Ok so Saturday morning about 1 a.m. I was driving down a street the speed limit was 55 and that's exactly what I was doing, but it was also raining. As I'm cruising along some guy starts to pull out of a parking lot to a bar and my bright's are on so I thought for sure this guy seen me, because he was RIGHT in front of me. So I start to move over to my left-hand lane and sure enough this guy doesn't stop coming BAM!!! He hit me as I was doing 45-50 mph I spun about 3 time's and rolled backward's a good 20 feet before coming to a hault. The truck wouldn't shift in gear or do much of anything. The guy that hit me took off never stopped to help or anything. Since I hit his front end I tore his license plate off and we ran it to get the guys address, but I'm not sure if the cop went to the guys house or not. I wasn't severly injured just a few neck/back pains and my truck was totaled crunched in the whole passenger side. It wasn't a nice vehicle just a 1996 Chevy 1500 pick-up and I didn't have insurance, only cause my job doesn't pay well enough to afford insurance and everything else I do. I'm only 20 so I need alot of help and guidance on what I can do, my parents said they would put a lawsuit against him, but when my dad woke me up for work this morning they didn't say shit about doing anything about it. Now I kind of figure I'm going to be doing this on my own somewhat or until I atleast start doing something my parents won't do shit either. So all help if anyone know's where I need to start or if I can actually go after this guy for 5-6k for a new truck and everything else he caused.

Provided you can get this guys info and that you yourself are not in violation of the law by driving without insurance, you may be able to recoup blue-book value on the truck.

Yea I was suppose to get a citation for no insurance, but regardless the buy was drunk and hit me I should be able to file a lawsuit shouldn't I?

You'll need the police incident report and then the guys information, including his insurer.

It's no guarantee you'll be made whole, but it's a shot.

You can't prove he was drunk. He did flee so you have something nice there. There are many legal firms that will do the case for "free" and won't charge if you loose. If you win you will get your money and the lawyers fees are paid by the defendant... Check that shit out... its the best option!!

Yea that sounds pretty good, but I mean there is no way I can get him for being drunk I mean I know I can't prove that. This guy pulled out doing 5mph just keep creeping like that there was no doubt in my mind when this guy was about to hit me he was drunk...

Fuck no wether or not I got insurance I'm not a fucked up person especially being hit like I got fuckin hit. For all that mother fucker could of known he could of just shattered my damn leg or something. He just drives off? Karma? Yea it's going to be karma for him not me just because I don't have insurance doesn't mean karma is coming after me....If anything this helps me because of the fact my truck maybe worth 1000 if that and if I put a lawsuit on him ill get more than what I should of if he stayed, but why didn't he stay? Cause he was fuckin DRUNK when they ran his info. he stays in a rich neighborhood by my house, so I know for damn sure he had no reason to run except for the fact he was drunk. As I was talking to the cop another wrecker came to us and said they saw his car, but he couldn't figure out where he was going. They said he headed the opposite way of his house even they said he looked all drunk and his front end ripped off...

One other note, there is a lesson to be learned here as well.....never assume the other driver see's you while traveling at night, in the rain doing 50 mph.

It all could have been avoided with some defensive driving.

Yea lol its called "hit n run" but, yea I can say maybe I should of thought about it more....but come on lol do you really expect that shit to happen? Thats why they call it an "accident". Except this fucker should of stayed then I would be getting fucked not him, so now I'm going to fuck his situation even harder for being disrespectful first off and being AS drunk AS he was and driving...

I feel your situation. I was sitting at a stop sign trying to look around the parked cars on the street when i heard brakes come on and this dude hit the front of my camaro going like 45 in a 35. Spun by car around 110 degrees... Guess what? I got a ticket because i was at a stop sign! lol...

Speaking of karma... If you do win the lawsuit and settle. Will you be using some of that money toward insurance on your next vehicle by any chance? Just a thought.

lol yea ill use some of that money to get some insurance this time cause I'm also going to get myself a new truck. But, yea man fuckin people are crazy just don't know when enough is enough. My buddy's mom is an insuracne agent and I talked to her today about it, she was saying she won't be superised if they don't go up to the bar and write them a ticket for letting him get that drunk. She say's they will go back to the bar and pull his tab to know all his information.

If you got his details, and have his licence plate, then pay him a vissit, dont tell him you dont have insurance, ask him if he wants to settle without and court action and save himself a bunch of legal fees. If its a nice neighbourhood and he's got cash, it'll be his best option, esp if he was drunk. Be nice, be polite and none threatening, he may write you a cheque (check usa spelling lol) on the spot.

talk to an injury/accident lawyer. bitching on here won't help fix the situation. The lawyer should be able to tell you what they can do for you.

I got hit by a hit and run driver once and he had no insurance

i chased his car for a few miles and got his plates

i called the police and they went to his door the next day

he denied driving the truck, saying that one of his relatives must have stolen it

the cop came back and told me that the registered owner of the truck was not liable anymore

i contacted my insurance company and they paid for everything. props to progressive insurance, they cashed me out and fixed my car, and they went after the other guy themselves and i dont even need to deal with the situation anymore.

unfortunately you dont have insurance so you are fucked.

its not that hard to get insurance man, i was rolling for a few years with no insurance when i was in my "fuck the system" stage..but after i realized how cheap it was to get liability i started rolling with it. Its only like 50 bucks a month to get liability brother, you should wise up and get insurance next time!
