He hasn't gotten away with either AFAIK. The first indictment was by the prosecutor, that was dropped in favor of an indictment by the grand jury. No clue why it works that way, but he's still in hot water.

We showed up to court for the first hearing, clerks said there was nothing here on the schedule, made a few phone calls and found out the info posted above. First thing the lawyer said was, well your not on house arrest, he can leave town but be back for the arraignment on Jun 1.

And yea, as the situation dictates, its much better to keep this guy as close to me as possible. Keeps your friends close, and your potential snitches closer. A variation on an old saying. Guy don't leave my sight if I can help it.

I dunno how keeping him close helps you. Especially if you were seriously considering popping 50 new beans and getting your operation back up and running.

Seems to me the more you can do to prove you have almost nothing to do with the guy aside from him being pseudofamily the better. Maybe you get some wierd rush out of keeping your potential downfall in the guest bedroom.

Didn't even finish law school.

If you can prove ENTRAPMENT, I would get a different lawyer that will get you off.

Lots of words can be used in some circumstances just fine while in others not so much. It is the context that defines malice.

True, thats the reason I don't try and walk on eggshells, verifying every single person on the planet will not be somehow offended by something I write.

also, you are not considering the fact that the "buddy" was first asking for herb so he could pay for some DUI incident prior to getting busted for selling herb to a narc.

so this "buddy" with a recent DUI is gonna also get bail reduced from 50,000 to zero for the offense of selling herb? how does that work, really? so you just get a DUI, and get caught selling herb, and bam! court gives you free bail basically?

does this mean that if yu are to get caught selling herb, that you should get caught with a DUI prior to it so the court goes easy on you?

Bail is determined based on your flight risk and not on the crime itself.

Thats what I said. I told him his lawyer sounds like a moron, and even in cases of actual entrapment its hard to use that defense.

He did pull a good move on the (two) Dui's for the guy though. Managed to not get a jail sentence (yet) anyway. In this state he was looking at 6-12 months mandatory for a second offence. He went to court on the second one last week, I didn't expect he would come back, he came back, and now that he's off house arrest hasn't been around much. He had one DUI, pled no contest, got a second one pled not guilty. Went to court for it and the lawyer told the judge he was appealing the 1st no contest pleading & guilty verdict. SO that whole 2nd DUI is postponed until the appeal of the 1st.

I think I'm in the clear on still growing.

Pretty good for having all my lights stored in another location, and these growing under two shop lights till I bring the good equipment back.

Starting tomorrow night Im building a new 8x12 growroom to accomidate them. My old area was just 2x6

Interesting side note to the buddy saga:

I had a knock at the door tonight, didn't know who it was and the dogs were barking like crazy. So I went around, out the back door and came out front to ask who it was. One guy was at the door and one sitting in a truck out in the road.

He said he was the repo man and had information that so and so (buddy) lived there. Well, the guy did have his car in my garage for about a month, but I need the space, and already knew it was subject to repo, so I drove it down to the corner supermarket yesterday and walked home.

He said can you help me, I need to know where this car is. Me, being an eternal dick to all authority told him yes, I know where its at right now, and easiest repo you'll ever get, the car is unattended, keys in it, but locked and for $200 I'll tell you where you can get it. He said it was more than he was getting for repo'ing the car, I shrugged, told him he was trespassing and to leave the property and don't come back. He left.

Oh, one thing I forgot - he said "would calling the police jog your memory", I said no.

Boring update. He came back from out of state, next day went to court for arraignment. I didn't go this time wife did though since he needed a ride. Glad I didn't because it was a 4 hour thing, mostly waiting. Came home on own recognizance again, no house arrest, said he can't go into any establishment with liquor, next court date sometime in August. There's one meeting next month with the lawyer and prosecutor that he doesn't have to attend. (probably discovery)

While he was gone I picked up my equipment and built a new (bigger room) room.

I'd have to say that I'm totally out of the picture. He has no clue the new grow is still going, or that it was started in the first place. August will be just prior to harvest.
