearly all growers checked have Proposition 215 doctor's recommendations. There is only one case involving recommendations.

Several residents have written this publication to complain that officials are entering properties without warrants, checking for items beyond grows and issuing citations for unrelated items.

Snellings said officials on a property to check a growing area may issue citations if they see other code violations, including for illegal structures, unpermitted water supply and wastewater disposal. The Sheriff's Office may take over cases where alleged criminal activity is spotted.

Officials follow a specific process when investigating cases, according to Snellings. With a sheriff's deputy or District Attorney's Office investigator standing by, code enforcement officials will first go to the door and ask for entry. If the resident refuses, officials can see an inspection warrant.

After a resident is served with an inspection warrant, they often have up to 24 hours to grant entry.

Snellings said most of the residents grant entry without the warrant.

Only nine inspection warrants have been served, according to code enforcement supervisor Chris Jellison.

Supervisors pleased

Following Snellings' report, Oroville-area Supervisor Bill Connelly said the number of calls to his office about the matter have dropped to zero. He said many people, including growers, are realizing the need to be polite with others.

"The positive effects outweigh anything negative," he said.

Chico-area Supervisor Larry Wahl supported the officials' work.

"It's been effective. It's been appreciated," he said.

Chico-area Supervisor Maureen Kirk said her constituents are happy too.

Snellings and County Administrative Officer Paul Hahn both noted that many county departments are working together to enforce Measure A. It's a team effort, according to Snellings.

(i) Any person who threatens the enjoyment of these provisions is guilty of a misdemeanor. The maximum penalties and fines of a misdemeanor may be imposed. (THE BOS, CODE ENFORCEMENT, ETC WILL BE CHARGED WITH A MISDEMEANOR FOR ENFORCING MEASURE X)

II. (a) Repeal, delete, and expunge any and all existing state and local statutory laws and regulations that conflict with the provisions of this Act.



(b) (1). Enactment of this Act shall include the case by case review for the purpose of sentence modification, amnesty, immediate release from prison, jail, parole, and probation, and/or clearing, expunging, and deletion of all cannabis hemp marijuana criminal records for all persons currently charged with, or convicted of any non-violent cannabis hemp marijuana offenses invalidated or modified by this act, which are hereby no longer illegal and/or applicable in the State of California. People who fall within this category that triggered an original sentence are included within this provision.

they were flying the new chopper today over forbestown and feather falls. mother fucker is quick and quiet, did some tight maneuvers, those piece of shit pigs sure are having fun with this marijuana enforcement. means they dont have to do any real tedious crime solving with meth and theft.

brenda is pushing some new litigation through in fresno, need to get that applied to some of the north counties we have the cases for them!
