How about the people in states like AZ and NJ who were waiting for word from the feds before implementing their programs? This is all the justification mmj opponents need to shut down or never start up their programs. Or what about existing, totally legal dispensaries whose banks and credit card companies have now been told very unambiguously they are subject to prosecution just for handling the proceeds from (federally) illegal drug transactions? Doesn't matter if any of the AG's threats are ever followed up. They only need to put the fear of the DEA into a relatively few people to throw a monkey wrench into the progress that's been made in recent years.

Sort of like how terrorists don't need to actually kill anybody to make people do some crazy things. Just the threat of some new kind of terrorist plot has led to government-sanctioned child molesting in our airports. Fear alone is sufficient, and the feds are counting on that to keep their war alive.

I'd offer that new regulations are most vulnerable because of people delta9nxs describes. Take a less than selective look at the wording of the latest memo. Don't expect the feds to tell states how to get away with a federal crime. Cali didn't word their reform laws in such a way that for-profit ops can go large. The latest clarifications appear to focus on profit (or the potential) through less than strict, state laws.

i dont believe that....runnning a dispensary in LA during the 04/05/06/07 years were waaay the fuck more fear of raids then there is now.... with bush you could count on 2x sweeping raids a year. around dec and around july/aug. i have not seen the same style raids. i see no evidence that were anywhere close to same amount of raids in obama as with bush. to say 2x more is straight bullshit

They're going on an article that compares W's ~200 raids to O's ~100. But they're pretty much zip over the increase in dispensaries. Statistics aren't always comprehensive.

his other cronies pelosi and reed have to be two of the most incompetent politicians to ever make it to their positions in our goverment and i cringe when i think of the impact they already have and will make on me and my family!!

not too single out dems in this i have to say i think most polititians suck it!

Medical Marijuana Community Decries Federal Threats Against Public Officials

Justice Department policy "clarification" pushes legal patients into unregulated, illicit markets

ASA Washington, DC -- Deputy U.S. Attorney General James Cole issued a controversial memorandum Wednesday in an apparent attempt to clarify federal policy with regard to medical marijuana. Calling marijuana "a dangerous drug," Cole's memo threatened enforcement actions against "Persons who are in the business of cultivating, selling or distributing marijuana, and those who knowingly facilitate such activities," including local and state officials. The memo further underscored that "State laws or local ordinances are not a defense to civil or criminal enforcement of federal law."

Medical marijuana advocates are decrying this new policy as a retreat from President Obama's pledge that he was "not going to be using Justice Department resources to try to circumvent state laws," and from the spirit of a previous memo issued by Deputy Attorney General David Ogden in October 2009. "It is disingenuous of the Obama Administration to say it is not attacking patients while obstructing the implementation of local and state medical marijuana laws," said Steph Sherer, Executive Director of Americans for Safe Access, the country's largest medical marijuana advocacy group. "The president is using intimidation tactics to stop elected officials from serving their constituents, thereby pushing patients into the illicit market."

Despite the wording of the Ogden memo that federal resources should not be used for "individuals whose actions are in clear and unambiguous compliance with existing state laws providing for the medical use of marijuana," Cole claimed that his memo was consistent with that of his predecessor. However, patient advocates are questioning what they call glaring inconsistencies. "How are federal threats against local and state officials who are adopting public health measures warranted at any time, let alone at a time of fiscal constraint?" asked Sherer. The Cole memo rejects attempts by state governments to design laws under which medical marijuana providers could be in "clear and unambiguous compliance."

Over the past few weeks, U.S. Attorneys have sent letters threatening public officials from at least 10 states with criminal prosecution if they implement laws regulating the production and distribution of medical marijuana. The Cole memo appeared to be an attempt to reinforce those threats. "At the same time the federal government is recognizing the rights of people living with cancer and other debilitating diseases to use medical marijuana, it is also denying them the means to obtain it legally," continued Sherer.

