The forms that are in our shop were drawn up by our attorney. Since he was one of the four lawyers that wrote the amendment, and is also a close personal friend, I will not allow anyone into my dispensary who don't want to sign these forums. This protects all my patients as well as my shop's lively hood to be able to continue to provide for other patients. These documents are per our attorney. I promise if it were not for him, none of us would be where we are at in Colorado with MMJ.
Sorry to those who are intimidated by these forums. I am sure there are some shops with great meds who maybe don't have the same forums.

I personally would recommend that you never sign a HIPAA form for ANY dispensary or CG. It's simply unnecessary and too far reaching.

As well the Doc is from my shop, and is in my shop on Saturdays every week, and Friday's, and Saturday's Starting next week. We are booking next Friday the 18th right now.
I am sure Med Cannabis CO will still have another Dr from our network on Fridays as well.

Hey Mike, your forms are the same as several other shops' forms, and I noticed on the HIPPA form it says that it is voluntary to sign. Does that mean someone can fill out the temporary caregiver forms but not the HIPPA release for access to your shop, or must both be filled out? Thanks.

I would take it that it's your choice to sign or not sign, just as it is their choice to serve or not serve you.

Be that as it may, I STILL recommend that all patients never, ever, ever, ever sign a HIPAA form for ANY dispensary. It's overreaching. Why does a dispensary need me to waive my medical privacy? They don't...all they need to know is that I have an active registry card...that's it. Nothing else is any of their business, including my medical condition.

My regular Dr has me sign a HIPPA form when I see him as well. I guess I don't understand the HIPPA laws. I'm visually Impaired and never read it.
Can someone post a form or at least tell me what it says?

The form I'm talking about is basically a waiver to your rights under the federal HIPAA privacy laws. Now, maybe I'm misreading it, but that's what I remember the form talking about. A regular doctor might need this to access records from other healthcare providers, but a dispensary? Give me a break.

Not to be coy, but I have heard of Mafia types running dispensaries. And the Hipaa forms state explicitly that you agree to allow them to release your medical information to any law enforcement agency which requests it. The state registry has tighter controls than that.

**Not trying to say that any dispensary owners are negligent or nefarious, but use some caution.
 
As of now all our patient information is locked in a fireproof file cabinet. We are in the process of scanning all records into a encoded server at which time we will destroy all hard copies. The encryption codes will be held in a safe location to ensure patient privacy in case of a breech.

But if the cops or the feds decide to kick in the door and seize all of you records, where does that leave the patients?

No offense to you personally, and I understand that lawyers are recommending these forms to dispensary owners to limit their exposure, but I think it is over-reaching to ask us to waive our privacy rights.

Finally got my MMJ license!!

Appointment was a breeze. Took like 30 mins for my roommate and myself.

Paid $175 with medical records.

In case anyone is interested. The current turnaround time to get your mmj license after sending it by registered mail is 6 wks. and 5 days. Woohoo!
