I know of someone recently got their card, took 7 weeks.

For what it's worth,

If you don't have your card back in 35 days, you are considered approved. It's part of the constitution of the great state of CO:

(d) Except for patients applying pursuant to subsection (6) of this section, where the state health agency, within thirty-five days of receipt of an application, fails to issue a registry identification card or fails to issue verbal or written notice of denial of such application, the patient's application for such card will be deemed to have been approved. Receipt shall be deemed to have occurred upon delivery to the state health agency, or deposit in the United States mails

It's so cool that Colorado is getting it's medical act together...I was a patient in California in 2006/2007 but when I moved to CO there was no doctors or dispensaries in my area. Over the last two months I've heard of three doctors starting to give rec's and four dispensaries have opened within about 30 miles. The floodgates have opened :woohoo:

Definitely cool the state of things are starting to take a turn for the better. Growing up here there was no shortage of good trees, it was only a matter of time before we got with the program. I knew that there were going to be big changes when that law got passed in the city of denver.

:woohoo:

and bigger, better mountains!! cheaper....on everything but herb!

Give it time, I can see prices going down as more and more people start growing. I know of around 20 people that started grows this month alone. The scene is starting to expand rapidly! :woohoo:

Yea, the compitition can only make prices lower and quality higher. Basic Economics.

Medichron, is there an expiration date on the card? I've been wondering how they account for the two month delay when it comes up for renewal.

My expire date included the time it took to send the card.

The expire date was 3 days before i got my card. But over a month longer than when i got my rec.

I assume his expire date is the last of Sept.

Thanks, just wanted to make sure the state isn't going to bone me...nah, they wouldn't do that!

I concur with GreenMtn, from what i've read of all the .pdfs posted from the states site, a real or temp drivers license from CO is enough to prove residency. I just obtained a PO box and surrendered my out of state license today. However, if I'm sending a photo copy of my ID to the registry I'm assuming they'll have my real address anyway :\

I'm almost there! Waiting on med records and then I'll be visiting greenmtn.

Thanks for this thread, this is all still surreal to me. I came from the most conservative damn state in the country.

before long you'll be living the dream like the rest of us. All of us like minded peeps have President Obama and Eric Holder to thank for what is happening in the cannabis world. Whether you love him or hate him, he's the man..

A big thanks from the Green Gorilla President O! The people at Green Mountain will treat you well, guaranfuckingteed! Their doc is one cool dude!

here just a year ago it would take around 35 days to get a card/a new card, and now its taking up to 8 weeks. the time that you spend waiting is very nerve racking, when your used to only waiting about 35 days. lately my biggest worry is that when my card gets sent out, that the postal service will deliver it to the wrong address, as i've been getting lots of other peoples mail in my mail box, and getting mail that has had wrong address writen on it. last thing I wont is some one on the block learning that I have my card just due to the postal person dropping it in the wrong mail box.

Note that per the law, if you have not received your card within 35 days of when your application is received at CDPHE, you are deemed to be approved. I don't know whether that is acceptable to dispensaries or not as far as selling to you, but you would be legal for possession and/or growing at that time.

You're actually legal the moment you have the signed document in your hand. Burn a copy for your own records, send the original to CDPHE certified mail, attach the reciept showing it was sent, and you can use that to prove you're a patient, it'll get you into dispensaries.

Good and accurate info BG. The State site even mentions that as well.

It depends on which dispensary. I asked the owners of the one in the town where I live about this; they spoke with their attorney and were told if they want to be sure of legal protection, they should require a card.

What I've read and heard is that you're legal for possession or growing as soon as you have a recommendation, under the "affirmative defense". If you haven't received your card within 35 days of when your application is delivered to CDPHE, you're deemed to be approved for the registry. Once again, the dispensary will decide whether they accept that, or want to see a card.

Since the law isn't real clear on the whole dispensary issue, the interpretations on how they operate depends on who you talk to. Specifically, the CDPHE web site says:

Dispensaries
The Colorado Medical Marijuana amendment, statutes and regulations are silent on the issue of dispensaries. While the Registry is aware that a number of such businesses have been established across the state, we do not have a formal relationship with them. Please be aware:

The Registry does not license dispensaries.

The Registry does not have a list of dispensaries.

There are no regulations regarding dispensaries.

The Registry is unable to assist with complaints regarding dispensaries.

The Registry has no information on how to establish/operate a dispensary.

There may be local ordinances that might impact the operation of a dispensary. Please contact local authorities for specific information.

just because you are concitered "legal" after 35 days Does Not mean that if you happen to have a run in with a Barny-5 that they are going to conciter that a legal MMJ card. I may have a jaded view of the law-Pigs that the law employs............

Just because some one has a card(or waiting for thier new card), that doesn't mean that they intend to visit any of the pot shops in Colorado.

I think that the Registry sould do something to get the waiting time back down to 35 days. Perhaps they should start by having cards that are good for 2 years or more, look at your state I.D. or D.L., you think that its bad at the DMV now, just think what it would be like if you had to get a new I.D. or D.L. every year. Speaking about the Registry, I think that the MMJ cards that they issue should be more like a drivers liscence with your picture on it instead of a paper card.

Legalities..

Legalities..

I currently live in CA and am a patient of MMJ. I am thinking of moving to the Denver area and am curious to know what the current CO laws are surrounding MMJ, collectives/dispensaries, and cultivation. If anyone has any information they could share with me it would be much appreciated...

Thanks!
