I was recently denied by the Feds (knowing I had little chance of approval) ... because of a misdemeanor weed charge in the Mid 80s ... No Bullshit (what my angry samoan ninja #1 ... now I'm a liar too?? and I suppose there's no dead hookers in your trunk??) No Pell Grant ... No Low Interest Start Paying When You're Done niceness ... WV was willing to help some but not quite enough ... I would have had to juggle a job ... and if there were work to be had then WTF would a 40ish Hill Folk type be doing looking to further his Formal Edumacation ???

I haven't read all your replies yet but i HAVE to go turn myself in thursday morning. He told me on the phone if I didn't, there would be a warrant out for my arrest along with a $500 bail. He said when i turn myself in for processing and stuff, I'll probably be released with a $0 bail on my own recognizance. The only reason they didn't take me down when I got arrested is because I explained I've been sick lately and can't miss anymore classes and nobody would bail me out, so he said he'd wait til I was on spring break (this week).

But I talked to my dad when it happened, he has 2 lawyers in town for me and I'm going early tommorow morning to talk with both of them. One of them has been the city attourny for years.

WEEDMAN In California, all records of possession of marijuana charges are to be destroyed after two years. 11361.5 California H&S Code. I would see about the expungement laws for feds and the state you were convicted in.

Thanks ... but ... I've moved on as it were ... I tried the expungement thing ... It wasn't offered to me at trial ... I was arrested convicted sentenced and served time (and not just for the weed I was a shit but the Misdemeanor CDS Marijuana IS the charge that was cited on my Denial ... The MisD was what they could make stick ... I was initially charged as a Multiple Felon ... Read:They Made an Example Of Me at a young adult age) ... all of which will remain on my record ... It is very hard to get a Judge to overturn another Judges decision or modify conditions this long after the fact and very expensive to pay a lawyer to attempt it. I'm certainly not in Cali ... I was not convicted in the state I was attempting to attend school in. This is too fresh for me to go in to any more details ... I have probably said too much already ...

Like everyone else I agree you need a lawyer, they will at least get you a better plea bargain than your going to get otherwise. Nothing goes to trial ever.

Also in order for you to be disqualified for federal student aide, it must be a distro charge i do believe. Also the feds do not check state record so if you don't tell them they will never know, unless you were busted by the feds.

He said your bail is $500 thats a misdemeanor. I don't know about the school loan stuff but you wont do any time if you can make bail.

T ... What part of what I wrote didn't you understand? Was it the part that I was recently denied Fed Aid because of this charge? Did I forget to mention that I was Accepted by the school ? ... Do you think I've forgotten any details as to why I'm not attending a University RIGHT NOW or that I didn't exhaust myself trying to get in without taking on Mid to High interest loans and paying out of pocket ? Like I gave up when I "Heard" a drug conviction could get me denied. HaHaHa I'm fucking 40+ ... You don't half ass trying to get an education when you Actually want and need to learn to do something else with your life/career. It is Obvious you missed me not wanting to discuss it further ... I'm not lying to seem Cool to you kids on the Internet ... Yes! I was honest when asked questions about my past ... No! I did not offer said information without being questioned about it ... nah, you're not fucked. you're playing it smart by hooking up with your dad's lawyers 1st before going down to the cop shop...do not do it any other way! you have too much to lose and your lawyer will make sure that doesn't happen. you'll be fine...i really doubt if you'll have a record as long as you're a good boy for a year or two...and maybe a little community service at worst. it's definitely something to be concerned about but trust your lawyer and do what s/he says and you will walk. no judge would want to fuck up a college student's life on a little misdemeanor 1st offense like this.

yes, bring the lawyer with you. You see, cops are cops because they're not able to get real jobs and have no real education...so they get civil service jobs. Their only advantage over joe public is their knowledge of the law. They are aware 99% of people AREN'T aware of their rights and what the laws are, and they use this. So bring a lawyer. I LOVE it when they try to get tough. Give me a break. YOu know, like smart-ass stuff - "hey buddy I'll tell you what to do when I tell you to." Could always move to Oakland, I heard they just had some lay-offs

Get an attorney, if its your first offence, you will most likely get a misdemer and probation, fine etc. I know a person who got busted selling EX and an attorney saved his ass, misdemeanor, probation, fine etc. it could have been MUCH worse, and they will probably make you goto drug treatment also, the Hydrocodones fucked you. As for as your federal aid though, unless your case gets dropped I think your fucked.

