You didn't mention a warrant was there one?

Apparently not. People need to learn not to answer the door. If they have a warrant, they are coming in anyway. If they dont, they hope you will give them a reason to get in, which the OP did by admitting to having a joint and letting them in the house.

Cops are NOT your friends. They dont bring a unit out just to talk. They want to nail your ass.

You say you got hit with a 1500 fee and you think the charges will get dismissed? Why will they get dismissed? You TOLD them you had some joints.

I aint bullshitting. COps knock on my door, they better break it down cause I aint opening it.

Thats why I tape sudoku puzzles to the door to distract them for a while.

If a cop comes to your door, walk out another door and come around the house to talk to them. Even if you only crack the door to talk to them they can still smell/see things. They can't keep their eyes still, lol.....

Ok thanks for the replys buy you guys are missing a couple points.

NO WARRANT. i knew that, and thats why i told them NO SEARCH. his reply was that i was going to jail NO MATTER WHAT, so after that point they were going to find that joint either way, it didnt matter if i showed him. BUT, because i DID, and was COOPERATIVE, they left my house intact, and actually didnt even find glass bowls in my drawers! they were really easy on me becasue i was so nice. Im absolutely convinced thats why they didnt dig deep enough to find my gorw... its not invisible!

TWO- i dont grow a lot. under 5 plants in my area is a misdemeanor. i keep it that way, so i dont see it much risk to tell a couple OTHER PEOPLE THAT GROW. i would never tell anyone that doesnt grow. Besides, i didnt say i LIKED to show my grow off, i said it HAPPENS. and it does, i know you all have. again, the people that disagree strongly with this are the ones who are making money off their pot.... lots of money... they have too much to lose. this is much more of a medical/hobby deal for me. the only money involved is the savings i get from not having to contribute to the black market.

not to mention how many people on here put pics of their grow ON THE INTERNET!?! thats worse then just telling a good friend that also grows....

and ill throw this last thing in- i saw them comin to the door but i honestly didnt think they were here for me. this happened months after i ended contact with that ****, so it had slipped my mind. However, i am putting a peephole in the door and from now on i wont answer it if they come for any reason. Because after all, i used to think they need a reason to come in, but apparently all they need is an 'anonymous tip'

itll get dropped because i said NO to the search. ONCE HE TOLD ME i was going to jail, i showed him what he was already going to find. my lawyer didnt even care what happened after i said "I cant allow you to search" he said "thats that. dont worry about this bullshit"

i wont be answering for them anymore though... i dont live my life as a criminal so i normally dont have a problem talking to cops, but after this i simply cant be normal anymore. I dont even hate them, they dont know. theyre just a ignorant human species. remember planet of the apes?

When he said you were going to jail, did you ask him for what? That was a boo tactic, there was nothing to arrest you for.

You may luck out if the cop admits that but I suspect he wont. Dont count on it

Your attorney will probably have to depo him and all the officers that were there. That alone seems like it would run more than $1500

I am not trying to bash you, its just important for people to understand their rights and know what to do. Had you never opened the door, there would be no story. Had you walked outside and locked the door behind you, and refused any search, there would be no story.

The way I see it is if they have a warrant they are coming in no matter what. BUT if they dont have a warrant, its much harder for them to come in. If you open the door, they can say they smelled something, saw something, you gave permission, etc. But if they break down a door w/o a warrant, that will be tough to explain for them.

Like you said, for you its a hobby. For me its a shitload of time and I know how crooked cops can be. I am not helping them.

ok. say i didnt open the door, and luckily they dont know im home.

thats it? they go away and dont come back? yeah, right.

plus, if they do notice im home, whats to stop them from saying "we heard a disturbance".

my point is, if they want to search your house, they will. you have to prove your innocence in these days, its just a cold hard fact about america. so HIDE your shit!

also, my lawyer is good friends with the prosecutor. this isnt the first time he has helped me get out of charges. $1500 means $1500. :joint:

ps- after i told him "no" and he told me "thats fine then youre going to jail and were still searching the house" i told him "im not going to physically resist whatever it is youre going to do" because at that point i was under full belief that i had zero options. showing them the joint was after the fact. im willing to take my word right to a jury of 12 believe that.

YES, they will leave. If they dont have a warrant there is nothing they can do. I dont want to get into specifics but I have had the popo at my door a few times throughout my life and there have been several times I didnt open the door. Once my kid told them no adult was home and walked away from the window.

