If he was rich he would build the case against the cops right to enter in the first place because this is subjective. Was there really grounds to assume a domestic disturdence was in effect and someone was in danger?
If not then the call alone for domestic is not ground to search. They have to prove then though someone was in some type of danger, though without a home security system and the whole thing on video it's cops words against theirs.
That being the case, the decision to lay up and take some charges while getting others dropped is probably best.
Yea but certainly you asked for this by having a domestic while growing in an apartment or close quarter living.
You could have just walked out and destroyed public property or beat someone up and gotten in less trouble.
Anyway, I would have stayed in the drug program. It's a BS situation, but the cops do have the right to enter when they think someone is in danger or such. It's ALWAYS best to have a smoke room, away from the doors and a good door.. that's locked. And most importantly .. no domestics, no guns, no kids.
The system is flawed, cops shouldn't even be able to claim seeing someone smoke is probably cause.
Things like that make me want to rent a house with a bay window right in front of the cop shop and smoke my tobacco water pipe until they illegal raid my house. You can't visually identify a bag of pot from a baq of much anything else green from a distance.
The only unique identifier is the smell but all too often cops cheat, lie and bend the laws because, well that's all they really have. It's not like they did well in college or had many other options but to become a public servant who occasionally gets shot at and everyone hates.
If a cop sees my rolling a spliff or smoking a bong through my door or window, he should have probable cause and I think if you could get a case like that to the supreme court you'd have an undeniable point. How can the cope KNOW thats an illegal substance.
Does every bag of 'something' or waterpipe superceede your search and seizure rights ? I think it's clear these practices have to unconstitutional. They took the concept of probable out and replaced it with 'possible cause' and in that world everyone is a suspect and can be searched. His hands were in his pockets wrong. His cigar looked suspicious. He was making nervous actions. When does the BS stop and justice start ?

I agree...that cop had no right to search the house when for no reason having the both of you sitting down on a couch and answering questions and not reaching into a house,errr couch for a weapon...
If you stepped outside and talked to them...I still don't think they would have got inside the house to "look" around
You may get the case thrown out...at least have proof that nothing about you "reaching for a weapon" while sitting down with your GF....Wierd thing about this.
If they so worried about a weapon and you had a weapon buried in the couch...bam,,ya dead pig.......but seriously ...Searching the couch for a weapon before you both sat down isn't that what happened.

Hey Now, bummed out hearing about your legal problems. You got a problem.
You think you can beat the rap cause the arrest was'nt right. You still were caught with weed, and growing plants. How the cops got there really does'nt matter, you were breaking the law. A lot of people in jail tonight fighting for their rights, lawyers like a good fight, they get paid right. Even after alot of money spent, you could still lose because you were guilty.
I know you don't need me telling you this, but listen to my story. I got into a domestic dispute. I left the house to avoid the fight. When the dog and I returned I had cops all over my growing space. 12 plants, and all the stuff it takes to grow it. I was busted cold. Spent three days in solitaire confinement, it was the weekend. Not fun, If I did any thing right I did'nt freak out and start screaming about my rights.
My plants were in veg, and the mother was cut back so I knew I was under our 100 gram possesion law. The equipment, lights, pots, pipes, ect were called Drug paraphinalla, still a misdemeanor but with jail time and loss of driving privileges. I know, What's driving got to do with it, but that's our law. Also domestic violence charge. I was in trouble. Cops spent 4 hrs cleaning my grow space and searching my entire life worth of stuff.
Long story short, I had like 5 charges. I admitted to the plants and the grow lights and bongs, but not to the violence charges. Using the court appointed lawyer we plea bargained everything down to two counts of disorderly conduct {messy grow room}.
It no fun being busted for anything anywhere, but when it the local cops and local judge it's a nightmare. In court I admitted my Rastafarian beliefs and my sore lower back, but denied being drunk, stoned or any violence. Cops had me on video for three days, and I did'nt flip.In the end that worked in my favor. I plead guilty to the lower charges, my two 30 day sentences and my fines were postponed if I completed 9 months of supervised probation. Piss tests,AA meetings and staying out trouble. Just this month my sentence was "vacated". It's over and except for the court costs of about $500. I did'nt even get fined. Sure I had a Supreme court case, but local courts are busy places, they don't want a long fight, but they got time. Meanwhile the defendant got to spend alot of money on lawyers, who always promise to "beat the case." Why not either way they get paid.
When this happened I was mad as hell,knew I was ****ed. I went to a friend who been in jail and knows his shit. He explained to me about alot of innocent people in jail fighting to get out. "they got you man, you were breaking the law." How you were arrested not as important as that bag of weed they saw when the first arrived at your door. "Due Cause" will work for the cops everytime. What really at stake? Were you gonna get hard jail time for two plants? Remember this is America where jails are overflowing with real criminals. The aggravation, stress about this whole affair is enough punishment.
I wish you the best of luck, but it been my experience if your caught red handed take the advice of Jackie Childs, Kramer's lawyer on Seinfield and throw yourself on the mercy of the court. Really, Jah guide, I'll keep you in my prayers.

well whatever happens i hope you beat the charges and i really hope the cops have to pay for your lawyer when you win, that would be some sweet ass ice cream on top of the cake
yo yo guys, sorry I didn't post sooner, but have to tread lightly these days!
I finally had my day in court after months of continuations and suppression hearings and.....
they dropped everything but 2 misdemeanors drug possessions (NO2 and MJ)!
the judge ruled that the initial search of the apartment was in fact in direct violation of my fourth amendment and as such they could not use anything they seized as evidence against me. They offered me a plea bargain dropping the felony and 2 of the 4 misdemeanors with no jail time, 2 years of probation, and a $200 fine.
My lawyer was able to get a hold of their internal documents authored by the DA that contained their argument on why I should be in jail for as long as possible (which made them look like a fool in front of the judge). Turns out they have been on my trail for a while. They were posting surveillance on my old apartment and when I was kicked out of drug court they doubled that up. They initiated phone taps and attempted a couple times to get an undercover to make a buy/sell to me. Of course this all turned up empty handed because I haven't even smoked weed in a year and a half, much less possessed. And i'm no drug dealer, and never will be. I'm still taken aback by how much they spent trying to make these charges stick... PA REALLY hates potheads.
so I'm safe, I'm free, and I'm lovin life right now.

Glad to hear things took a turn for the better!!! Keep your dors locked and if they ever show up again, you don't have to let them enter your residence without a warrent. When you see them open the door and step right outside and lock the door behind you!
Stupid S.O.Bs tryed to enter my place once, said they heard screaming, I asked them if they needed their ears examined cause that's my son's band playing. Then they changed their tune and said they had a noise complaint... I told them it's 7pm, both the homes on either side were unocupied at the time so that was BS, and to come back at 10pm when the noise restriction takes effect. I never let them past the front door...best of all they then asked if they could come inside to talk,it was raining it's ass off and they didn't like it one bit....drenched S.O.Bs

yeah PA is tough on weed, whenever I travel through PA (312 miles on I-80) I get good and buzzed before I hit the state line & I stash hard all my weed and stay only 5 mph above the speed limit. It's funny how little trouble you can have in Ohio (most lax weed laws in the nation) and get jammed in PA right next door.
I hope you can get back into the grow mode once the dust has settled, I'd consider moving though into a new jurisdiction if possible to keep the heat off of you.......

i dunno what are your from but in my area i got no trouble, they are not fond of it but i have driven by them smoking and nothing happened numerous times, fortunately i dont grow but sounds to me like your situation was a they got lucky they got to find it but you got lucky they were idiots and fucked it up
