Buddy just busted

1st OP I can't believe that you didn't read the house arrest papers before letting this guy into your house. That was the very least you could have done to find out what kind of license you are letting the cops have when it comes to having access to your home.

Thats the thing. I have read them several times, and read any state code that is referenced in them. Was even going to post them but its so riddled with proprietary information, its almost a custom form and the cops might be able to use whats not redacted to track down who it is. But the gist is nothing in it or the laws referenced in it gives the police the right to enter the house. It does say if he is out of the house for any of the reasons listed in the form that he is subject to probable cause for being stopped and checked out. And must have the papers on him at all times when out of the house.

Also we (the owners of the house) didn't sign anything, let alone sign away any rights. That and the behavior & body language of the one cop that visited make me pretty sure (but not positive) that the cops have no more right to enter my house than my neighbors house.

I'll return and revive this thread when something new happens. This is the kind of thread I want to read if I wasn't involved, just to get an idea of what happens - for real :)

My wife and I, and the judge and his clerk were in the courtroom during his televised arraignment. I got the feeling from the clerks that it doesn't ever happen that visitors come and view the hearing, but they let us in to view it. I heard the whole thing, and even in that the judge never said anything about giving up my rights. Actually, he didn't say jack shit to us, and only glanced our way for a split second. Almost like he was trying not to look over at us. And I know the judge personally from years ago when he was the escrow lawyer at my house closing. Yeah, its a small town. He was also the prosecutor later when I beat a speeding ticket, causing the city to pay the court costs. Thats a whole nother story. Called me by name then so I know he knows my name. :)

also, you are not considering the fact that the "buddy" was first asking for herb so he could pay for some DUI incident prior to getting busted for selling herb to a narc.

so this "buddy" with a recent DUI is gonna also get bail reduced from 50,000 to zero for the offense of selling herb? how does that work, really? so you just get a DUI, and get caught selling herb, and bam! court gives you free bail basically?

does this mean that if yu are to get caught selling herb, that you should get caught with a DUI prior to it so the court goes easy on you?

The DUI isn't resolved. In the US you are innocent, all the way up until you are proven guilty. He's currently innocent of any charge in the eyes of the court so the DUI charge is meaningless to the judge. Innocent until proven guilty isn't just words. He will actually get off on the DUI, or so says the lawyer. The first breathalyzer showed just under the limit. Cops waited another 1/2 hour, made him to the breathalyzer again and it was just over the limit. He was charged with that result instead of the first. Lawyer says its pretty much open and shut that the DUI case will be dismissed. Yeah, I know a lot about this buddy. He practically lived here even before this whole thing.

Lawyer wasn't even going to show up in court until the retainer was paid though. That was the reason for the rush in getting the money. The one day he spent in jail was the day the DUI appearance was supposed to have taken place,

You're delusional. "Innocent before proven guilty" is just words. Have you been busted before (yeah ... I think you're getting popped at the end of this story)? Do you know anyone else who has done time (yeah ... I think you will be the one in this Triangle doing time)? You better talk to someone who knows before you go betting your life on guess work and wishful thinking. Of course the Other snitch is relatively Clean and trying to act like it was someone else ...

I bet that one day in jail was enough for him to not want to go back. Idk about where you live but if you get a DUI its gonna cost about 7 grand after lawyer fees, missed days of work, and all the other crap you gotta do. Thats before he even got caught selling.
 
Yeah dude..not to harp on what EVERYONE is saying here, but dude, be smart......ITS JUST NOT WORTH IT...seriously...we all have/had friends like that...dont deal with him....He makes bad decisions and can not be trusted with adult shit.....He may be a friend, and Im sure you want to help him, but when it comes at an expense to you and your family, thats whgen its gone to far....Dude needs to find another place to live, like yesterday. Dont be dumb man....this shit will catch up with you, even more so since you live in a small town......

Heres a better idea, if you are hell bent on growing at this terrible time, how about some outdoor plants....just not on your property....be smart live to grow another day....I hope this thread gets through to you man..Good luck.

seems like your helping avery long term friend out the kind of person you KNOW will not rat on you. if that is not the case and some kinda friend type is living w you after his bust well then you have larger issues.....

I would never grow in that sport again, sucks you own the house in this market but i would try and sell and get out of podunk.
 
50 germinating seeds is going to weigh over 200 grams...cops yank those bitches up with the dirt and plop them on the scale right then. You are betting that a narco officer doesnt know how to get the most weight out of plants. Your roommate belongs to the state, so they can pick him up and search his residence at any time they please. And he probably ratted you out when they took him in for the distribution.

There are the people smart enough to take the proper caution and avoid being caught.
And there are those who are foolish and reckless and get busted.

It sounds like you're probably not in the former category.... and willfully so.

They're waiting to let those plants grow bigger before they bust you.
 
He had his court date last week, charges were dropped, house arrest void. Then told that the grand jury had indicted him on the same charges that morning. Lawyer walked over to the main courthouse and set up a date for arraignment next month.

No cops busted into my house during his 2 week house arrest and searched it. (because they can't according to my carefully crafted question to his lawyer). I also asked him if they could bust in and arrest at any time on the new charges. He said why would they do that, we just set up a date for arrraignment in the judges office. He didn't say they couldn't, but said its never happened. Buddy is going out of state early next week, will be back by Jun1, perfectly fine according to lawyer.

Seedlings were sitting in slightly too hot of a medium, took forever to sprout. 10 of the 50 sprouted, planted more, all 31 (now) are about 2 inches in height.

He still hasn't narked on me, as I knew would never happen. First court date on the revived charges, Jun 1

i just was going to ask why you made a new user acct and came right back to this thread and posted as yourself..Then I saw you have been banned (I thougt you just got paranoid and made a new acct cause of it)..but still, why out yourself?
 
Well if the mod who banned me over abbreviating "Japanese" wants to continue to hold a grudge he's perfectly welcome to re-ban me. I'm sure there are some Jewish people who are offended by the abbreviation too, but I won't walk on eggshells worrying about someone's speech police. No white guilt here, just white rhino :)
