What state are you in? That's the principal problem in my case. I didn't know what was legal and what wasn't. What was being sold/bought at the club gave me further indication it WAS legal (oil)....

If there's another medical state that gives you as a new patient, in triplicate, the rules and regulations, WHY doesn't California do this? My case would be non-existent had they done what you're describing. Thanks- Blink

I believe there are ways to save your property.
I might be going through a forfeiture.
Got myself in a little trouble, for MJ manufacturing.(long boring story).
But at my preliminary hearing, one of the first things the assistant DA said was"I want him to do state time and I want the house."
I have about 75 k in equity,in the house.Had my mom and dad put a 25,000 lean(lawyers advice) on my house,as they put up 20k for my lawyer and 5 k to bail me out of jail.
But anyway...
I called a NORML lawyer(even though I already have a lawyer),I wanted all the advice I could get.
During my conversation with the NORML lawyer,I mentioned that they wanted to take my house and told him the details. He said he doubted they would take my house because I owe so much on it yet.
But he also mentioned, that if I'd of called him first that he would of had a plan to definitely save my house. He was talking fast and I didn't catch all the details(sorry).

Having a job that can afford to mortage your house and a small personal grow should keep it. Having a better lawyer works even better.

We checkd out norml and just found out what we kinda knew-not a friendly place for MJ where we live. But details are vague as to what penalty is given for what amount. It does say that cultivation over X amount is a felony with 150-250 months of time+fines. That's a broad scale. I guess it's just a case by case bases. Thing is I and my partner both qualify medically to get a script in most states that offer it-but we don't live there and aren't planning to relocate.

I like the incorporating ideas and the lean against it idea (if it works); but sounds like I'd need to speak with an attorney. Maybe norml attorney... We do make enough income at our 9-5's to run our household and we drive early 90's "beaters" too. We have little equity in the home; just what we put down basically..But it's home and we'd like to stay-if there's a precaution we can take now before we get started.

Hope you are all doing well-

Thats a good question Maj.PH.
I sure hope thats the way it is.
When I got busted, they took,my computers, any money they found in the house, including jars of change. They even took my sons savings bonds.
Not to mention when they search the house, they tore it apart.,and i mean they tore it apart. It looked like they took great pleasure it destroying the place.
I lost what little respect I had for the state police.

From what i've noticed, they usually don't seize the property unless maybe it's a huge property or it's paid off.

Some states have tax stamps.. a member here got busted and he had to pay 8k to keep his house, if i remember correct.

Whodi good point.. Usually heavily mortaged properties don't get seized.. Unless they can make monmey off it or use it some other way they usually don't seize things.. That's why they take jewelry, cars, TVs, cash on hand and homes paid off or close to it.. All those other things like jewelry they know you can't provide recipts for.. Also the cash is hard to explain so you usually dont get that back.. But your property usually will stay urs unless it's close to or fully paid off.. But thats not set in stone people get there homes taken all the time..

not a bad reply sack, but only funny to that sick side of us.

folks, i am an old man and i have been up and down this road. if you are acquiring your income by some illegal means, or even acquiring only your investment dollars illegally, you better think long and hard about "investing" that money in any sort of hard asset. you get popped and appear too prosperous, the government takes your shit. haven't you noticed? part of the master plan in funding the drug war is cleaning you out should you get arrested.

i am sorry to advise you that if you are obtaining your livlihood through felonious activity, the only truly safe place for the proceeds is in the ground. hopefully, the day will arrive when you are no longer committing major crimes and can safely dig it up and invest in your dreams. i wish you all the best.
