i didnt try to enter i just posted a pic from indoor gardeners magazine that came out in december with the think inside the box slogan printed right on the page
so i was just pointing out the slogan was already in print by the time the contest done
thats all

That's right. Chucky wasn't ripping off anyone else's entry, but rather pointing out that one of the entries was already in use before the contest started. That entry was then pronounced the winner and the post showing it in use was edited to remove the picture. Then someone else posted a link to another company who had already trademarked that slogan. I pmed gypsy who has said that he will look into it. Then Dave came on and claimed that he was clarifying things by accusing Chucky of using someone elses slogan. Just wanted to make the situation absolutely clear.

ok this is getting confusing... can someone post a picture of that please! chuck.

Also can someone point where is that trademark done... because if its done its done, and you will get sued by that company mojave, if you use a slogan that is already in use...

So before anything we need clarification here, I understand that he posted that slogan very fast! BUT there is a point in here that is being done!.

yea alot of crazyness with this.. should have been put togeather better.. i saw the pic also .. it was plain to see that there are many slogans like that ...do a google and u will find a million and a hlaf companys .. all these contest seem to work out like this

o wait.. was this contest to guess the new slogan? .. or acually think of a "good" one.. or one that would acually sell ur product..

ur askin the customers whats a GOOD slogan to use... and hundreds were posted.. and u choose the least popular most used one.. is that a good idea? i think some one missed a couple days in marketing class..

to be seen u have to be bold and UNIQUE .more like ONE OFF .. u said u used to be a tattoo artist .. what did u show them to make them want u to tattoo them ur best custom art.. not some stuff u copyed off a flash sheet..

.. when i see think inside that box. i think of a computer nichi or moving my stuff out of my house.. or possibly i can use the home box to put my big TV in. .. and my stereo.. That would be RAd..

this is just my 2 cents .. tottal respect to mojave dave.. but when u ask the community to participate in ur marketing of ur product .. ull get some protest responces.. cause we want ur product to be the best .. and suceed..

post#251 shows the other company, but they are in a different industry, so I doubt they'd clash.

Just a moment folks...if you’ll read my post again you’ll see that I never "accused" anyone of anything. I simply said— by way of an explanation-- that the first instance of the winning slogan was rightly the one too choose. That’s all.
Whether that phrase is actually used in our marketing is unsettled anyway. Copyrighted slogans are very rare unless the company is large enough to have the resources available to defend itself in the event on copyright infringement suit. That phrase is simply a play on words from an American saying that has been around for several years in the public domain. The actual phrase or slogan is "Think outside the box", meaning to free your mind of the corporate yolk and think for yourself for a change.

Eastside-Impex would never consider stealing another businesses legitimate slogan. But regardless, this contest was meant to be fun. Let's all try and see it that way. It was just a way of getting great exposure for the products in the correct atmosphere, and if we were lucky perhaps a great slogan to use in the bargain. And as a by-product of our efforts to maximise exposure, some nice person here got to win a HOMEBOX.

I see this entire experience as a definite win-win for all involved. I had a great time reading all of the entries and by all accounts so did the majority of you. So I guess I just don’t understand why we’re even going off on this sort of tangent.

Anyway, congrats again to the winner and thanks to all who participated!

Think outside the box, the original way that phrase was first heard, is an American term. Americans and Canadians will understand the meaning of it, but I don't think Europeans are all that familar with it. Maybe that's why it doesn't sound correct or useful to you?

Congrats Omega.Now Dave,any consolation prizes for the rest of us?Is the homebox available directly through you or does one need to go through a distributer.Thanks,and it was fun and there were a hella lotta good catch phrases to choose from.Good job and good luck to you in this venture.

Wow...I never saw that article and they never mentioned to me that they had already used that phrase. Weird. In any case it was they who decided the winner, and perhaps they simply thought that the phrase entered here was the best of the bunch offered up for consideration. I really don't know.

And nope, I have no consolation prizes. But if I did I'd surely pass them around!

Perhaps I'm reading this wrongly then. I wanted to clarify that chucky wasnt trying to enter the same slogan again. But raising another issue. I simply thought that your clarification could do with clearing up a little.

I have no problem with anything you choose to use, even in the understanding of it, I am perfectly aware that the meaning of your selected slogan is not to think for yourself and to adopt a corporate mentality. As will most europeans.

