What's Your Lawyer Fund?

find a respectable criminal defense lawyer. hire him for a menial task so you get lawyer-client confidentiality. tell him everything that you do. ask him how much it will cost to take that case to trial. give him the money. they will all accept pre-payment and if you ever want it back they will give it you. ask him how much bail in this case typical is... give that to someone you trust and know their number

I live in a medical state and am under the plant count. I do not distribute.

I have no proof of income beyond my social security disability and recon it would look strange if I had a paid attorney. It might even be used as evidence of social security fraud if I did get pinched by a cop with a chip on his shoulder.

My defense fund is spent of prevention. Paying someone to mow my yard, be approachable to my neighbors, charcoal, and following the guidelines set by the state.

Fishermen don't go after little fish, though sometimes a little fish gets caught in a net.

I'm sure some of ya'lls experiences are different but some of these amounts sound crazy unless you're involved in some big operation or have a real record.

You don't need to go to that kind of trouble if all you want is someone on retainer. You just contact the attorney of your choice, ask 'em if they're taking new clients, what their retainer is and pay it.

In fact, this is a good way to keep your lawyer fund YOUR lawyer fund. It's much more difficult to seize.

For those who haven't experienced a criminal drug charge, either personally or via friends or family, I can assure you that it's too easy for $20,000 to go POOF! in no time flat, just like that. If you're involved in a criminal trial I can see the numbers jumping to six figures, and not only in the case of a kingpin drug dealer, either.

First time offense can knock you or your mom back $25,000, easy, especially if everyone insists on using private representation from the very beginning. In fact, IME, $10-$15K can go just during discovery.

Wouldn't professional ethics require them to report any ongoing criminal activity, even if they were your attorney? In searching for an attorney I had always imagined myself asking about cultivation and the costs associated with prosecution of it in a 3rd person kind of way. Like we would talk about it but I would stop short of flat out saying I was doing it. Obviously he/she would know what was going on, but not actually have direct concrete knowledge of it. I'm not sure at what point attorneys are compelled to report ongoing or future crimes; could use some insight there.

Is this common? I can have my attorney hold money allotted for litigation and they will give it back? I had always imagined that they would only hold retainer fees, which were usually non-refundable.

At least they know to have the transport cars cleaned each and every day. They know enough to walk around the vehicle to make sure that all lights are working. They know enough to shave and bathe every day so that they don't look like road trash.

And most importantly, if you're going to use things like newspapers to pack the load then at least they get off their asses and go to a bookstore and buy newspapers from a different city than the origin of the load.

It's called common sense.....

No. That is why he/she is YOUR attorney.
Found what I was thinking of:

American Bar Association Model Rules of Professional Conduct: Rule 1.6

Client-Lawyer Relationship
Rule 1.6 Confidentiality Of Information

(a) A lawyer shall not reveal information relating to the representation of a client unless the client gives informed consent, the disclosure is impliedly authorized in order to carry out the representation or the disclosure is permitted by paragraph (b).

(b) A lawyer may reveal information relating to the representation of a client to the extent the lawyer reasonably believes necessary:

(1) to prevent reasonably certain death or substantial bodily harm;

(2) to prevent the client from committing a crime or fraud that is reasonably certain to result in substantial injury to the financial interests or property of another and in furtherance of which the client has used or is using the lawyer's services;

(3) to prevent, mitigate or rectify substantial injury to the financial interests or property of another that is reasonably certain to result or has resulted from the client's commission of a crime or fraud in furtherance of which the client has used the lawyer's services;

(4) to secure legal advice about the lawyer's compliance with these Rules;

(5) to establish a claim or defense on behalf of the lawyer in a controversy between the lawyer and the client, to establish a defense to a criminal charge or civil claim against the lawyer based upon conduct in which the client was involved, or to respond to allegations in any proceeding concerning the lawyer's representation of the client; or

(6) to comply with other law or a court order.

So there are some circumstances where they can and should breach attorney-client privileged. It looks like it's limited to situations where the attorney believes that the client will cause substantial harm or financial damage to an entity. I personally don't think cultivation would fall into any of those categories.

I know of someone recently detained in GA for 1 lb. He is in it 60K so far to keep from doing time. Pretty much ruined his life, and he had some money.

I'm amazed at some of these figures.. maybe I dont live in such a bad place after all.

Around here (non-med state).. the layer typically wants $2500 and there isn't a judge in the county that wont make it go away for 5k. They are all corrupt as they come and $$ makes you "not such an evil drug dealer" after all.

$7500 around here - pretty good chance you'll be OK. I'm talking cultivation less then 100 plants w/o guns. Might not be the case for all lawyers, but ex prosecutors (now defense attorneys) will gladly work it all out on their next golf outing or lunch with the judge.

That said I feel sorry for all of the growers who spend their profits as they get them as if they'll have this income forever. I know several folks who've been busted after years of commercial growing..only to be broke as fuck looking to borrow money for legal fees. WTF?

Not just growers, but it seems as though a mass % of Americans have no idea what savings are. They have no desire or feel the need to save.

kinda hard to save while raising a family & your living in a deficit . not all of us have jobs that actually pay us enough to pay all our bills .

Certainly raising a family makes saving a little more challenging...but even more so important & necessary.

I was more referring to commercial growers (or even guys with a few 1000s) that immediately blow the profits from their labor without ever setting aside the funds for future events unknown.

I just dont like it when friends running 8000w 6 times a year coming running to borrow money for their "legal fund" because they set absolutely nothing aside while pulling down 40k harvests. Hard to be willing to help people like this.

Thats all dansbuds, didn't mean to sound like a dick to those struggling to keep their family afloat in a shit economy and workforce.

I had to fight a case once. Whoever said $20k goes poof is right.
Care to explain your legal costs a little further? Like how much you were running, what you were charged with, how long litigation stretched out, whether or not you were happy with your lawyer for the amount of money you spent, if you thought you saved enough or maybe if you thought you should have saved more.
