if you are going to get busted, maybe I should have said "someone is sympathetic to your situation" rather than "likes you"

still, that fact is, there is no such thing as legal or recommended limits.

when you get busted, would it help to have 10 certified physicians stating you need to smoke an 1/8th a day to be healthy? yes

when the judge makes a decision, its all up to whether they are sympathetic to mmj users. those 10 physicians don't really mean squat.

if you want to be safe, stay within limits. if you want to take risks, don't

its mostly a peace of mind thing if you ask me

The doctor that I see in the Triangle only writes a 5lb script! It's just a 5 hour drive and a $200 every 6 months to renew! If ya'll weren't being rude I might have told you the doctors name! Enjoy your state limits!

The court on Thursday let stand the voluntary card program but found that the limits it imposes should not "burden" a person's ability to argue under the Compassionate Use Act that the marijuana possessed or grown was for personal use.

California Attorney General Jerry Brown said in a statement the decision "confirms our position that the state's possession limits are legal" as applied to medical marijuana cardholders.


Thanks for posting that--I did not realize that if you have a State Card, you are still bound by the 6 and 12 and Half pound-- That sucks!!:tiphat:

KmK many thanks for your post..I am not clear on this ^^ again, as usual, as I have never been scince inception. I am considering doing a thread dedicted to it to see if we can get some more input from someone with facts rather than opinion. I registered for the State program and now am wondering if I should have?

sorry, none of my sources come from the internet

source #1: friend who recieved 6lb script

source #2: friend who works at doc office offering rec renewal for $40... says doc is about to go out of business because all the "fake" docs are killing the biz with their "fake" limit increase recommendations

source #3: friend who just completed all processes and paperworks to open his own mmj dispensary and now sells his product at a store right on the beach

source #3 was raided with 100+ plants and multiple firearms just before opening his store... no time served

I tend to think all 3 of my sources know what they're talking about.

but hey, i could be wrong.

keep driving 5+ hrs every 6 months to pay $200+ hope it works out for you

actually, the final word rests with what your doctor recommends. if your doctor goes on the record and writes down that his patient can possess 25 plants and 6lbs, then that is all the judge will care about. Dumb cops aside, read the laws.

There is a lot of misinformation and interpretation on this thread by respected members.

The supreme court ruling on limits state that it is "the patients current medical needs". The doctor determines the words in quotes. I repeat "the patients current medical needs". Your doctor must see you regularly at least twice a year to determine your current medical needs. Your medical needs can change in a month or 6 months.

you read wrong. the supreme court ruling throws out the state limits. it keeps the ID portions of the card. you can have the state card and have a limit exemption. the county healh dept even told me as much.

who cares if some jerk off with a fly by night dispensary tells you something because his fly by night attorney told him something.

you can have a plant count exemption. just make sure it is worded properly in case you have to go in front of a judge. helps if you have an incurable disease and not just "fleeting insomnia".

BEWARE this is a SCAM.

The only thing a doctor can do is recommend that a user have an exemption from limits.

There are no medical studies for MJ so it is impossible for a doctor to "dose" your needs of MMJ.

Doctors who offer exemptions of certain "amounts" are feeding you BS to make $$$.

My friend has a doctor who gives an exemption of 6lbs.

My friend got pulled over with 3lbs.

My friend tries to contact doctor to appear on his behalf to testify to legitimacy of medical claims.

My friend finds out doctor is only in the country 2x a year, the rest of the time he is busy sun bathing in Costa Rica.

Long story short, you're not getting off with increased plant counts and numbers unless people are being nice to you or you have scripts from different patients for every 6 plants.


so your friiend's rec said he could have 6lbs and the cops disregarded it? what did the judge say? i doubt your story holds up bro.

the law clearly states that CA med marijuana patients can possess grow and transport as much cannabis as their current medical needs . who decides this? your doctor.

The real bogus doctors are the ones charging $40 and giving generic recomenndations.

no 2 patients are alike, no 2 scripts are the same. There are people on Oxys taking 20mgs a day, and people on oxys on 600mg a day. This is a fact.

At the end of the day, it only matters what a judge says. The judge will want to know your current medical needs. He will ask your doctor.

There are some logical errors in your bulleted 1,2,3 anectodal examples

P.S. my doctor doesn't leave the country lols. he is def a scam artist.

I have concerns about the state cards. I get Disability and Im 100% disabled for the rest of my life. If I get busted and the state reports this to the SSI will they revoke my benefits since cannabis is Illegal federally. I have been using Meddicann with no problems. I have never been busted so I could not say if meddicann is good or not but the state cards make me even more nervous. I dont like being in any state database where they can come bust me if they wan to.

Hammer you say "they will" is this really true? I've read about a lot of differing instances and I'm not sure this is a fact. My reasoning is, to take away your disability I would think they would have to prove you are no longer disabled. It's such a huge process, thier process, to get awarded these bennifits, I'm not sure they could just yank um because of your legal state use of pot.
As for state cards..I had one last year, they provided certain bennefits, but there are some loop-holes that I don't like. I am contemplating not re-newing mine when it expires. DD

Thats why I don't want to be on any list state cards make me very various. If leo can see that your a card holder the feds can as well. If they decide to bust you there goes your income until you are released from jail. I'm sure there will be other hoops that you would need to jump through to get your benefits back. It took so long and was a major headache to get in the first place. I'm not going to make it any easier for them.

wtf? that's not the way the law was written when voted in in 1996, it's what you need, there is no hard limit, did you have to pay that doctor extra for him to place this limit he made up on the recommendation?

SB 420. You need to keep up on case law because there are limits. The law is complicated. Many people think that the Kelly Decision says that there aren't limits. This is not true and it's more complex than that. Also a recommendation by itself does not protect you from being arrested for violating SB 420/attorney general/DA guidelines; you need the state issued Marijuana ID card which is very hard to get. If there is some update I am not aware of please guide me and others in the right direction.

You do not need a state card or any card all you need is your recomendation from your Doc. Thats what your going to show to leo and the court. None of the people I know had problems getting there state card it just took a long time.

They cannot find out you have a State Card-- Your info is encrypted (by Law) in the Data Base...it is set up so nobody can access it...and if there is a hole in it, and they do...you will have a nice Lawsuit--:tiphat:
What information will appear on the MMIC?

  • A photo of the cardholder.
  • A unique user identification number issued by The California Office of County Health Services Medical Marijuana Program.
  • The expiration date.
  • The name and telephone number of the county agency that approved the application.
  • A web-based Internet URL that will enable state and local law enforcement officers, the public and others to have immediate access to verify the validity of the card.
