They can still purchase from another dispensary - like that is going to happen....the Cali immigrants (invaders) will never sell to their competition. They will have their "good ole boy" system in place!

Werd on the street is all the Cali shops are stocking up on imported goods to the max right up until 9/1/2010, then as long as they have a backroom with a few CFLs hanging down to please the auditors (not like the auditors will know anything about growing) and enough patients, they can claim all those meds as their 70% allotment, pay the licensing fee, and continue their trickery. Legalization in California will only make this cheaper and easier for them.

Caregivers/Patients can't sell their overages to dispensaries. So unless you are selling black market, you can't even hold onto more than 10 ounces at any given time. Maybe 12 ounces if it shakes out to be yourself plus 5 patients.

The only reason to grow more than your patients can consume now, would be to supply the black market...sucks.
You can't even charge patients above the actual cost of growing the product. But you can charge for "Service".

I can only imagine we will be seeing a few caregivers getting busted for going to the dark side with their overages.

This is the saddest part of this bill, IMO, that and the drug felony thing. Somehow rapists, murders, child molesters, frauds, counterfeits, thieves, gun runners, arsonists, stalkers, pimps, prostitutes, inside traders, extortionists, and drunk drivers are all okay, but humble gardeners are not? Who is running this gig, the Catholic church? Salvation bribes anyone?

That's a real "grey" area....if you are growing "offsite" for a dispensary, you cannot grow at home, or elsewhere for that matter.

Thats BS also. If I'm a patient, and I am legally EMPLOYED by an MMC, but I don't get my meds from them, and don't sign as caregiver, I still have a legal right to grow my 6 at home. How can they interfere with patient status and employment status, thats just not fair. I guess the big dispensaries will just force all of their employees to sign over to them as per terms of employment. But doesn't the new bill still say you can have your 6, even if you sign over to an MMC? When I had the cops over my place to count plants I still had copies of my original papers where I signed over caregiver. I have all the paperwork for change of caregiver to NONE that I sent in, but didn't mention it unless they asked, and they stared at my paperwork, and it had the caregiver section filled out, and they still didn't ask questions or worry about it. Then again, that is Boulder. North Metro might not be so forgiving...

The question that I have is: Can a MMC owner also be an employee of another MMC to lease space to and grow for them... That could circumvent the 30% sell/buy restriction.

This probably goes against the "you can't work together" thing. God forbid we actually organize. Stoners are just too easy to take advantage of.

I think this might also be a good loophole for breeders! I know personally, even if I end up working for a dispensary, NO WAY am I doing any breeding for them or on their property. God forbid I find something magical and they steal it away from me! So it seems like as a breeder, you can just setup the Infused Product Manufacturer, and just grow whatever, pollenate freely. Keep the seeds for your next runs, sell 'em on seedbay, or do the seed company thing, and then just hash out the rest and make tinctures or edibles. Yea, the license fee would hurt a bit, and the commercial kitchen, too, but it would be worth it to stay independent and not be affiliated with a dispensary. Of course these laws don't really ever address seeds, clones, or breeding in general....because politicians know absolutely nothing about cannabis......other than $$$$$. But they'll talk your ear off about some 30 year scotch that they put themselves to sleep with every night.

We need a clause in there for "Political Refugees from the War on Drugs, as it pertains to Marijuana".
So if you caught a conviction in another state, you would be omitted from the residency clause. I bet Romer would love that.

Yea, I also had a secret part of me that wanted the worst draconian version of Romer's idea of utopia to pass. Only because I wanted to see a strong reaction from the people. It would be nice to see people actually taking a stand in what they believe in. Romer is hoping that at least 50% of the patients will also not be eligible for renewal with SB109, and investigating and prosecuting one or two doctors with full mass media present should scare away 95% of the rest of the doctors back to stitching hemorrhoids on granma's ass and stay the hell away from cannabis.


I'm pretty sure he just said that he doesn't want any hippies in the biz! Isn't that prejudice based on beliefs? Oh wait, Arizona just proved that is just fine!

Oh, and the going contract rate for growers seems to be a 50%/50% split of the retail price or the total profit for what most places are offering. That is if you are already have an up and going space that is zoned and permitted legally. And you have to pay the offsite growers fee, while they pay the MMC fee. I haven't heard any $10 an hour offer, but that is pathetic. In any industry, a seasoned and experienced technician or engineer with leadership skills would be making far much more than that. Shit I work 3x as hard as most electricians I've hired, and I pay them $30 an hour!

