charged with 3 felonies in Michigan this weekend.

So I went up to michigan and bought 10 lemon haze clones Saturday. On my way back, around the battle creek area I got pulled over. They found a loaded pistol in my car along with the 10 clones obviously. The pistol is my fiances and it's registered to her and I "didn't know it was in my car". So I'm charged with felony ccw for right now. I know they're gonna send the plants to a lab to be tested and as soon as it comes back positive I'll be hit with manufacturing and also felony posession of a firearm since I had a pistol in my car while comitting another felony. Bonded out Sunday afternoon and bow will be getting drug tested thru this whole ordeal...smh. so can anyone from michigan tell me what kinda time I'm looking at? I currently have one of the best lawyers in Michigan retained so hopefully he can make the prosecutors lie miserable enuff and he'll end up lessening the charges... this is my first offense btw. Did I mention that I'm not a michigan resident? Thought it'd help. Thanks guys :/

Shit dude sorry to hear. I don't have any info to help but just wanted to offer my sympathy. I been smacked by the long hand before. 1st offence can only help you in this situation.

uh, they have to dry that down and determine sale weight before charging you, i can't imagine 10 clones amounting to more than an ounce and certainly not felony weight. the gun though...

Doesn't matter how big or what stage it's at. They don't dry and weigh the plant.

why would you have to be tested through this process ? you are not guilty of anything yet ? so why would you have to submit to any types of testing till found guilty and on some sort of court ordered program ?

Questions which make me wonder if this is bogus in some way... (?) ... (if not, adam, sincerest apologies).

I checked, it’s not April 1st... so what gives?

List the three felonious charges. It might help.

I've have heard of pre trial conditions of release with drug testing but that was for fed charges..
Perhaps since he bonded out (using a bondsman) the bond holder is requiring drug testing.

I think if u can get the gun charge tossed (mayb) Ull have a shot at probation for the plants.
Just a guess tho... I've never had interactions with the Michigan legal system.
Good luck and good job retaining a good attorney.
Now get ready to wait, it may be up to 2 years before the case is resolved,
Also, I doubt Ull do it again but it's absolutely crucial that u know when ur in possession of a firearm. Iam amazed how often people catch gun charges without even knowing they were in "possession" of a gun.

Damn.its not what you want to hear but the firearm means federal time.maybe it can get lowered. don't know but good luck.oh by the way.that its my wife's pistol I didn't know it was there isn't gonna fly.we know exactly what you were doing.

Battle Creek is in Calhoun County, so that is not a best case scenario in dealing with our "justice system". What was the pc for your stop and search? I assume you were stopped on I94? Who was the leo agency that stopped/searched you?

Looks like you should of read up on the state laws before getting caught. Less than 20 plants is a felony and facing 4 years. Would of been much easier in the non-med state Ohio!

I'd try as hard as I could to push that your in medical need.

As for the weapon charge I couldn't find a straight answer, but 5 years is a guess. No clue what your third charge is but I'm guessing you were stoned?

You have not much luck with a medical defense so I'd try to plea for a consecutive sentence and less time. Michigan doesn't seem to mess around at all.

Don’t expect the gun charge to go anywhere. Unless, in addition to the gun, the vehicle you were in is hers also. Is the car registered to her? If not, and it’s in your name, you’re legally responsible for what ever may be in your vehicle. Don't think the ignorance defense will fly.

Indiana is not a medical state. So you’re not a cardholder. No chance of leniency there. Was the purchase from an individual or a dispensary? I suspect you’ll be leaned on to give up this info.

That gun charge was everything.there is no defense.you are considered a drug dealing gangster in the eye of the law.lord help you if are already a felon.that's like mandatory minimum of 5 years.and you knew the gun was there cause you were scared of being robbed.its hard to be sympathetic on this one

Wait till AUMA passes in California it's gonna screw up our laws just as bad if not worse. Advice for the op take a self defense class your gonna need it.

It is insanity.

But get this, civil asset forfeiture runs amok. There have been many instances where those who can “legally grow” have been raided, had various pieces of property taken, and not even charged with a crime... and usually those charged still don’t get their property back. And of course the seizure usually includes one's grow-room equipment.
