Thanks for clearing that up.

It's been several years since we posted anything on this site.

( of course, it was under another monicker )

We started out on Vic's B.C.G.A. board, where Subcool and B.O.G. were early adopters.

Moved on to OG and CW, and then here, and one other, much smaller, "boutique" weed board.

Wish that our return here had been under better circumstances.

The good news is that Gypsy is out of that hell-hole, & we hope he stays that way.

We "brought it here" because the site is well attended, and we thought there would be a good chance to find other people who had also been screwed by H.T..

Hey if you made some sort of commercial deal with HT it was done for money .. most of us have known better then to deal with HT for years. Asked me to photograph my garden over 10 years ago .. I already knew better. Looks like any interest being shown here must all be by PM ... which im pretty sure you cant do yet. Good Luck

When content is STOLEN, and not compensated for, that's not considered a "commercial deal".

If you want to know more about the suit, and not make assumptions (you've made a LOT in this one thread already, BB) you can PM the OP.

Just to be clear, the Class Action suit has nothing to do with the takedown request issued to ICMag about the Hawaii event, although both show how HT abuses their position in the industry to bully others and restrain the trade of rivals.

From what I'm hearing, you're going to see HT popping up everywhere as they leverage that position in the industry to market even more products in more venues than ever before, for profit.

Lots of $$$$$$$ heading to HT and yes, their lawyers ensure they'll easily profit off the hard work of OTHERS - OK Weird? That is the issue here with the class action.

I did more trademark research and found that "Cannabis Cup" has been trademarked THREE TIMES by HT. Each with a different definition. If that doesn't prove how "generic" the term "Cannabis Cup", I don't know what does...

HT has trademarked and abandoned many other variants including North American Cannabis Cup, which is still active, again showing how generic and descriptive "Cannabis Cup" actually is, thus disqualifying it as a trademark on its own.

This is where peer pressure and legal pressure comes in.
HT's sinking rep is at stake.

Ask the Dutch how things went with HT at their last Cup there.
You'll notice they don't do Cups in Amsterdam anymore...My understanding is a lot of ppl and bizes got screwed there. I think the Dutch should speak up so others learn from them. The Dutch themselves manage to hold similar events without issues.

Haven't you noticed how HT Cups evolved from a true stoner event into a BIG BIZ that is still mismanaged apparently.

It might depend which book it was. Jorge was contracted to HT for many years, so the question is did you grant Jorge the limited use copyright or HT?

You'd need to prove that HT used the image without permission. If you specifically told Jorge it was for his book and only he was granted limited copyright, then likely HT did not have the rights.

I think Jorge published all his own books, however if HT published his book, then they are the ones granted the publishing right.

So you've probably got a case, but consider that it is only one photo, yes? So you might be granted a fee but it would at most be in hundreds not thousands. We're talking small claims court. Obviously it wouldn't be enough to pay a lawyer.

However, if you join a class action, you might get more if there is a pattern of this kind of abuse.

You'd need to prove your own copyright claim with original photo and communications with Jorge. If he bought your image outright, then he owns the image. If you just gave it to him to use without compensation or written permission, then it might be harder to prove you own the copyright. Normally the creator retains all rights, unless specified otherwise.
