Not to be a dick or anything but have you at least learned your lesson as far as talking to cops and letting them search your house?

They tried to get you to submit and give up your rights and you complied by letting them search your house. Why is that when police are involved people just lose all sense and roll over like a dog for them?

If people like you who were in a position to tell them no would say no more often they would not necessarily give up asking to search but would get tired of being told no.

It staggers the informed mind to realize how many nice guys out there, like the OP, that do NOt understand their Rights and how to use them.

You were HOPING?? What? Hoping is like wishing....you can wish in one hand and crap in the other...what do you think will be left in your hand? the wish or the crap? Your HOPING that they were there legitimately and that you could handle it proves my point: you were unprepared.

The cops could NOT get a warrant. If they could have, they WOULD have!! it is always that way; the filthy lying pig SAYS they will get a warrant, HOPING that you will believe the LIES. you did. NEVER believe anything a cop says. They lie like we breathe, as a natural function of life.

Had you said; " Hell NO..go GET your freakinn warrant pig"...they would have slinked away and left you alone. WHAT was the cause of them coming to you? Something so vague and wishy washy as some neighbor allegedly saying something...?? What the hell?

NO COP can get a warrant without probable cause. Probable cause is NOT just the fact that some hearsay has been heard. it is NOt the fact that you refuse entry without a warrant. The cops will say and do almost anything to get around having to get a warrant, because they know that without evidence it will not happen. So they HOPE, like you...and know that most people are WEAK and SCARED of the scum cops and will give in...like YOU>

Just because you live in a medical state does NOT mean you have to allow lying cops to bluff you. EVERY TIME a cop asks for something, like CONSENT, it is because he CANNOT get a warrant. Cops LOVE to get warrants because it makes it much easier to lay responsibility for a bad warrant on the judge and not on him for actimng without one.

So, if a cop CAN get a warrant, they always WILL. If some cop shows up at your door and says anything, demand the warrant and if they do not have one DENY them entry and refuse to speak to them. Take charge!! put the COPS on the defensive and show them who the real boss is; not them...but YOU!!

Hopefully one day we will cease to see reports like this: Never give a filthy cop anything...ever. Not the time of day...not consent..nothing.

I suggest you watch the Never get Busted DVD, if you would have, you would have known that when cops think you are doing something illegal they will do whats known as the "knock and talk". The best thing to do is just act like your not home and get rid of all the extra plants since ur medical. Another option would have been to talk to them through the window and tell them that you don't open the door for cops and tell them to come back with a warrant and if they want to talk to you have dispatch call your house. Another key phrase is " I don't consent to illegal searches ". It takes 24 hours to get a warrant, and they need some evidence to get the judge to sign the warrant. All the police will do is try to lie, intimidate and trick you into getting what they want. You have to know your rights and know how to use them. Best of luck with your situation.

Okay about 4 months ago the Police came to my house because the nosey old neighbor heard me talking or something and called the police saying I was "Growing Marijuana in my Garage". The Police come I let them search, they find 60 plants about 1ft tall not in flower, and 30 unrooted clones. They left us with 12 (me and my girlfriend have medical cards, 6 each.) They called the power company out to make sure I was legit, The officer which is in charge of marijuana cases in my county told me it seems I was just misinformed and this was a personal grow, thanked me for my cooperation and told me he deals directly with the District Attorney and I shouldnt worry about it, The man from the power company thanked me for "Being Honest" and not stealing power.

I explained how I just moved into this neighborhood and didnt want to do Outdoor so I was going to do this grow and be done for the year. They told me how they busted houses with 3 storys completely full and this wasnt nothing. So they left and I figured that was that, He told me not to worry about it. I was never handcuffed and never went to jail.

Today I get a letter from the D.A. saying I have court and they are charging me with Health & Safety Code 11358 & HS 11359, Which are cultivation and possession with intent to sell.

I had NO processed marijuana, NO scales, NO Bags, NO PROOF.

This seems like just a bullshit case, Should I even bother getting a lawyer that I cant afford right now or just see if they throw it out like they should? Also can those 30 unrooted clones be counted as "plants"? Because that made it look like I had "90 plants".

If I saw the man at the door, and they were not busting the door down, I would have the quickest cleanup session in history to bring myself within legal limits.