No they weren't perscribed I bought them off somebody who was. I know I'm fucked. And I'm glad you told me that, now I'm probably going to lose my financial aid for college, get kicked out of college, and owe my school $20000 on top of that. This is great

Sorry, you have to be arrested and booked in order to be charged and released on your own recognizance. Or at least issued a ticket if the charge is simple posession. He was let go on the spot, that is completely different. They are not asking him to come in for prints and processing, they are asking him to turn himself in for posession while they are in posession of it, assuming they haven't smoked it already. Trust me, they can't enter something into evidence without a case number or opening an investigation. If they don't issue you a posession ticket with a court date, you have no court date. These cops probably have a bet going to see if this kid is dumb enough to walk in to the police station and say arrest me. Also, marcellas, you would do well to watch the busted, and never get busted again series of documentaries and memorize them by heart for future reference. All I'm saying is don't walk in there before you've had a lawyer tell you 100% that I'm wrong, and be aware that an unscrupulous lawyer may tell you to go get arrested so he can represent you. The ball is in their court, they want you to shoot into your own basket. If by some loophole they have the legal authority to arrest you, let them do it, there is no additional charge for not cooperating with an officer.

best pece of advice yet you haven't been charged with anything,so there is no legal pretext to charge you with anything 2.5 grams I would let your friend know they are watching,as they obviously thought you were someone higher up on the foodchain. seriously you have to be charged with a crime never admit to anything !that bag could have been left by a friend!don't let em search your car. i would have told that fucker your wifes panties you want em back?i always act surly and pissed off if they are copping me an attitude,anger is a convincing emotion,much more useful than despair which all that l.e.o. feeds off anyways.when you are angry you also have the advantage of diverting their attention from making a bust to assessing their safety.

Honestly, i wouldnt even worry too much about it. you only had 2 grams, thats a joke, 10 prescription pills, the most you are looking at is a simple misdemeanor possession charge, which might be a couple hundred dollar fine and a couple weeks of community service.

unless you live in some crazy state, i live in CA, the cops would laugh at me if they only found two grams.

Also, dont store weed in pill jars, contrary to what you think its NOT airtight, you need a good glass jar with a air tight locking lid.

And dont take all your pills with you wff, leave those at home!!! and why is your grinder in the car, dude it sounds like you are kinda sloppy. Dont use your car as your personal hotbox stoner pad. Keep all your paraphenalia at home where it belongs!!!

Dude, $250 bail? I had to call my parents at 4:30am on a weeknight so that they could call the bailbondsman...he said that my mom had to put her house up for collateral...

Sounds like a ticket to me. Definitely go in, but like everyone else said, don't say shit. They let you go home, that sounds like a good sign to me. Get a good lawyer, it makes WORLDS of difference...

I was charged with 4 felonies and like a million misdemeanors, the judge said max penalty for all charges would be almost 90 years... my lawyer got me a year of probation and 25 hours of community service...i even got to serve my probation out of state!

HAHAH real truth here, Marcelles honestly you are TRIPPPPIN! What you went through is your basic small time misdeamor citation, lots of peoples have had dozens of these, cops have written me tickets a handful of times for marijuana possession, alcohol, drugs, and i have never served a day in jail, ive done alot of community service and paid alot of fines though.

Shit i was facing three vandalism charges, caught red handed, with a eyeball witness. I denied everything, stuck to my story, and sweated it out till my case. Come case day, my lawyer tells me all charges have been dropped because the witness was a transient who was never found again.

DONT WORRY MAN!! Your not gonna get kicked out college or need to cap piggies, just sit back, save up some money to pay those fines, and clear out a few weekends to do community service, which is fun because i meet new smokers and other like minded criminals to hang out with everytime i go! Everytime i have been in community service, i ended sparking up a blunt or joint with someone else in the program.

End of story. Oh yeah and i have court in a month to face another misdemeanor vandalism charge, shit even if i have to spend a week in jail who cares. Its a week where i get free food and i dont have to talk to my annoying ass girlfriend, woo hoo.

Also, they took your drugs, and never issued you a citation? Did they issue you a ticket that says show up to court? Did they give you ANYTHING??

If they only took your drugs and bounced, then thats NOTHING! Standard police jackmove, its happened to me hundreds of times, its much better than getting your shit jacked AND getting a court date and a couple charges to go along with it!