They may come back but by then your house better be cleaner than Martha Stewarts house

Good luck and hope it works out for you. Hope your ex gets herpes or something, dumb whore

Your first mistake is you answered a door you didnt need to. No biggie. The second mistake you made that your lawyer or anyone elses wont be able to get you off on is you were totally culpatory to the crime.

When the police ask you if you are breaking the law you dont willingly give them the information that allows them all the probable cause they need to search your house. Anything they find at that point is perfectly legal, even a rookie rate lawyer can tell you that.

Strike #2 for the mouth bro.

i completely understand the way the law works (i even know how its written, but thats never relative in real life) and i do agree i should not have answered the door.

however, as im trying to explain, i made it specifically clear they could not search the house, and his reply was "it doesnt matter, youre going to jail and the house is getting searched". at that point, it was over. i was under full understanding that i was arrested, regardless what the charge was. showing him whats in my pocket (or my ashtray) is not relative to this situation.

do you understand what im trying to say?

I've been threatened with the "you'll be arrested if you don't do what i say" so many times I don't even listen to those asshole cops when they tell me that anymore. A lot of the time they use that to scare people into doing what they want them to do. I don't give a fuck, I would of locked the door behind me and say "look I don't care what you do to me, go ahead and arrest me but you aren't getting inside this house unless you break in". If a cop breaks in he better have good reason (like a warrant) and if he doesn't and still breaks in he will have to explain himself in front of his superiors, my lawyer and a judge and he better have a damn good explanation. I'm serious don't ever let some coward ass pig push you around.

exactly right JJscorp on the walking out another door then go talk to them. learning how to talk a good game is a real good way to stay safe. Even if you are against lying, it is something you must learn to master if you wish to live on this planet.

NEVER let a cop in your house unless you are certain that they will not find your grow. Talk to them OUTSIDE and play dumb no matter what. If you have to say something to them to calm them down, say A) my attorney told me never to talk to police without him and B) he also told me to ask all strangers for a warrant if they would like to visit my home... whatever else you say WILL be recorded and used against you some how by the court...

girlfriends are the worst to tell shit to. i believe wives are ok because they are tied to you somehow, mostly financially- and if you go down, ultimately THEY go down... but girlfriends bro, bad fucking move....

Ha thats great, by me they would be like i saw a gun then they would break in and shoot your ass or the classic i smelled....! thats why i never answer, if they comin in they comin in if your home, away, doors locked or not, otherwise no need to even talk with the motherfuckers! i had one group of them sit outside my door for 2 hours onece, knokin every 15 or so, they kept saying "what the hell is that smell" or "do you smell that", it was the freshly cooked ketaset and i was in a hole on the sofa drooling on myself, they went away, they always do. i know everyone says go outside ask for a number to call etc, i say ignore ignore ingnore, if they can come in they will if they can't no need to open the door to intimidation and i do not mean the literal door!

i believe i did make them go away.

now that adress is on record as a medical marijuana user and nothing more. as it should be. i dont give a damn that they know i smoke, i want them too. im still pissed about the $1500 but oh well, thats the way it works in todays world.

For those who ignored the cops, no question youll be put on indefinite alert. your listed as "no show" and any chance they get theyll want to be all over your nuts.

thats at least my observation from around here. they honestly didnt go nuts when they found the bud, they understood it was personal. but you know how they are- they throw on charges simply because they can. they didnt want to leave empty handed- thats embarrassing.

Seems if you really knew the way the law works you would have played his " Im going to arrest you anyways " card with " go ahead what do you intend on arresting me for " instead of caving in, confessing to a crime and then giving up the last right to privacy you had.

The cops showed up with nothing more than an angry girlfriend tip, no warrant, and a gameplan. You got played and gave them everything they needed.

Being somewhat familiar with litigation Im curious since this happened three months ago you should already have a copy of the police report but havent mentioned one minute detail from it. Whats up with that? Did this event even happen?

I DID say "you cant arrest me on an anonymous tip"

I DID NOT play into their hands. HAD I, i would have done something to piss them off so they would have REAL reason to go after me

I DID NOT CAVE, i told them "im not going to physically resist you" and i didnt, i simply complied with their commands AFTER they told me i was going to jail.

Police report? there wasnt even a search warrent, who the hell knows what the report says. it doesnt matter, my lawyer has already seen it and i would hear from him if there was a problem.

dont you guys know there are two types of lawyers? the ones that actually have to fight for what they want and the ones who have power in the city- the ones who go golfing with prosecuters on the weekends.... those are the kind you need to get in situations as this....

i sat in jail for two hours and i got one charge. thats a hell of a lot better then getting multiple charges with possible no bail until i see a judge....
