I do not know of an attorney in the state who thinks the caregiver to caregiver exchange is legal without meeting and wellness services.
I do not know of any case in this state where a Judge has upheld a caregiver to caregiver exchange.
Distributing mj to another person is illegal. Manufacturing mj is illegal. A20 gives you defenses so that the act is no longer illegal. Where does it allow you to hand mj to a person who will then hand it to someone you have never met and do not provide wellness services for?
How are you justifying the act of handing it to the dispensary owner? Ie. distribution? Is that person naming you as their caregiver? Are you providing the dispensary owner with wellness services?
Then we have People v Clendenin, 06CR1758, where the Judge in Boulder held that in order to qualify for the caregiver defense you need to have met the person that you are caregiving for and you need to provide them with wellness services. The Appellate Court agreed.
So how is it again that you think A20 allows you to walk into a dispensary and sell mj to the dispensary owner knowing that he or she will then distribute it to people who have not named you as a caregiver, who you have never met, and who you do not provide wellness services for?
