Has anyone ever been arrested from someone signing a statement against them?

No, you can not be arrested based on somebody's signed statement.

Judges must issue warrants based on probable cause, NOT heresay.

The story you relate is, indeed, a result of probable cause,
based not on your stupid friend's signed statement,
but that pound of pot the cops confiscated from him.


WTF? Not another one.....

We were arrested for the weed based on the one persons statement. The same statement was also used to obtain a warrant to search our homes and vehicles......

Bottom line is tell noone, keep your shit secure, dont speed, and if you get busted, SHUT UP and hire a lawyer. No offense but when I need REAL legal advise I talk to the guy with a degree on the wall, not some guys on some forum :D

In 1997 I was arrested because a man went down to the magistrate and swore out a warrant against me for assault. The charges were dismissed after trial because it was his word against mine, but the charge, booking, bond, lawyer, trial etc were all very real.

It's hearsay, not 'heresay'. Hearsay evidence is not something that somebody heard. If you state aloud 'I struck John Nonsense' and I heard you say it and testify to that effect that is direct evidence that you made the statement. Hearsay would be when I testify that JJScorpio told me that you said the above.

Yes Virginia, people go to trial everyday based on sworn statements and nothing else.

I guess I dont get it. Are you talking Legally, is this the way it worked, or theoretically can it happen? Legally... sorry but there is no judge signing a warrant from just hearsay. Anyone that got arrested could have other people arrested if that was the case. How many people get arrested daily for felony narcotic charges?

Can it happen? Sure you bet it can.... with a good attorney it should be fairly easy to get thrown out though. Thats just my 2 cents tho.

It's not signing something, but the same exact thing..

My ex wife told the court, in testimony, that we were living together after she had filed a restraining order. The court case was about my daughter missing school. They sent police to my house to arrest me. My ex called me and told me they were coming. I got the proper legal distance from my house and watch them raid it looking for me.
 
The original question SHOULD be: Has anyone been convicted based ONLY on an allegation brought by a single person with NO corroborating evidence? THAT is the real issue, NOT if some backwoods sheriff's dept. ever falsely charged someone using a single witness.

Framing a question to get the results you wish is an old trick. Being honest means asking the really pertient question:

Has anyone here ever been charged with and prosecuted for a felony that arose from ONLY the accusation of one other person with NO other evidence? THAT is the real question, and the answer is NO!

eyp......some1 got busted(for something severely minor most likely), then the PIGS told em theyd just let him/her go if they gave some1 up! happened to me b4.....some a**hole got popped with some 'E' with me havin bein arrested for 1/2zip, they were let go home that night, my lawyer showed me the statement........FU**ER didnt even get that from any1 i even know!


was like 10 years ago, got 4 years probation, not to mention the 2 weeks i got 'held without bail' for the distribution charge........

JJ is correct and it is not just in pot cases. Rape, date rape and child molestation arrests are all made solely on the statement made by the victim or parent.

Anybody can get anybody arrested at any time, just by swearing out a complaint.

All you gotta do is go the the County Attorney and say BillBob did so and so...

That's how all this works.... You will be arrested...

Yes, I've been arrested because of false info! Happens every day, every minute.

edit: the amount of armchair attorneys here is hilarious.... it actually makes me sorta sad, Just cause something has happened to you people... doesn't make it the way it is.
