BigBudBill - I realize this. I doubt many are in there for a 24 sq ft grow.

got my legal mind a turning..

up until 19 cultivation has been categorized not by square footage but by plant numbers.

given that the burden of proof is ALWAYS on the state and '² never was an issue..
there could be a significant number of overturned convictions (or clemency granted) based on lack of evidence to prove an area greater than 25²'

Do you think anyone is in for cultivation as measured by sq ft? But people ARE in for growing 3 plants indoors..

There's always hope.

True, that is why we keep trying to get people to understand this bill is not perfect, but it is a base to work from. Then we can talk about clemency and stuff like that for current prisoners. If something like this doesn't pass now what could you use to better our movement? I see nothing anytime soon on the horizon. This needs to pass so there is a base to move forward.:thank you:

And of those 30K felonies how many were in the small category that 19 changes?

Only hash less than an OZ and growing in 5'x5' is changed by 19 ALL other CA felonies stay felonies don't they?

creating an avenue to introduce reasonable doubt.



so in keeping with the spirit of the discussion within the discussion..

of those 30k
the hash cases would be overturned
and
ALL growing cases could be overturned.

now this is all speculation but as reasonable speculation as some have speculated that monsanto,richard lee,george soros and phillip morris have conspired to get 19 passed so they could have multi thousand acre grows off shore...

I'm fine with BBBs IT IS A START point, but it is pure fantasy to claim 19 will help overturn previous grow convictions and if the state of CA takes the time to prosecute AFTER 19 passes I bet they only do so when they feel confident about obtaining a conviction.

but a good lawyer and a donation to the right 501 c:3 can work miracles....

all this bill is is a txx codifying bill anyone else voting on this for leaglization is a fucking idiot. it has nothing to do with legal but everything to do with taxes for the dumbasses in sactown who cant figure their shit out. Its legal in CA if you are medical, under an oz. is a minor violation with small fine. how much more legal do you need it. keep the money out of the hands of the govt. anyone living in CA who votes yes doesnt know what they are voting for.

As I take if/when 19 passes selling large amounts will still be a solid federal felony, so does it mean that anyone owning a shop would risk serious charges?