Congrat's Omega ,great job./ MD, I used the same slogan til i went through the whole thread.I think there was probably others that thought somewhere along those lines until they noticed it already posted.CYF cheatin isnt even a thought or possibility not even for a second i dont think MD meant it that way but who knows. the same slogan was already in a mag?.I had to go back and edit mine after a long time because i never took a minute to look through all the entries,dummy,lol.Nice contest and hope to see some sweet grows from youre new Tent Omega.Peace DWW edit,sorry GMT if i hit the wrong Rep post Bro.

I dont want to flame anyone or anything... not saying anything against omega7 with the "winning" slogan, or to you Mojave, whom im sure you made this contest with the best of your intentions.

But first of all i totally agree with kalinca, hes absolutely right, maybe next time we can play with the slogans of different companys. and my entry would be something like "Always, Homebox" but you got to do the cocacola tone when you read it, or something like "Homebox dedicated to make smiles"... this slogans have nothing to do with the industry of grow tents or anything alike...


You see what im talking about... the slogan was already in a magazine before this contest was thrown... this makes this contest absolutely untrustable.... not legitimate... How cant we know if omega had that same magazine and typed that slogan right after the magazine???? (NOT SAYING HE DID THAT).

But again like kalinca said, if you asked for a slogan with sertain caracteristics.. its not fair for all the participants, that a winning slogan, is the same that the one the company used in a magazine from a little while ago....

The prize should be retained until this is perfectly clarified, and in the route this thing is taking dosnt seem close at all... GYPSY please check this out, this is gonna turn into a shitstorm, and will cause a lack of credibility from everything envolved. This might even appear as a corrupt move...

chucky I got your back if this gets ugly. Are you going to try and help someone out of a possibly Actionable Position due to Plagiarism next time? I am (of course) just joining in on the fun but Dave you might want to look into this just in case. Oh and by the way Congrats omega7.

I just got lucky. I happen to see the contest early on. I had never heard of the Homebox before this contest. I clicked on thread, read three or four sentences and typed the slogan which came to mind immediately just like Im sure it did for a couple hundred other people. The rest of mine were just BS or plays on my first one. I didnt mean to piss anyone off or cause any strife in an already stressed community of smokable valium. As far as the slogan goes, as long as it is not being used by another grow box company than it is fine. Vidiom, the example posted earlier in the thread has the slogan registered. Registered trademarks are illegal to use in the same industry or if the slogan defines the company. Meaning slogans like "just do it" which is synonomous with nike are bad slogans to use. Mainly because nike's lawyers will own you. So as long as the slogan is not being used for the same goods or services then it is fine. I really cant believe Im defending myself for winning a contest. When is the official deposition? I thought this was supposed to be a fun contest. It isnt like they are putting golden arches on the box and calling it McHomebox.

It was the fact that you used the word "accused" in your reply that I objected too. It's over now and all is well, so let's continue to congratulate the winner and look forward to the next time we all meet to enjoy another contest courtesy of the good people at Eastside-Impex!

Okay...I am getting far too many crappy e-mails and PM's about all of this. This was simply meant to be a fun thing, and I have been informed by Eastside-Impex that no one there was even aware that the slogan selected was actually contained in that photo/article. The folks who wrote that article popped that little saying in there of their own accord. That was NOT an Eastside-Impex-written ad.

But that's really beside the point here. I am finding myself sitting here shaking my head in disbelief! As I read some of the posts on the last few pages (after the announcement of the winner), all I feel is sadness that the shine has come off of the the winning member a bit because of all of this unsettled behaviour.
Everyone had an EQUAL CHANCE at winning since we had absolutely no idea what sort of slogan ideas would be entered.

Well...Eastside-Impex watches this thread as well and I sense from speaking with them that they are not at all happy that this is turning out to be a problem. This may affect their dercision to run any more contests like this because they have no wish to create any ill-will where there products are concerend, and right they are.

I am stating here and now that Omega7 is the only true winner of this contest because Eastside-Impex, who put this contest on in the irst place, says he is the winner. It is their decision. They haven't got a clue who any of you are. I simply made a list of the top ten answers that I liked and sent that list to them They picked the slogan they liked and the erest is history.

That's all I have to say, folks. I just wish we couldf all enjoy these types of things without some sort of upset popping up to take the pleasure out of it.

No offense is directed at anyone at all. Just had to get that all off my chest in an attempt to smooth things out a bit and trun this back into a happy event for our winner, Omega7!