Unwilling to accept this level of hostility from the federal government, patient advocates are putting energy behind a number of initiatives, including a pending petition to reschedule marijuana from its current status as a drug with no medical value, and a number of Congressional bills that aim to reduce federal restrictions on how states implement their own medical marijuana laws. "Until states and localities have the ability to adopt and enforce their own laws regarding the production and distribution of medical cannabis, federal interference will continue to undermine the rights of the very patients the Justice Department purports to recognize," emphasized Sherer.

Sixteen states and the District of Columbia have legalized medical marijuana for patients with physician approval. Laws regulating dispensaries exist in 10 states -- Arizona, California, Colorado, Delaware, Maine, Michigan, New Jersey, New Mexico, Rhode Island, and Vermont -- but some states have suspended those laws as a result of federal intimidation. Notably, the states of Vermont and Delaware recently stood up to federal threats and defied such intimidation by passing laws licensing the distribution of medical marijuana.

I think this is more aimed toward large scale cultivation, and distribution. I have no doubt that most, forgive me I don't have figures, of those operations are for profit.

Yep, came in here to say this. The Feds are more concerned with "the commercial cultivation and distribution of marijuana purportedly for medical use" than they are with most of us. More specifically, they were really worried (or pissed) about state and local governments licensing, endorsing, or legalizing the commercial cultivation and distribution of marijuana.

Nothing to see here, we knew about this a year ago. Move on.

I think what gets alot of folks here, is that they blindly followed Obama, and mistook his vague, non specific generalities on the topic as something that he was going to actually do. I recall telling people during the campaign that this was going to happen, and then after the election, and then after the first raids a week after he took office. I heard alot of, "he's only been in office for a week, a month, 2 months, etc...
And now what was done in the dark is coming to light and people realize they were taken, (in their minds).
I just will never understand how someone can believe that a person representing a political party that lives, eats, breathes, and shits big government, government making decisions for all the stupid people, government involvement in the most mundane personal decisions, would decide on this one issue, that they are going to get government out of our lives. It ain't gonna happen. Hell it ain't gonna happen w/ any of the Republican candidates, because in reality they are not real William F Buckley conservatives...if they were, we wouldn't be having this conversation today. Fact is there is about a gnats ass hairs difference between the 2. If I have a choice between 1 person that I believe is lying to my face, and a person that I disagree w/ but has the decency to be honest about it, I will pick the honest person. You can't reason w/ or have a conversation w/ a liar. The honest person, (if they are honest) you do have a chance to have a discussion w/, and if they are in fact honest and you have the truth, then they will come around. The liar will keep playing off the ignorant masses and do stupid shit like hold online townhall meetings asking "the people" to submit questions, and then laugh in your face and disregard you like trash on the ground. Which I believe has happened at least 2 times now, or so I hear.

I had this crazy thought the other day, what if, (i know this would never happen), but what if on 4/20, instead of parading and shit, what if even half of the people that used/supported cannabis just turned themselves in for possession, at their local police stations, and demanded their day in court and just started taking up public resources while being housed and fed by the local gov? What if that happened in every city? Do you think that would get anyones attention? Might be more productive than getting 10k college kids together and all getting smoked out and getting a 5 second blurb on the news. Just thinking out loud here, using the term thinking loosely.

Everybody thinks that if they sign their name on a petition that SWAT will be kicking down their doors for their 3.5 grams of medical marijuana and their $5 china slave labored glass pipe....and were talking about a fucking peition. Imagine trying to convince them to turn themselfs in for possession of a joint? Im almost assured they would rather you rawdog their mom spun on tweek before you convince them to deal with a possession charge....and now here in CA all possession under 28 grams is an infraction. So they would just write you a ticket and escort you to the door.

Its simple and makes a loud statement but your right never get enough to do it then you will be reading a thread here on ic about some dillusional ranting idiot that turned himself in blabbering on about how the jail would brought to a grinding halt and the courts overrun with canna patriots...headline would read "stoner gets reefer madness on pot holiday...."
