Everything has went underground. Never liked Home Depot runs, but now I hate them.

View Crest is off Old Olive Hwy which has signs saying its a drug-free zone, more than likely its a single-owner using Google Earth to rat out all his neighbors. I agree with ButteCounty_Guy - Measure A has pitted neighbors against neighbors, its a slippery slope that Butte has got itself in, not only economically but socially.

Yeah that side of oroville is a tough area to operate. I went over to my buddies the day after they put those up and I was like fuck no I'm never going over there again. 98% of Cherokee residents feel the same way-fuck the police. Now if growers would stop driving down the roads at unsafe speeds you might be able to convince the other 2%
 
I saw code enforcement followed by animal control headed up Forbestown Road today, a 72 hour notice on the Pritchett Road Gate, and a Sheriff and another car that looked like a county one at the Lakeside Market corner. The Prichett area has no homes, and only a few grows. I don't believe there would have been a complaint filed from there.

Sure wish they would update the site so I could read the fucking bills. I hope they don't try to ban delivery services again, if you look at NorCal all we have is delivery services! Banning them just sets up Sacramento for a monopoly and leaves local patients driving hundreds of miles just to find their medicine. Absolutely bullshit.

I actually like Jerry Brown, and I'm sure his ideas are as far to the political left as could be achieved in the legislature. But it seems likely that while legalization will achieve the goals stated, there is a great possibility that a person with a small grow who now faces a county ordinance will face a violation of state law. The bill will have little impact in Butte County where local attitudes will prevail along with pervasive poverty.

But it seems likely that while legalization will achieve the goals stated, there is a great possibility that a person with a small grow who now faces a county ordinance will face a violation of state law. The whole fucking thing is stupid. The Department of Public Health in Colusa County, Jerry Brown's home, REFUSES to do their job and accept applications for medical marijuana cards. There are only 2 counties in the state that are currently doing this. Now he wants to allow these same type of people push their religious views on everyone else and stop medical marijuana. How the fuck am I suppose to get a license from my local county when my local county won't even recognize medical marijuana. There has been a "temporary" ban on all medical marijuana business licenses in Colusa county since 2010. How the fuck is 5 years temporary? Now after 3 years I'm just suppose to pack my bags and leave now. I've never had a bad thing to say about Jerry Brown until now... Every single patient in Colusa County is going to be negatively affected by this. WAY TO SHIT WHERE YOU EAT GOVERNOR.

I'm gonna bet it gets pushed through quickly and signed by the governor.

I read the newest version. Its definitely interesting. From what I gather you can do personal medical, or up to 5 person caregiver garden. But EVERYTHING rests on your local county or city laws. If butte says no, the state could care less, and no it will be!

they just want to appease the local govts.

Kinda fucked BC if I had dough I'd be all over this,l.

It's extremely hard to become someone's legal "caregiver" in this state.

I think a proper collective would be find with signed agreements that everyone puts in equal shares of work.

It was "primary caregiver" that deb and gang were trying to get rid of. It's says now "caregiver or primary caregiver" so it's much better

The bill is so fucked! The Department of Public Health is in charge of labeling and testing, yet in my county the people working at the Department of Public Health think marijuana is morally wrong because their pastor said so. Jerry Brown just gave these religious nut jobs another way to push their religious views on others. Fucking bullshit

Tank, it says specifically "primary caregiver." Havnt read nearly 1% of it but this section doesn't state any "or" and limits you to 500 square feet.

This section does not apply to a primary caregiver cultivating marijuana pursuant to Section 11362.5 if the area he or she uses to cultivate marijuana does not exceed 500 square feet*

Any suggestions ? Ive been planning on... Make them get info gathering warrant, record entire thing, Set up hearing and contact charnel.

 
They hit at least one grow near Railbridge in Palermo too. Its hard to imagine who was being bothered by a grow out in east Palermo. Not exactly a sought out destination.

They probably aren't coming back. Over the last few weeks the strategy has seemed to be post fine at the gate. No return visit. At this point their is no point they know that no one is cutting. Hire charnel and you won't have to talk to them again.

yea old country, at some point i was kind of relieved when i got the abatement notice because it shows their hand and takes away alll the doubts and what ifs. then its your turn to act and theres options and routes one can go. you can either go the fuck them route, and just ignore ignore ignore even after inspection warrant. or pull sneaky shit and hide/move the plants, call them in show them shits empty and send them on their way. a bunch of guys got notices posted recently and will update y'all on if theres follow ups.

also saw code enforcement with sheriff escort out today in bangor, coming back from a property check on los verjeles rd past the feed shop.