Shit, I would work for $10/hour IF:

1) I got free meds of my choosing for as long as I'm employed. Makes no sense to grow it for a living and then pay for it.

2) I could work at my current pace or slower, paid medication breaks: 15 minutes for every hour of work.

3) Full health and dental benefits for myself and my family.

4) Keep my right to 6 at home.

5) Travel compensation.

6) Workman's Comp, if they ever get PM, RA, or spider mites, they still have to provide me with free meds, even if they gotta buy it buy it nickel and dime at full retail cost from another shop! This includes if I get injured on the job site.

7) A company car

8) Full expenses business trips for "research" to Amsterdam, Spain, Nepal, Mexico, Thailand, and India, all while clocking $10 an hour.

9) A retirement package. When my back goes out from growing for years and lifting jugs of water and plants in buckets, I need some kind of security for my family. Lifetime free visits to a Chiropractor and massage therapist, since they should have these on hand at their "wellness center" anyway. Free meds for life beginning at retirement, for not just me, but my entire family, dogs included.

10) They would guarantee to cover my legal fees and take care of my family (dogs included) if the Feds come and knock us down. Any jail time would fall under the $10 hour rate, also.

So my next question stemming from that would be, what protection will any of this give us from the Feds? If we just shelled out $50k to get legal between the MMC and the growsite, and the feds come busting in, is that state license any defense at all? Or is Romer just lining 'em up so the Feds can knock 'em down?

but only 18 flower, dont think Id have the balls to go 36 at once in flower...


sorry if it has been answered before but when does the 5 patient limit per caregiver set in?

Given that 50% plus dispensaries are looking at being put out of business, I'd suggest to them that instead of footing $35K to the state that they instead put that money towards supporting the proposed legalization initiative. Medical marijuana becomes a moot point when legalization happens.

I'd also suggest that patients should forego the 90$ application fee and just pay your doctor to sign your papers every couple of months. That way the state doesn't get your money and they don't get to add your doctor to their list to investigate.

Both seriously excellent ideas. But, unfortunately that 35k donating to legalization will not keep you in biz when the cops coming knocking and you don't have the license. Conceptually great, but realistically scary!

As I am slowly reading through the final HR-1284 it says that local cities and counties can also vote to ban Infused Products Manufacturers.

12-43.3-106. Local option. THE OPERATION OF THIS ARTICLE SHALL BE STATEWIDE UNLESS A MUNICIPALITY, COUNTY, CITY, OR CITY AND COUNTY, BY EITHER A MAJORITY OF THE REGISTERED ELECTORS OF THE MUNICIPALITY, COUNTY, CITY, OR CITY AND COUNTY VOTING AT A REGULAR ELECTION OR SPECIAL ELECTION CALLED IN ACCORDANCE WITH THE "COLORADO MUNICIPAL ELECTION CODE OF 1965", ARTICLE 10 OF TITLE 31,C.R.S., OR THE "UNIFORM ELECTION CODE OF 1992", ARTICLES 1 TO 13 OF TITLE 1, C.R.S., AS APPLICABLE, OR A MAJORITY OF THE MEMBERS OF THE GOVERNING BOARD FOR THE MUNICIPALITY, COUNTY, CITY, OR CITY AND COUNTY, VOTE TO PROHIBIT THE OPERATION OF MEDICAL MARIJUANA CENTERS, OPTIONAL PREMISES CULTIVATION OPERATIONS, AND MEDICAL MARIJUANA-INFUSED PRODUCTS MANUFACTURERS' LICENSES.

So, that might not work depending on your situation...

you just hit the nail on the head..

isn't it funny that, according to the timeline of hb1284, all mmcs must prove their 70% production rate about 9 or 10 months before the legal entities "mmc" and "optional grow site" even exist...
so, from 9/10 till 7/11 all the larger operators who want to go legal will have to rely on the current caregiver defense if busted, a defense that the very politicians and lawyers who promoted the bill insist is invalid.
i'm not a doomsdayer and don't think this period of "medical marijuana purgatory" will be used to prosecute all large operators under federal law. the 10 months will, however, be enough time to "weed out" any operations that are out of good graces with municipalities, the state, and leo.
