SO ... do you have to have all parts of the plant?? Leaves and roots, or does just one justify a plant? It seems that the roots make a cutting a plant, but do you need the foliage to make the roots a plant?
Hemmed
I haven’t kept up with your thread but I wish you the best and thank you for all the invaluable info you are providing.
Your question above is a tough one. They could say the root ball shows existence of a plant. Because there is a root ball and "to be a plant" there must be roots. So with the root evidence i.e. there must have been a plant at one point. You can’t have roots without veg on top somewhere.
I hope I am sooooo wrong but just commenting on what might happen. Good luck to you brother.

Mmmmm........a couple of points: Isn't there a statute of limitations on state and fed marijuana laws? Say, Hemmed Up grew only 10 plants this year and claimed the rootballs are from 5 years ago, can those liberty thieving bastards count all the plants he has ever grown? Geez, I hope not. They dare not. And what about the seeds? Most folks go thru a domestic ISP to buy seeds, which I believe is also illegal. I know Gypsy's servers have your purchase history
and EMAILS you a record of your recent transaction but doesn't your ISP/phone co. keep a record too? Remember that the fuckers enabled the feds to spy and listen to every phone calls and emails going abroad not too long ago........... without warrants, mind you.
Hemmed,
I've seen threads where growers would take a plant outdoors and lay it down burying multiple parts of the stem to keep a low profile. Where it was buried they would scratch the outer part of the stem and put root tone on it so roots would develop. The point being one plant could have multiple root balls. There are other threads on air cloning I think it's called where you take some gause with coir and wrap it around a scarred stem until a roots pop out and you sever the stem completely. I know it sounds like a stretch but reasonable doubt is just that.
As for jury nullification I served on a jury in a drug case where a street crack dealer shot and killed the buyer in a robbery attempt. I had always wanted to get on a jury in a drug case but could in no way nullify this case. What was amazing was in the case the prosecutor said that had there been 5 crack dealers attempting to sell and one shot the victim all 5 would be guilty of murder due to a law that said anyone involved in the commision of a felony in which someone was murdered is guilty of murder. It was a giant net that insured a guilty verdict. Luckily the defendant said he was the only one there and no one else was roped in to the murder conviction. The victim was white with 2 white witnesses in a car and the defendant was black. The jury was half black half white half male half female. No one seemed to have a problem with the net the prosecution was willing to cast had there been multiple sellers. I wish it would have been a worthy of nullification but it as not. It did make me change my opinion on legalizing hard drugs which I had always opposed before that week of jury duty. Had cocaine been legal the victim would not have been in a position to put his life on the line to get the drug he was looking for. The fact that pot is still illegal is a joke. I read today where a high school kid that played football died from smoking that synthetic pot crap that athletes smoke to keep from failing drug tests. I think it is called spice and is sold for $60 for 3grams which is more than grade A pot. I am truly sorry you have to go through this and wish you the best. Even if you were selling and made a living at it I doubt I'm the only one who thinks you are making a more honest living than those who arrested you knowing you posed less of a threat than anyone who has ever sold tobacco or alcohol.
