Why hasn't harris resigned her senate seat yet?

Harris Will Leave Senate Seat Monday! Harris will be sworn in by Sonia Maria Sotomayor, an Associate Justice of the Supreme Court of the United States. In a Senate that will be split 50-50, the tiebreaking vote she can cast will give Democrats control of the chamber. Given the hyperpartisanship in Congress, she may need to cast many tiebreaking votes.