MEASURE A UPDATE: 1260 cases, over $1 million in fines issued, only 85k collected. only one hearing has been completed with the grower "agreeing to pay fine" lol. a bunch more hearings scheduled through this week and next. lots of interesting tidbits in here, they are aware of upcoming regulations, but are still ignorant enough to think that one would need to obtain a permit for growing their stupid little 50-150sq ft lots. even under new regulations with state and water board anything under 500sq ft will not need any permits. no new inspection warrants issued since last check, which seems to back up tankers assessment that they are only going after open sun gardens that they can visually see from the air and then send a notice of abatement in mail.

Oroville >> The number of cases under Butte County’s Measure A medical marijuana cases increased 33 percent in the past month.

The county has received 1,262 cases through Monday, according to information from development services director Tim Snellings. At the Aug. 11 Board of Supervisors meeting, he reported there were 949 cases.

Snellings said the number of cases may be increasing as the cannabis harvest nears. That means grows become larger and smell issues increase.

Measure A is a voter-approved initiative that sets growing area dimensions in the unincorporated county based on lot size. Permitted outdoor grow sizes vary from 50 square feet for lots between a half-acre to 5 acres to 150 square feet for properties larger than 10 acres.

The most common code violation remains having grow areas exceed what’s permitted, Snellings said.

Of the total number of cases, 299 are pending review. An additional 111 are under active investigation, according to code enforcement supervisor Chris Jellison.

Snellings said that there is a backlog of cases. Officials are trying to concentrate resources on specific areas at a time. They are also prioritizing larger grows.

While 32 cases have been given notice to abate or are in the process of abating, 20 percent of the cases are currently undergoing citations.

There are 329 properties that were initially out of compliance, but are being monitored after fixing their issues. Officials have closed 191 cases, but Jellison said that reflected properties that had multiple complaints consolidated into one active case.

Some residents have voiced concerns about inspection warrants being used to check some properties. Jellison said 11 inspection warrants have been served to date. He noted the warrants are used to check for compliance with Measure A. If alleged criminal activity is detected, law enforcement would take over and they would have to seek a criminal search warrant.

MOST FINES UNPAID

The county reports 503 citations have been issued to date. While $1.14 million in fines have been issued, only $85,090 has been collected.

Snellings said officials were planning on using the nuisance abatement hearing process to get fines paid and to ask to recover costs for expenses. After the process is upheld by a hearing officer, the county can put a lien on the affected property.

Only one hearing has been held thus far. Snellings said the cited person admitted to the citation and would pay the fine after the harvest.

An additional eight hearings have been scheduled. There are also 20 pending hearings that don’t have a hearing date.

As county officials are investigating cases and scheduling hearings, they face the end of the cultivation season in October. When the crop is harvested, most sites will again be in compliance with county codes.

“Essentially, every case is going to self-abate in about a month,” Snellings said.

PENDING CHANGES

He said officials would look at changing the ordinance last year to shorten some of the timing. For example, cited residents have a 20-day appeal period where any county abatement action is on hold.

Snellings told the Board of Supervisors on Tuesday that the program is within its budget, but he didn’t have specific figures after the meeting. He said they would review the budget for the 2016 growing season.

During Tuesday’s meeting, supervisors Bill Connelly and Larry Wahl noted they’ve received fewer complaints this year and even heard some compliments.

Supervisor Maureen Kirk said she thought Measure A enforcement would discourage people from coming to the county to cultivate marijuana.

Jellison said there was a cooperative from Los Angeles that said they wouldn’t return next year.

County officials also discussed the potential impact of a pair of medical marijuana laws passed Friday by the Legislature. County Administrative Officer Paul Hahn said the laws create a state framework regulating cultivation and dispensing, but also allows local governments to control or ban the activity.

Hahn suggested it was possible for Butte County growers to have to follow Measure A requirements and obtain the appropriate permit from the state.

Snellings said they would hopefully see additional details about what the laws entail, although he liked that the county would retain local land-use authority. He said one key change is treating cultivation as agriculture.

With California voters likely to vote on proposition legalizing recreational use of marijuana next year, Snellings said it was possible there could be a system where recreational use is allowed, but it wouldn’t be legal to grow everywhere.
