Bill S-10: Mandatory Minimum Sentences for drug crimes

Cops inflating plant numbers on a bust can't hold up in court, it is the prosecution that must prove their case BEYOND reasonable doubt, not the other way around, meaning that the police have to have documented proof of plant numbers and such, which is why they take pictures and usually video tape busts

lots of people take plea deals b/c of the cop's practice of lying so what they do does have a consequence. if they charge you with 201 plants and your looking at 2 years under s-10 when in reality you had something like 197 and then the prosecution offers you a deal you are more likely to take it.

While I kind of understand what you are saying, that comes down to having a shitty court appointted lawyer that probably has totally different alterier motives then the clients he is suppose to defend...
Every court case has a period called disclosure in which the prosecution/defence are required to hand over ALL of their evidence whether it helps or hurts their case, not doing so WILL result in a mistrial, if you have a competent lawyer. Without this exchange of information neither the defence nor the prosecution can form cases. If there is no clear evidence of plant numbers or whatever else your trying to prove then basically the prosecution has no case.

When the prosecution approches the defense with a sweet sounding plea agreement, it is basically a red flag to any good defense lawyer stating that the crown is not too confident in their case/evidence and would rather not take this to court... The problem is that your court appointted lawyer, who probably works in the same office as the prosecution, works with the prosecution everyday on a type of favor system, a you scratch my back, I'll scratch yours. Your best interests are not in concern, but see how the legal/court system works when you have a well respected lawyer fighting your case.

thanks for the info. i always heard public defenders sucked hard but i never really understood why apart from their pay and experience. So the cops need to photograph or document in some way to prove the plant numbers?

its sad how court relies so much on whoever can throw around the most money

I got pinched once and they dug through the garbage and pulled out 200 decaying clones and and added them onto the number.That right there woulda screwed me bigtime.Just hope yer lawyer could get it thrown out i guess.

The best he can up with is a form of the, "if you're not with us you're against us" argument. He sets up his critics as straw men and even waffles in his attempt to tear down the very straw men he's just created.

When he's rebuked thoroughly he's then given the chance to respond -- "uh, no, it would take too long". What an absolutely pathetic excuse for a public servant. He has no argument to make -- and I'm pretty sure he knows it.
 
Senator Wallace is pretty pathetic. He heard from many witnesses that the bill is a step backwards, but he just can't seem to wrap his head around it. He must not want to understand.

Hearing Senator Wallace is shocking. I used to want to be a politician when I was in school (hahahhaha) but I realized I would get nowhere career wise because I am disgusted by toeing an ideological line instead of making policies that are good for society and the planet.

If educated and reputable professionals come in and give me information backed by scientific studies, statistics, and other accepted methods used in post-secondary institutions, I would listen to them. What fucking boggles my mind is that the Senate committees are bringing in just these educated and reputable individuals like researchers , professors, and people who work in fields related to the policy in question (like addictions groups), yet people like Wallace are choosing to listen to cops, firefighters, and mayors who are obviously not experts in the field of drug policy. Not just that, but Wallace and others are totally ignoring the historical failure of mandatory minimums as a whole!!! whats that saying about failing to remember history????

I can appreciate that these people have a street-level view of the effect of drugs but their experience in no way reflects the broad societal impacts of drug policy. We shouldn't be listening to cops and people who have a vested interest in keeping laws tougher, rather we should look to the educated professionals who are experts in the field in question to guide laws... it makes NO FUCKING SENSE . what kind of a degree do most Police officers or fire chiefs have that qualifies them to make comments on legislation??? just because they enforce laws doesn't mean they have anything important to say about the creation of law. i dont think we should rely on cop's testimony. or fire chiefs for that matter.

FUCK THAT BLEW MY MIND.now they are talking about limiting the number of hydroponic shops in the lower mainland. These people are sooooooo dumb. An overriding theme of my recent life has been figuring out that the notion that adults are generally responsible and smart (which as a kid i believed) is a totally fallacy. nobody knows what the fuck they are doing or saying and the ones that do aren't in or aren't able to get into positions of government to effect beneficial laws. i dont think there are very many smart people in government. something strange happens to you when you spend your days sitting in parliament and listening to everyone talk like its the 1640's in royal england court or some shit. always referring to each other as "your honorable" or "your worship". shit makes me vomit.
 
I think the person who made the "gateway theory" comment was Ray Massicotte, member of the Canadian Police Association (union). Senator Nolin quickly put him in his place though.

Crime bill to be reintroduced in Senate

Harper said in a statement the new senators have pledged to support reforms to the Senate, including legislation to limit Senate terms to eight years.

"These new senators are committed to community safety and justice for the victims of crime," the prime minister said in a statement.

"the majority of the country.. are not prepared to accept the assumption that drug use is something to be encouraged in our society." what kind of statement is that?! our society loves drugs. doctors pretty much throw drugs at people. you can go to a psychiatrist and fidget around and they'll probably prescribe you adderal(similar to crystal meth), or you can say your sad and they'll throw some anti depressant at you. what an incomplete and ignorant statement.

also the fact that hes too much of a tool to even respond to the stuff they said just made me so angry. im so sick of being governed by retards like this fuckface.

But it does make a difference! there are so many people just like you around the world thinking "im just one person, what can i do??" but you know what? there are millions of just one persons, and each of them together can lead to huge changes! HALF of Canadians vote, thats MILLIONS of people who dont care or dont think it will make a difference. if these people decided to be active in the governing in our country, maybe we wouldn't have so many douchebags like senator wallace leading us. please vote, i know it seems pointless but you have to keep hope alive!

I think I read in a thread that Canada was or is pushing for private prisons, ie: prisons for profit. As it is here in the States the prison for profit industry needs to be filled. The easiest way to fill your prisons is to bust pot smokers and growers. I don't know the stats but the percentage of people in the joint here are in for non violent drug offenses. lets face it, there are more dope smokers than other types of "criminals", And most older people think that putting pot smoker n jail is the same as a heroin pusher. So the end result is how to fill the prisons, and you folks in Canada are just now finding out how they are going to fill them.
