On Friday, the administration announced the forgiveness of $39 billion in student debt for 804,000 borrowers.
The math on that is incredible. $48,500 each on average.
Do they rule on Constitutional matters? Yes. Are all cases before the Supreme Court about the Constitution? No, not even close.
Case 22-535 Department of Education v. Brown was about using the HEROES Act to forgive $430 Billion in student debt and the nowhere in any article of the case references the Constitution.
What the Supremes actually said was they couldn't use the HEROES Act for justification of the debt forgiveness. Which is why Biden's team is now forging ahead with the new plan (the plan they should have done in the first place) and using this defeat as a road map to success when they inevitably face the challenge in court again.
