FEDS Thump On Montana

There will soon be petitions out to stop this shit. It will take effort by everyone who gives a shit, patient/caregiver or not. 100k signatures of registered voters needed toot sweet. A lot for sure, but there is also a ton of anger about this treatment of us. Probably also be challenged on constitutional grounds, which will cost $$$$.

The word needs to get out that a referendum to stop 423 in its tracks will be ready to sign statewide around the end of the month. Everyone interested needs to be registered to vote. Takes 1 day. Volunteers needed to get out these petitions in all parts of the state. (Patients and Families United, Montana Connect, NORML for more details) Every storefront should have them available and signs along the lines of "Save Medical Cannabis Here" out front. There is a parallel hopefully combined lawsuit to challenge the constitutionality of 423 in court. This needs to be co-ordinated into one suit, not a bunch of single suits. See Montana NORML (John Masterson) for details. If we can get +- 100,000 valid signatures by July 1, the stores can stay open. Otherwise there is 6 months to get signatures. There are a hole lot of serious folks set to go here, we need EVERYBODY to get going and spread the word
 
Good info there Bobo. I've contacted Montana Norml myself...looks like petitions wont be available until end of May/ early June. It also sounds like we only need 30,000 to 40,000 signatures. $50,000 was raised in 72 hours to pay Jim Goetz a hard hitting lawyer from Bozeman to bring a lawsuit against the state. Word on the street is he wants $250,000 if this goes to the State Supreme Court.

This shit ain't over till Schweitzer starts singing like the bitch he is.

Just this eve spoke to a good friend who has business in Billings and Missoula and is for the time unfortunately deciding that he must abandon all his patients to not be in conflict with the "law" should it be in place July 1 nevertheless said "I can get thousands of signatures :) ".
I can't get thousands but I'm going to give it hell soon as the forms come out for sure. The Essman/Milburn/Sands/Schweitzer Goose Stepper Faction is about to feel the lash of the Power of the People!:whip:

Several reasons really. It is nice indeed to be <somewhat> legal. I have cards enuf for a nice spot if just left alone. I am old so I have quite a few friends and aquaintances that have problems a card works with, they are very happy to be legal. I really love to help folks out with medical issues. Also , it is a step on the road to full legalization. Just take a look at the states where leagalization is right now being considered--thanks to pioneering MMJ :tiphat:

Hey Bobo, Don't forget Art Wittich, this asshole is a lawyer who has two med clients but gets up in front of the Senate and supports repeal... Conflict of interest??? I thought Diane Sands was one of us??

Glad to see this thread is still going. We have been handed a real shit sandwich with this bill. I am however against the Schweitzer hating. He did us all a big favor by vetoing the total repeal and worked to make this bill much better than it was, too bad the legislature wouldn't include most of his suggestions. The man has done a shitload for this state and really put the republican majority in their place this session. Inaction on the issue of the mmj circus that has turned up in our state would have been political suicide for him so I can see why he was forced to let this bill pass. Do I like the bill? fuck no! I just lost my job! I have plants going into flower fpr the last time; no new clones and the moms have been scattered to friends and my employers just lost 50k+ they invested. You can bet your sweet mamas knickers I'll be putting the rubber on the road as soon as I can get my hand on a petition. Anyone out there need a nice working vacation in Montana? Lets make the Republicans look like the asshats they are and get this bill repealed!

Ya Goetz is a competent lawyer, he was a good choice and the bill is clearly unconstitutional, most glaringly by banning the advertisement of a product.

Big Brother Is Back. This shit about makes one want to puke

HELENA — Federal enforcement agents raided a Helena medical marijuana provider on Friday, the latest development in a continuing crackdown on pot distributors in the state.

Paul Schmidt, the owner of Sleeping Giant Caregivers, was out of town Friday afternoon, but confirmed to The Associated Press in a brief telephone interview that agents were at his marijuana operation on the eastern edge of Helena.

A search and seizure warrant signed Thursday by U.S. Magistrate Judge Jeremiah Lynch of Missoula authorized federal agents to seize items that are "evidence of the commission of drug trafficking offenses," including marijuana and hashish, weapons, transaction records and other documents and paraphernalia.

Lynch ordered the case sealed, and it was not immediately known what was seized from the raid.

Federal agents also had a warrant to seize up to $1.2 million from an account at Mountain West Bank. Assistant U.S. Attorney Jessica Fehr in Billings said that warrant also is connected to the Sleeping Giant case.

The Drug Enforcement Administration was involved and there were no other federal raids taking place Friday, Fehr said.

Outside the warehouse where Sleeping Giant Caregivers is located, the windows were shuttered and several confused patients were turned away by an officer at the door. Another officer stood watch at the rear of the building, where a large, unmarked truck was parked.

The raid and warrants are similar to those of March 14, when 26 search warrants and four bank seizure warrants were executed on medical marijuana operations in Montana.

More than 2,880 marijuana plants and 258 kilograms of bulk and loose pot were seized in the March raids, along with weapons, vehicles and a ski boat.

U.S. Attorney Michael Cotter of Montana has said the raids are part of a long-term investigation into drug trafficking, though no charges have been filed.

The raids happened as state lawmakers were revising Montana's medical marijuana law to restrict who qualifies as a patient and to prevent pot providers from making a profit. Several providers in the state's once-booming industry have since closed or suspended operations.

Two Montana providers who were raided have sued the U.S. government, claiming the searches were unconstitutional.

The Montana director of the advocacy group NORML said the raids have left hundreds of patients without a safe, reliable supply of marijuana, and Friday's operation was more of the same.

"It's not only an egregious attack on states' rights but on fundamental human and civil rights," said John Masterson.

The raids appear to be part of a larger U.S. Department of Justice crackdown on medical marijuana providers. Letters have been sent by Cotter and U.S. attorneys in several other medical marijuana states warning that department would enforce the Controlled Substances Act against anyone manufacturing or distributing marijuana, even if it's permitted under state law.

The department has said it won't prosecute seriously ill medical marijuana patients who follow state law.

Hey Bobo, Where the HELL are those petitions? I've contacted NORML via e-mail and Im playing phone tag with Craig Shannon. All of my patients are wondering and I'm ready to travel to whatever districts I need to to get this thing done. The real numbers are between 31,000 and 43,000 people depending on which 51 out of 100 districts we use. Doesn't seem like that should be too hard considering there are 30,000 patients in the state.

Keep your veg plants alive...this aint over.

The bureaucracy works like a snake digesting a rat. I hear June, maybe even the second week at worst? Which would make it impossible to get done in time to keep stores open. Folks i know that are staying in the game are preparing to shut it down temporarily. Its a fucking bump in the road way i see it-- a blow but not at all fatal. People of all persuasions are itchin to sign.:laughing:

Goetz has already won the lawsuit over the ban on advertising.
The petition business has been submitted and then sent back to us as there is some conflict over the language..bitches.
