Has anyone ever been arrested from someone signing a statement against them?

That's why they have juries and defense Attorney's.

The average person just doesn't sign a statement against someone for no reason. Usually it's because a crime has beed commited. It's up to the DA to look at the statement and determine it's validity, or lack of. Usually if it's a he said she said, minor thing they will hope the two work it out. Although I saw one case where two neighbors were calling the law on each other day after day, so they eventually arrested both of them on every statement just to put a stop to it.

I never realized there were so many people here that didn't know how the law works. Don't fool yourself thinking more than one person has to see you do something for you to be arrested. That's why it's important to never show or even tell one person about your grow....

So if anyone can have anyone arrrested at anytime... when people are fingered for a crime, why dont they just say "i didnt do this, i wana testify that joe schmoe did"

edit: the amount of armchair attorneys here is hilarious.... it actually makes me sorta sad, Just cause something has happened to you people... doesn't make it the way it is.


a judge has no reason to not believe a law abiding citizen who is reporting a crime for the benefit of society.

if you saw someone comitting a murder, you can go a sign a statement that what you have witnessed is true, if you lie, you are gonna be held accountable for that...

so when someone goes in and tells on you, there are no reasons why not to believe it.

for example, when i was a kid, i heard strange noises in the house next-door, i knew the family that lived there well, and knew they were not home.
i thought someone had broken in the house, so i go out and see a truck parked inside the garage and a couple strange dudes loading some furniture.
so i go back to my house and get my bicicle, and ride to a police statation that was about 1km away, told the police what was up, and they loaded me and my bike in one of their trucks and we drove back to my neighbors' house.
popo gets out of the truck and start to question the guys with the truck, then i see the uncle of my neighbor come out of the house since he heard the police arrive. turns out the uncle was just taking some old furniture my neighbors had given him. i had not seen the uncle when i went to check what was up though, just saw two strange dudes with a truck.

sadly, since cannabis is considered to be the devil himself, if someone tells the popo they know someone grows, you bet your ass the popo will come around looking for your grow, and when they find it, you are gone. and you can say you were busted due to hearsay.

1. Joe is hurting for money, so he decides to bag up some grass and tell someone it's pot. He finds someone and tells them it's great pot and they buy it. It just so happens the person Joe sold the weed to is a cop. They arrest Joe and take him to the station to book him. While testing it they find out it is nothing more than field grass. What happens to Joe?


2. Bill has a freind that is down on his luck. So he gives the friend some pot. The cops catch the friend with the pot and he says Bill gave it to him as a gift. What charge does Bill get.

3. John is visited by his brother Bob. While talking, John tells Bill he murdered a man 40 years ago and he has been in a freezer in the cellar since the murder. Bob says bullshit so John takes him down and shows him the body. Bob then goes to the police and tells them the story. What happens, if anything, to John?

according to how the law thinks, yes, that is right.

you see, if they let that other criminal go free who had the pound with the other busted criminal, who is to say he won't go get another pound to sell it to little girls and force them to worship the devil?

now that they have one of the two, they can catch the other with what the one they have tells them, and they get two "criminals" off the streets.

Joe is arrested for distribution of marijuana and goes directly to jail

2. Bill has a freind that is down on his luck. So he gives the friend some pot. The cops catch the friend with the pot and he says Bill gave it to him as a gift. What charge does Bill get.

Bill is arrested on felony distribution of pot, and since Bill lives near a school, they hit him up for that too... Bill goes to jail (There is talk of imposing the Rico statues..lol)

3. John is visited by his brother Bob. While talking, John tells Bill he murdered a man 40 years ago and he has been in a freezer in the cellar since the murder. Bob says bullshit so John takes him down and shows him the body. Bob then goes to the police and tells them the story. What happens, if anything, to John?

John is arrested and put in the cell next to Phil Spector, who falls madly in love with John

I was arrested one time Not cannabis related,I was building a new deck on my house
on a Sunday ( only day off ) And the guy next door an old man comes in my yard .

He was dunker than a coon dog telling me i can't be working on sunday how it was the sabeth and what ever.
I told him get off my f--king property and he pull a gun on me.
I said to him "Old man Ill kill you, you MF)

Well he left went to the court house ,signed an affidavit, About 2 hr's later i was arrested .
Spent the night in jail,Wasn't to bad seen and old buddy in there who had some bud so got high.

Next morn i go in front of the judge,They called my name i told what happened and the judge said thats what they said too.
Then the judge looked at me all surprised.Then he was like WHO the HELL signed this!!!

