Here is the deal, if actual policy, the states can no do what ever the fuck they want. So outdoor AG in CA blessed by CA state can now produce on an unlimited scale so long as the CA rules make it clear that all that CA cannabis must stay in states where cannabis is allowable.

The false equivalency of "They're All the Same!" is more than a bit tedious, as you say. We have only to look at the list of MMJ states to get an honest feel for it-

Yeh, sure, there are few red states in there, but certainly not the reddest of the red, the deep South or some plains states. Arizona barely made it, and that's because of the number of more liberal seniors who've moved there & find some relief in MMJ, and the large Hispanic community. It's the same reason that Florida approaches the tipping point.

What about Conservative Repub strongholds like Oklahoma, Kansas, Texas, Mississippi or S Carolina?

Dream on if you think their politicians are the same as those in Colorado or Washington. Once we get past the usual anti-gubmint raving, obvious differences are right under our noses.

One of the biggest problems for the future is that Dems were asleep at the switch in 2010, allowed Repubs to take control of many state govts, where we now have voting districts gerrymandered all to Hell & gone, districts specifically designed to deny the will of the People as much as possible. It's desperation & arrogance rolled together in a truly sad combination.

Obviously, the Obama Admin hasn't "legalized" MJ at all. They don't have the power. OTOH, they're removing obstacles & will probably allow US Attorneys a lot less leeway in the pursuit of MJ enforcement.

Traditionally, US Attorneys have a great deal of discretion, which explains the differences of enforcement patterns in different states. OTOH, they serve at the pleasure of the AG & the President. Clearly, what pleases them has changed, which is reflected in this memo-

You have to be able to speak bureaucratese to really get it. I do, rather fluently, having worked in a bureaucracy for over 30 years.

Yeh, sure- we'll see, but the indications are that Washington & Colorado will be allowed to regulate & tax MJ sales within federal guidelines, which are intentionally vague. It's also likely that other states who follow suit will have the same ability.

Once retail is up & running, I expect intensified efforts against non-licensed growers in legal states. They'll be treated as bootleggers depriving the people of the state of tax monies. Dunno how that plays out in Washington, but it means that Colorado home growers would be wise to observe legal plant counts, always.

But if its upto the state I hope we have this in the bag

i guess i'm confused. i always thought that the DA's and such seemed do do whatever the hell they pleased. i know there are still places in colorado where you are more likely to get fucked with by the cops than others when it has to do anything with weed. it was always my understanding that since that is the case that it was some of the DA's and sheriffs pushing there own agenda. and it seems like they can get away with it in most cases.

am i misunderstanding something?

even if obama legalizes herb and is smoking a blunt at the next state of the union address i can't see guys like sheriff joe arpaio leaving stoners alone. and there are folk just as dickish as that guy in much higher positions

It's a start, but far more attitudes need to change to pass actual bills into laws. It's still a very unpopular for politicions to voice pro-marijuana decisions. There are some horribly conservative states in America, not that they get a huge voice anymore.

It'll be legal when people in jail for weed are freed & anyone who was ever arrested for possession or dealing no longer has to worry about their record when job hunting, etc.
