Victor Marion is a barber in San Diego, California and a medical marijuana patient. On May 15, 2012, Mr. Marion allowed San Diego County Sheriff’s Deputy Kevin Ralph to conduct a compliance check of the medical marijuana grow at his residence in Poway. At that time, Marion informed the deputy that he was involved with the Supercanna Collective in San Diego on 32nd Street and Adams Avenue. He also provided the deputy with a valid medical marijuana recommendation.
On May 18, 2012, members of the Narcotics Task Force raided the residence. The Integrated Narcotics Task Force is a group of agents cross-sworn as both local peace officers and DEA agents. The DEA is committed to complete marijuana eradication throughout the U.S. Inside Mr. Marion’s residence, agents found medical marijuana plants and concentrated cannabis. Concentrated cannabis is processed marijuana. Medical marijuana patients commonly use concentrated cannabis to avoid the potential harm to the lungs involved with smoking marijuana in a cigarette. Concentrated cannabis can also be consumed in a vaporizer which does not give off any odor.
District Attorney Bonnie Dumanis filed felony criminal charges against Mr. Marion and another patient. On August 14, 2012, the prosecutor dismissed the cultivation and possession charges and charged Mr. Marion with manufacturing a controlled substance through a chemical extraction process for which there is currently no medical marijuana defense.
