Problem with neighbour - what would YOU do?

1) Contact landlord. Tell him the problem and you are building a gate on your property to access your property. (200-300$) Since the tenant will not move the stuff, tell the landlord that tenant needs to move stuff off your property. Explain it nicely, and state that you have been nice and it has gotten too bad. Mention to Landlord, that with this notice, tenant has created a fire hazard to your property, if landlord doesn't do anything, the landlord is liable for any fire damages to your property.

2) Contact tenant. Tell him remove trash immediately. Tell him that it is a fire hazard liability and he could be sued for any and all damages.

3) If tenant and/or landlord do not respond. move stuff over onto his property side and get ready to build a fence. OR remove the trash and bill them. Get ready for small claims court and have EVERYTHING documented as best you can.

i think i would pursue welderdans advise, i would add some cost due to damage to my property, re sod, paint, etc

Make it so that the landlord sees him as a liability, hes not in the business of spending money due to tenants...

One of the biggest problems with shit up against a house, is Termites may be able to build access tubes.

time to get the property surveyed and put up your own fence,,,yeehaw...contact landlord and tell him to remove anything of his or his tenant off your property...take pictures of everything including where marked stakes are put after survey

Sometimes property boundaries don't line up with the title or deed. In some cases a easement is givin. Basically its a contract that says for the rest of our lives, forever or until your whole family dies you can use this land to access your property.

In the U.S. It's common! State Parks, national parks or with farmers, oil and gas wells or in this case people... Or Canada missed that...

Hi folks - we have survey, I own about a foot and a half of his driveway running right down the side of my house. The owner put up a fence/gate between our houses, I had no problem, it wasn't locked & we only go to that side of house once in a blue moon.

Now tenant has locked the gate - restricting my access AND is piling his shit/garbage/tree trimmings, etc. against my house, inside the locked gate. I couldn't get to the stuff to move if I wanted to. He won't respect our specific requests to STOP doing this and I'm done talking to him.

We found landlord contact info - he gets a pleasant call tonight. I will be pleasant, he's not the one doing it, but the situation has to stop now! If I put up a fence to keep my house safe, because of the way the property lines go vs his driveway, he suddenly gets a 4 ft wide driveway (not so good for him, eh?).

I do very much appreciate all my brothers/sisters/persons adding to this thread - it's why I titled it "What would YOU do".

Did the property owner get your permission to put his fence up on your property? Whats stopping you from going around your house the other way to access that side?

Don't threaten the guy or do anything that puts you in a bad light. Document the junk he piles against your house with pictures.

Drop $500 on a lawyer to draw up a cease and desist and deliver it to his landlord via certified mail so you know the landlord got it. It is on the landlord to correct the situation. The threat of legal action should be enough to get the landlord off his ass. When the tenant becomes a problem for the landlord, you have the upper hand.

Don't bust up your knuckles on a chuckle head, or get yourself arrested for threatening to stomp his ass.

Better to drop $500 on a lawyer to handle it than $5000 on bail and more money on court fees and even more on a defense lawyer.


Solid game plan. I didn't think anyone else still used chuckle head. Classic.

Putting a fence in seems to be my only long term solution - the owner will lose a good chunk of his driveway but that's not my problem. The pile of brush, leaves & assorted backyard debris looks like a fucking hedge planted in asphalt right up against my house.

I asked nicely the first time, I told him quietly but firmly the second time -not doing the dance a third time.


The fence is your best bet for stopping the BS.


If you can erect it when he has gone out of town, even better. Pile all that shit up against the inside of his gate, put up the fence and then grab a cold one.


Imagine your own giddy laughter when he returns home to find that he cant get in the gate.

Our backyard fence - it runs from the end of my house to the end of the backyard. The only way to the side of my house is thru his gate - I actually own a chunk of the land used as his driveway.

I see. So you would have to take that fence down and erect another along the property line. Salvage as much of your fence as possible to save some $ on the new fence.

Our neighbors should get together and play hot potato with a live grenade - pin pulled.

Maybe telling the landlord that youll be forced to put up a fence, making his driveway useless, will get the job done. Awfully hard to rent a house with no driveway.

Interested to hear what the landlord says. If it comes to hiring a lawyer just do it. It will suck coughing up the dough but it will be worse if this issue keeps gnawing on you.

Just spoke with Landlord - I went with the approach "Not sure if your tenant mentioned this, but...". He said they had, but didn't go into particulars. I explained how this was 2nd time, we'd spoken to them twice but now we needed to make him aware & that we must be clear that this is not acceptable / he is now responsible to make sure it doesn't.

He asked how much of his driveway I owned, so I told him - but said that the issue isn't how much I own, but that I own the house AND the property & I cannot have this happen again. I also put him in charge of resolving the locked gate - I let him know the situation was unacceptable and he has to come to an arrangement that is OK with us. Either unlocked or we get a key. His call.

He was a tad gruff - I actually asked him a couple times if I was bothering him or if it was a bad time. Not that I care, but I hope he understands, as a home owner, where we are coming from (IDGAF if he doesn't - it's on his shoulders now).

So, now we wait - can't wait to see how neighbours react to me telling "Dad" (IDGAF if they are happy or not - not my problem).

Thanks again everyone - I have read every word & there were some damn fine suggestions in there. This site has a great family feel & I appreciate (most of) the family (there's the odd asshole cousin, but "ignore" takes care of them)
