SHe didnt admit to running the sign .... instead admitting she never saw it....Giving the cop the right to dui test her.....

she doesnt need to admit anything..... he saw her....

and has her on video.......

whats next ????

The cop never DUI tested her, he cuffed her, put her on the ground, called for transport to take her to jail. All documented by the audio. Given that the story made national news almost immediately they would have looked more in the right had they said she was arrested for DUI but they didn't and no reporting I've seen of it ever implied she was DUI.

If you dont have the stop sign...you dont have probable suspicion to dui test her....

The police officer himself, saying he pulled her over for failing to signal clearly contradicts your assertion that she was arrested for running a stop sign. Guess what though, even if she did run a stop sign that is still a minor traffic violation and as such it also doesn't justify the extreme actions taken by the police officer. Which is why he's been removed from street duty and is the subject of a criminal robe.

They didn't need a probable cause to test her for DUI since they never DUI tested her during this stop and no where have you come up with evidence that they did or wanted to.

He had a choice.....stop sign or turn signal....

No cop will tell you all the charges at this stage....

He simply chose to use the turn signal.....

Far from it....

There is a very simple lesson here.... that can be learned in 5 minutes.... and may save your as some day.....

it would have saved this womans life......

The only way to respond to a police officer if he stops you is very simple....

but you should carry this advice with you for the rest of your life....

O...now I see. You are rapidly posting away in this thread to teach us how to handle LEO...in case...we're pulled over...and questioned.

you have a lot of experience with talking to the LEO?....or are you just going off what some lawyer told you?

I'm not thinking you have dealt with cops much...at least not been on the end of the stick. You try that shit though....and then watch how they run a game of fuck fuck on you.

be polite

answer their questions (whether you lie or not is up to you)

keep your hands in sight

do it without an attitude

usually if you are semi credible....you should be on your way.

Not recommended: making the cop work harder than he has to and being a smug smart ass or being difficult.

I have zero experience.....but my lawyer has some.....

So who do you listen to....

someone who has managed to keep out of the view of cops...

If the cop articulated that he suspected her of DUI it would have been n the video along with everything else. It wasn't because at no point in time was DUI ever suspected.

The say nothing part mainly applies after you've been read your miranda rights anything said before that can't be held against you. It's still a good idea to not say anything since you don't want to give any reason to arouse suspicion. Like for example, saying your lawyer has instructed you not to say anything before even being read your rights. This tells the cop that you've been in trouble before and are likely hiding something now.

He's says to say nothing on a traffic stop? I'd get a new lawyer. You'd have trouble at the border check points around here as well.

"Where you coming from?"

"Sir..with all due respect my lawyer has told me not to answer LEO questions."

now you are making his job hard and also bringing suspicion upon yourself. he may be calling for back up....and things are going to the next level...your day is getting longer. why?

because you wouldn't answer a simple question. that's not smart

She was not arrested in the car, when he threatened to "Light her up" she got out of the car of her own volition. Sure I can know what the cop suspected he told her several times he was just going to give her a warning but because she was acting the way she was she was now under arrest. If he suspected her of being DUI he never would have said or entertained the notion of letting her off with warning.

I thought this might be relevant to the thread but dont know how to post links.the name of the clip on Youtube is "Woman claims rape after being arrested claiming she doesnt have to follow the law" or close to it.i really think it shows a good example of how the police should have handled the sitaution.I gaureente you most cops dont act like the one in the youtube video i mentioned above.i think its worth a watch.