He then told the cop to unhandcuff me and to get me my clothes!!!
Then he said charges drop your free to go.

Man, I would break into his house and shatter/pour out all his alcohol all over his kitchen.

Joe would have spent in jail whatever time it took the test to come in and confirm it was just field-grass, kinda like guilty before proven innocent.
cannabis related charges are dropped after results come in though.

however, can he get new charges for conning whoever he was selling to? i dunno about that.

Bill gets charged with distribution and possesion.

I just did a brief google search. It's easy to find stuff. So this is from SC because that's what popped up on the first page. This is centuries old English common law and doubtful that there isn't comparable codification in the other states.

c. Arrest With a Warrant

(1) The Complaint

A person, whether police officer or private citizen, may appear before a magistrate or municipal judge and "swear out a warrant" seeking the arrest of another person. This complaint must be in writing and under oath. The magistrate or municipal judge should remind the complaining party the penalty for perjury attaches to all facts alleged in the affidavit and then administer an oath.

1. Joes screwed, by NY law, and most other states, what you say it is will be what you are charged with. Because he said it was pot he will be charged with selling pot......

2. Bill is charged with selling marijuana. Giving to someone is the same as selling it by law.

3. A search warrant is gotten and John is charged with murder.

Different states have different guidelines regarding no remuneration....some would be possession, some would go with intent/delivery..... and it seems anywhere it's on the books, somewhat favorable and reflected in sentencing...(point is still valid...)

Of course in itself, gift(s) insinuate smaller amounts......I am sure volume might very well change a favorable situation to an unfavorable one....

(His real problem would be they come down on him for giving away a z, and somewhere in the process he's holding 20....:smoke:)

Let's start with mob cases.......then work our way through fed drug cases (which actually takes it one further...stating knowledge when not only none, but in many not even knowing suspect..)......those alone should provide more cases than all combined have time to review...

Let's start with this one...(first search return on search phrase used....)

Shawn Sorrels, (Federal Inmate Number 40609-074) was federally indicted in May of 2003 for Conspiracy to Distribute Illegal Substances (Drugs), Possession of a Firearm in Furtherance of a Drug Trafficking Offense, and Possession of 5 ounces of Marijuana with Intent to Distribute. In this conspiracy there were around 20 co-conspirators indicted for similar charges such as Shawn's. Out of everyone in this conspiracy, Shawn was the only one to plead Not Guilty, and to take his case to trial. All of the others signed plea bargains and 10 of them received "time off" for testifying against Shawn. Shawn chose the path that very few in similar situations take. He did not assist the DEA, FBI, or Assistant US Attorney with information -- he didn't have any.

His trial began March 10, 2004. No recorded phone conversations, no undercover purchases, no surveillance, NO PROOF other than the words of his co-conspirators receiving downward departures in exchange for his or her testimony. His name was only brought up after the arrests of several other co-conspirators on the day of their arrests. Shawn's name was added to a search warrant based on one girl's account, and his apartment manager stating that he had a lot of people going in and out of his apartment. This was disputed by his attorney and was allowed into evidence by the presiding judge. The search of his apartment was the only tangible proof of evidence presented at his trial. 10-14 people were prepared to testify against Shawn, (but only 6 did so), and on these rehearsed and "paid" testimonies given by admitted drug dealers Shawn was found guilty on all counts.

The gun found in his apartment was unloaded, in a holster, in his closet -with only one bullet in the entire apartment. Those that testified against him were all held in the same jail cell for about 6 months, and in jail for 9 months before Shawn's trial. On June 30th, 2004 Shawn was sentenced to 180 months (fifteen years) in prison.

Shawn received the most time out of anyone else involved in the conspiracy- more time than the man charged with the King Pin Offense. One man that testified was caught with a pound of methamphetamine- received less than 5 years. Others that testified received 7 or 8 years and were caught with 10's of thousands of Ecstasy pills; kilograms of cocaine, pounds of methamphetamine; pounds of marijuana and most were caught with firearms. He has been sent to a prison, which is also home to two of his co-conspirators that testified against him. One caught with a pound of marijuana and a gun will be out next month in May, the other caught with kilos of cocaine will be out this coming August of 2005.

1 joe goes to jail,,, there is a special charge for this
2 under 20 grams in my state is a gift and a fine, i am not sure if all states are like that

edit now that i read the rest of the thread lol,,,, samething happened to shawn happened to me pretty much,,so all kinds of fucked up shit can happen in the socalled "land of the free"
