well this is my first post on this wonderful site but i've been a lurker for some time but on with the story. i had a friend of 15+years set me up big time he got a couple to get me to get them a ounce of just average swag and to meet them at a certain place and certain time. now this is always against everything i know i don't deliver because i'm not a dealer just a smoker but i took it there anyway. of course they weren't anywhere to be seen so i gave them a call and asked what the deal was she told me they would be there in just a few to hang tight. well being stupid and already having money tied up in this crap that i don't want i got out and walked away from my vehicle. minutes later i swamped by k9 and sheriffs deputies, the dog was already barking so they knew something was up (nothing in the vehicle but on my person)i couldn't ditch it and they wanted consent to search the car well knowing nothing was there i told them to go ahead little did i know they were going to pat me down and damn there it was on me. i was taken in to custody put on a hold where i was interviewed by narcotics several times trying to get me to roll on someone and when i didn't it really pissed them off. they asked for consent to search my home and i told them they would need a warrant for that. well they arrived at my house told my wife that they had consent from me to search and that she would let them search or they would take her and my oldest daughter in to custody on the spot and search anyway. well she gave in and they searched my house(now granted i don't have a grow i do have lights and all stuff)they found a small amount maybe a quarter in a jar that a bro had given me. now here's the part that got me i'm a convicted felon but not on paper anymore (not for drugs but let's just say someone died) inside my house were numerous firearms and rounds of ammo in which they quickly gathered them all up and took them from the house keep in mind now none are in my name and the only ones i owned are black powder the rest are my wife's which she explained it to them they told her it didn't matter and i was looking at 500 YEARS just on the weapons charges. i was finally granted a bond on a charge of mj for resale even though it was in one bag and here it is a class e felony. they kept the guns,took my money from my paycheck out of my wallet called it drug money and said they would be taking a charge of manufacturing mj and the weapons charges to the atf and the grand jury to get indictments at a later time now right now i'm feeling kinda fucked any good advice is appreciated and yes i know the first thing i should have not done was to get it for them and take it to them but being for a bro i thought it'd be cool now he's talking about it to everyone and knows to many details of what took place to have not had a hand in it i mean things that never got to the press but anyway sorry for the rant but i just needed to unload a little stress. again thanks for the great site hopefully i'll be around to enjoy it some more and learn with you guys!!peace and happiness to all

You need a lawyer, we are sympathetic to your situation, but you need the right caliber help, legal.

Folks, if you have to travel with herb, do it in a sealed, addressed envelope that requires a warrant to open. And never consent to anything for any reason.

whoa shit...first of all and foremost. FUCK COPS. they took your paycheck what kind of fuckery is that. those scumbag cops are treating you like a dirtbag for a minor ass offense. an oz of weed is nothing, they are obviously on your ass because of the felon status.

2nd...the firearms are a bad look, especially if they are unregistered. you should know better than to be around an unregistered gun. im a 2nd amendment supporter and have a big collection of guns, but they are all legally registered and kept a location seperate than my weed. also, even IF i had an unregistered gun, that things getting buried until i have to break it out to use on somebody lol. never just hang around with an illegal weapon, that combined with felony drug possession is gonna fuck you buddy, plus your prior record.

get a lawyer, or jump bail and go to mexico because it doesnt look pretty.

you cant be around firearms. I am a convicted felon and I was looking at having my wife get a gun. I was told if shit went down (someone broke in, etc) and I used that gun, I would be in BIG trouble.

Sorry to hear of your troubles.

Consult with several lawyers, retain the one you feel comfortable with. Sell anything and everything if you have to. If you have been locked up for some time, you already know what happens to those with paid lawyers and public defenders.

Look for someone who has been in that county for a while and has many relationships. They may have been a prosecutor, public defender etc.

WHO a lawyer knows is JUST as important as what laws he knows.

Your freedom hinges on getting all the tainted evidence from after the fact thrown out that was obtained from an illegal search of your home that you did not consent to. Fuck the one weed charge, no big deal.

Your wife is going to need to testify against the cops who came into search the house and the whole entire case hinges on lack of consent basically that is the key to this whole case. You need a lawyer and he needs to focus primarily on that first & foremost otherwise you are facing some serious time man. No federal safety valve with gun charges so no time off if they decide to hang you out to dry.

running is not a option for me. i am currently looking into getting a local attorney that is well established in this small town so i'm hoping for the best. i have a few prominent citizens that are now on my side so i feel somewhat a little relieved.

Best of luck to you zarak, it sounds to me that the search on your home could have been illegal, as others have said get yourself a good lawyer. Its just an ounce of week so i wouldn't worry too much, as long as all the weapons are legal you should be fine.

Courts call that "constructive possession". Be prepared for that.

Your best bet is to get it thrown out based on false statement by the police to your wife. Hopefully.

time for an update. holy sh_t i'm free, well except for misdemeanor probation and a couple thousand dollars worth of fines. i got one of the best "if not the best" lawyers from my area. he worked it through sessions court but couldn't get me a fair shake so we went criminal. well when we went criminal they held up their end and called up atf. atf stepped in and started to investigate to make their case and discovered all the b.s. that the local police did that to them seemed to make the case look like a toss out. so one agent who was good friends with my lawyer called him up and told him what i was going to plea to or he would have to take his chances and take it on to a federal level. here was his deal- simple possession on a charge of 3 oz. and let go of a few of the seized firearms mainly large caliber assault style rifles and a lil time in county. well it sounded good enough to me and now i'm happy, wife is happy and snitch ass boy is sweating along with his other 2 buddies. don't worry i got a good head on my shoulders and i won't f_ck with them i'll just let the guilt and sweating it out waiting for something to happen(that never will) be punishment enough. to everyone here that wished me well and gave sound advice i thank you all from me heart. on a side note i got the 3 oz. charge from what i had on me, the small amount from the jar, and a damn bag of stems, leaves and popcorn that i forgot was in the freezer for butter. lesson learned keep a cleaner house and trust no one!!! time has been served
