True, but I'm a cash-strapped student in an apartment. I have no money for an attorney, and I was the only witness to this. I didn't recieve any physical injuries or marks, they didn't try to beat me or hurt me. As such, there could be no way I could sue them, it would just be my word against a police officer's word, with no physical evidence.

Don't be loose, keep a micro-cassette recorder with a good condensor mic handy (I've seen the Boyz 'lose' their own tapes when it was convenient), and never, ever, ever, consent to a search.. ever....
Preferably meet 'em in the driveway, and tell 'em to hit the trail...

Put a dog fence [compound] to turn your front door into a no approach/trap zone. Insert dog. If unknowns come to your front gate, or have the balls to go through to the door, you have had time to be alerted and see them. Go out your other door and circle behind them like you just came back from a stroll. Of course you dealt with odor ands your breath before you went out, right? No "wafting odor of cannabis" no probable cause, no thank you, you may not search.

When the cops came knocking for my ass (with a valid warrant), I never opened the door. They pounded on the fucker for 10 minutes before one of them finally crawled through the back window. After taking me into custody, he asked,

"Why didn't you open the door?"

I replied, "I figured if you actually had a warrant, you'd break in, which you did. If you didn't have a warrant, I didn't want to talk to you."

Unfortuanately, they did have a warrant and I had a backyard full of enormous MJ plants. Ooops.

But I was never charged with anything other than cultivation and possession with intent. You don't have to open the door. Make their lives more difficult. Why the fuck not? They are there to make YOUR life more difficult.

on top of the memorized lines, i think its important that you believe what youre doing is right.

other guy got busted on here and was saying stuff like "i cant believe i was growing, it was the wrong thing to do and i wont do it again" omg :(

when someone has a loose grip on themselves and theres five cops in their face verbally assaulting them, its easy to crack.

you have to feel it. know you will win. get the tension out of your voice. stand up for whats right. dont be a coward. i think this is the state of mind where the quick witted, non-incriminating responses come from.

had this happen to me.
in my state they are required to have audio tape(which they did not) of the conversation.
also i would never, ever open the door and step out again. they can detain you while gaining info by looking in windows, smelling around, and looking over fences.

from now on its locked door and me not in sight. infact i dont think i'll ever answer my door again for unanounced visitors.

just what i've learned from my experience.

moose eater- your right about the tapes 100%. if the tape exist in my case it would prove alot.(no miranda, false statements, rosing out of house, sexually explisit talk and harrasment) basicly their whole case against me gone. but with out tape its this stoners word against the cops.

as for the laws in alaska, sounds a hell of alot better than where i am. i should have moved a long time ago and alaska was one of the places we were looking at.(along with california and b.c.)

in my state they are allowed to detain you for i think 24 hours while gaining evidence. and thats exactly what they did.

No cop is stupid enough to kick your door down without a warrant.

If you open the door they will just walk in and say you let them in on their report whether you really did or not.

It is kind of hard to explain to the judge why they kicked your door in if you let them in though.

Always make them kick the door in.

If their not kicking the door down, they don't have a warrant.

If they approach you while you are outside your house, just refuse to unlock the door for them.

Just sit on the ground Indian style and let them arrest you or do whatever they want to do.

Never open the door for them though, not from the inside, or the outside.

Don't open the door and tell them you don't consent to a search.

Don't talk to them through the door.

Go to your bathroom and sit in the corner until they leave.

Just don't open the door period.

Str8 up. Fuck em. let them knock and look stupid when no one answers the door. And going to the bathroom and chillin is an excellent idea. Fuck it, take a shower or shit and read a magazine till they leave. :nanana:

This is just a shame. People need to know their rights.

I got busted as a kid once for some serious stuff and was scared and talked. Had I kept my mouth shut, I would have gotten off.

2nd time, I knew my rights and did much better.

The cops have 3 reasons to enter your home
1 Permission
2 Warrant
3 Extragent (SP?) circumstances (screaming, kids crying, etc) in dwelling.

If they have a warrant, they arent going to ask if they can search.

Theres also different levels of police contact. A police officer can not detain you unless he has just cause. All you have to say to a LEO is your name and thats it. You are under no obligation to talk to them, period. People really need to understand their rights

I got busted on a knock and talk...it's a long story...and I posted about it under my old user name (granma).....

Based on my experience, and what I was told by my lawyer....
Do not answer the door. If they had enough evidence to really bust you, they would not be knocking. I went outside and shut the door behind me....but the cops used the above line that I quoted...and it took a while, but they got to me...and the rest is history.

I wish I had a freedom card on me to hand them as soon as they pulled up and got out their cars.I would only use the part that has no reference to norml, though...not both side of the card.

I made it quite clear to the LEO that I did not feel I was hurting a soul, MJ should be legalized...and even got the cops to admit they thought it was a harmless recreational drug..no where near as detrimental as alcohol.