Like said before, dont answer the door. Make them sit outside all day waiting for that warrent, if they can even get one.

If confronted by them, deny everything, and say nothing afterwards. Dont make their job easy. Sure many cops are cool, and I have been given a break or two in the past, but at felony level it's a different ballgame.

I was not comapring growing to shooting somebody.. I was just trying to explain how police casually try and get you to admit your crime.. And in your case, even with the med cards, you were over the limit and got caught.. The police are going to say they left you wit your limit and took everything that was over.. Let us know how this all works out... I know what it's like to be in the system and it sucks.. Even when you go to trial and get aquitted you still have stigma in the community as if you were guilty..

Ok, smelling weed is NOT probable cause for a warrantless search!!
Even without a Rec, it is not an arrestable offense to smoke a joint...therefore they cannot search without a warrant for something they cannot arrest you for--
DO NOT TAKE A DEAL WITHOUT CONSULTING A GOOD LAWYER!!

If the cops were convinced that you were a dealer, why did they go ahead and leave you with 12 plants? That fact can be used in court. The very fact that they left you with 12 plants indicates that they knew that you were a Prop 215 patient and not a dealer. If they thought you were a dealer, they would have ripped all plants.

My son was caught with 60 plants in his back yard. He was a Prop 215 patient, but the SD Sheriffs deputies were cross sworn as DEA agents so they wouldn't have to follow Cali law. He was charged with 2 felony charges and did a plea and got 3 years probation. It really doesn't matter anymore as my son is dying from ALS, but I am growing for him now and will keep growing until they lock me away for good or until my son dies.

Running is no good anymore. You can't hide from your past as easily as it used to be, Ever since 9/11 homeland security has all the computers linked. im not preaching here as I grow like the next guy on here but im puzzled as to why you have 60 rooted plants and 30 cuttings knowing you are only allowed 12 total between the two of you? and with knowing what you have on hand verses what the state / county allows, you consented to a search without proper search warrant? what exactly did you think would happen? common sense goes along way bro. you just have to exercise it into play. no matter what state / county you live in.

as the old saying goes, anything you say or do can and will be used against you in a court of law......regardless of how sweet the officers are to you.

your DA is just doing his/her job. "hmm, what do we have here? they have 90 plants on hand, only allowed 12 under state law? well, my educated guess is they they were growing with the intent to sell. lets bring charges before a court and see what happens"......see how easy that process goes. it took the DA all of 5 minutes once your case hit his desk to decide to go after you and your girl. if your a baker, your job is to bake. if your a farmer, your job is to farm. if your a DA, your job is to prosecute if laws are broken. you were not within the allowed limits under the law so yes, they are bringing charges.

you need an attorney. I hope you wiggle your way out of this one as I dont like seeing fellow growers taken down. especially med patients.

The clones came from 3 untested "female" mothers, when I was ready to start I found out one of the moms had hermie tendacies and wasnt sure which one, they had accidently got mixed up, So I wanted to make sure I had plenty just incase half or more turned out hermie

I dont know why 60 small plants seems like such a big deal, not like they were 8' monsters outside, they were less than a foot indoor, I could have put 1 plant outside and got way more weight than all the ones I had put together, The whole number system is bullshit, size of plants should definately be considered. In Santa Cruz County you are allowed to have 4x8 growing area with up to 99 plants. So If I lived a hour or so away I'd be perfectly legal? I'm a double FELON here but a hour away in the same state i'm a legal medical patient? Something doesnt seem right there.

My mistake. Maybe next time i'll just do 12 10foot plants that produce 5lbs each and be in the "plant limit".

Dude don't listen to those people. Get a real lawyer. Keep putting this case off until the State Supreme Court (if you are in California) rules on people v kelly and people v phompkhady. Also if they were going by the SB 420 limits they should have left you with 24 plants not 12, You have ammunition against them and can sue. If you go by government stats of plants yeilding a pound each and each pound being worth $5000 the cops could end up paying you $60K.

exactly what I was going to say, and a great argument in court regarding how nobody knows proper plant counts even the cops couldn't follow "the law" (in quotes because SB420 plant limits are both unconstitutional and make no sense).
