Yes, one can. For example, if someone is charged with a crime that they did not commit and they put up a good legal defense. They may prove their innocence. It happens all the time. Of course they are supposed to be presumed innocent, but I think many jurrors presume guilt instead, unfortunately.

They aren't proving their innocence though. The state is failing to prove guilt. It's that "beyond a reasonable doubt" part of law. In theory, the state needs to show beyond a reasonable doubt that someone is guilty, if that potential doubt is there then they are supposed to get off. Of course that doesnt work in practice and lots of innocent people go to jail, but theoretically it should help protect against that.

I agree with you that war should have justification. Unfortunately, with the war on terror and the use of force authorization for the 9/11 wars means that any POTUS has a green light to do pretty much anything. As far as evidence for 'Salami,' it is probably only going to be shown to senate and house intel folk and not with the public, at least for a while. But, it is already acknowledged by all sides that he was a justifiable target except that it could trigger a negative reaction by Iran.
I saw 20, but it was unconfirmed.
We weren't attacked though. Unless you consider Iraq a part of the US now.
