Texas Lieutenant Governor Dan Patrick has floated removing Biden from the state's ballot, citing his handling of the influx of migrants at the U.S.-Mexico border, during a Fox News interview in December.

"Seeing what happened in Colorado makes me think—except we believe in democracy in Texas—maybe we should take Joe Biden off the ballot in Texas for allowing 8 million people to cross the border since he's been president, disrupting our state," he said.

Patrick has not taken any official action to remove Biden from the ballot.

Missouri​

Missouri Secretary of State Jay Ashcroft has suggested he may move to have Biden removed from the state's ballot if the Supreme Court allows the Colorado and Maine decisions to stand.

"What has happened in Colorado & Maine is disgraceful & undermines our republic. While I expect the Supreme Court to overturn this, if not, Secretaries of State will step in & ensure the new legal standard for @realDonaldTrump applies equally to @JoeBiden," Ashcroft wrote in a post to X (formerly Twitter) on January 5.

He defended this stance during a Monday interview on CNN.

"There have been allegations that he has engaged in insurrection," he said, pointing to allegations he said have been made by Patrick. It is not clear what specific allegations about Biden he was referring to.

Florida​

Florida Governor Ron DeSantis, who is challenging Trump in the Republican presidential primary, has also said his state may consider removing Biden from the ballot.

"This is just going to be a tit for tat, and it's just not going to end well," he said during a campaign event last week. "You could make a case, and we're actually—I'm actually—looking at this in Florida now. Could we make a credible case [against] Biden because of the invasion of 8 million [migrants]? Again, I don't think that's the right way to do it."

Arizona, Georgia and Pennsylvania​

A coalition of conservative lawmakers from Arizona, Georgia and Pennsylvania, three critical swing states in the general election, have signaled they plan to try to remove Biden from their state's ballot.

Aaron Bernstine of the Pennsylvania House of Representatives, Cory McGarr of the Arizona House of Representatives and Charlice Byrd of the Georgia House of Representatives wrote in a statement that Biden is "100% not eligible to run for political office," according to Democrats' interpretation of the law.

"Democrats' insane justification to remove Trump can just as easily be applied to Joe Biden for his 'insurrection' at the southern border and his alleged corrupt family business dealings with China," they wrote.

Four Judges of DC Circuit Court of Appeals Excoriate Prior Executive Privilege Ruling, and The Admitted Scheme of Special Counsel Jack Smith​

In a 14-page opinion and ruling today [SEE pdf HERE] four judges from the DC Circuit Court of Appeals deconstruct the previous ruling from their own court as well as the DC judge beneath them that gave Special Counsel Jack Smith access to President Trump Twitter account data and then enforced a non-disclosure order.

There are multiple layers to this story, but the substantive part is the scheme and the construct of how the Lawfare took place. There’s no way this was coincidental; I’ll explain why.

First, there are only 7 members on the full DC Circuit Court of Appeals. When the Twitter case to gain access to President Trump communication came to the appellate level, somehow all three of the most left-wing judges were assigned to hear the appeal.

An “en banc” review would have included the full 7 members. However, that review was made moot by the release of the information (a result of the appellate decision). The release itself was done with the use of a non-disclosure order, hiding the ruling in secrecy and keeping President Trump from knowing about it. Once the other four members of the DC CCA eventually found out about the case and the ramifications for ‘executive privilege’ their opinion lambasting their own court is released.



As noted from the panel, “the court here permitted a special prosecutor to avoid even the assertion of executive privilege by allowing a warrant for presidential communications from a third party and then imposing a nondisclosure order.”

The Circuit Court justices note that Jack Smith could have gone to the National Archives for the information as they held the same set of documents and information. However, Smith didn’t want to go that route because the National Archives would inform President Trump as customary and provide him the ability to assert executive privilege over any of the 32 Direct Messages requested.



Jack Smith didn’t want President Trump to know the prosecution was looking through his Twitter metadata and personal communication, so they went to district court under seal to file their search warrants in secrecy; then banning Twitter (the third party) from telling President Trump about it. The four justices from the DC Circuit Court of Appeals are furious the other three members of the court went along with this precedent setting usurpation of authority.

President Trump could not appeal any part of this process because he was unaware it was taking place. In essence, a star-chamber of secrecy was established and the majority on DC Circuit Court of Appeals is not happy about it.

Jack Smith gained access after Twitter lost the 3-judge Circuit Court appeal decision. So, an en banc full 7-member ruling is essentially moot. The information was released, and Smith had access without President Trump or the White House having any option to assert privilege.

…”While a Twitter account primarily consists of public tweets, it may also include some private material, such as direct messages between users, drafts, and personal metadata. In fact, the material produced by Twitter included several dozen direct messages written by a sitting President. The district court afforded no opportunity for the former President to invoke executive privilege before disclosure, and this court made no mention of the privilege concerns entangled in a third-party search of a President’s social media account. This approach directly contravenes the principles and procedures long used to adjudicate claims of executive privilege.” [pdf HERE]


The ruling provides no remedy other than public scrutiny and perhaps fuel for Florida Judge Aileen Cannon who already has Special Counsel Jack Smith on his heels after several rulings in the Mar-a-Lago documents case.

What the publicity does is highlight to the world just how politically motivated all of this aforementioned action really is. Lastly, what are the odds of the random 3-judge panel to approve it. Even the DC Circuit Court itself seems to imply this was a structured outcome, which is even more infuriating to the majority within the court.

he's going to get the Republican nomination for sure. but realize you are talking about the guy who lost the popular vote in two consecutive elections. the first by 3 million votes and the second by 8 million votes.

he did legitimately win the 2016 election but by the electoral college only. he did legitimately lose in 2020 by losing both the popular vote and the electoral college.

the 2020 election was not a vote for Biden. nobody really likes Biden, then or now. it was a vote against Donald Trump.

and 2024 will be a vote against Donald Trump.

think about how the demographics have shifted even further against Trump since 2020. the cultists are older racists and are dying off at a high rate. their numbers are not being replaced by newly recruited young people. MAGA represents approx 34% of the total electorate. they are counting on non-MAGA Republicans and independents to help them win. i live in a deep red southern state and i know a bunch of sane intellectually conservative Republicans who have said that if Trump is the candidate they just won't vote. they find Trump to be embarrassing and resent his takeover of the party. and most independents can't stand him!

most newly registered first-time voters between 18-22 years of age are going to vote against Trump. there were almost 8 million new voters registered per year since 2020.

and let's not forget the Taylor Swift effect. She is vehemently against Trump and is spending time at every one of her concerts asking young people to register to defeat Trump. She has 72 million fans in the US alone. the estimates are that she is recruiting 25 to 35 thousand per month.

if i were you i wouldn't start celebrating just yet!

i won't celebrate even if Biden beats Chumply again, by an even LARGER margin. i will, however, breathe a deep sigh of relief that the barbarian horde has been beaten back away from the gates...:smoke:

Looking at the primary results from Iowa, Chump clearly won, but the republican anti-Chump vote is what needs to be watched. These are republicans who are not drinking the koolaide and will likely vote against Chump with Biden or a third party protest vote. On a national level, particularly in swing states, this is another losing combination for the malicious mango.

data recently came out and reinforced what i've been echoing here. democrats and liberals appealing to anti immigration and other right wing positions at great expense of progressives to try and court the right wing vote does not work.
