Though agitation and education have their place, and "medical" use has gotten us this far, but outside of California and the few other states that permit initiative petitions, the path to legalization will probably lead through the Courts.

The Supreme Court has painted itself into a corner.

Slavery was ended in England by one ruling, by one judge.

If one Federal Judge rules on Constitutional grounds, the games over.

We'll outline the cases shortly, and invite informed commentary.

Here's the legal strategy, in a nutshell:

The Supreme Court decision in Daubert v. Merrell Dow Pharmaceuticals ( 1993 ) set forth the rules that govern scientific questions in all Federal cases.

When the Daubert Standard is applied to marijuana, we all know the result.

There's no rational, scientific, basis for prohibition.

The Supreme Courts 2003 decision in Lawrence v. Texas ( 539 U.S. 558 ) seals the deal.

When the "Supremes" legalized "bare-backed buggery", they set the bar very, very, low.

Is "smoking grass" more dangerous than "bare-backed buggery"?

Certainly not!

The same privacy rights that cover gays, also protect pot smokers.
