arrested for 2 grams of cannabis

i was arrested about about a month or two over 2 grams of bud. In the state i live in it's decriminalized....but i was charged with class D possession. For 2 grams. I called NORML and they thought it was messed up too. It's supposed to be an arrestable offence for over an ounce, and a ticket for anything under.
I have an awesome lawyer but they sent my weed to the state lab to test. 2 grams of bud, and i've been to court 2 times now and they keep drawing it out.
The drug testing lab they test everything at here just got overhauled in a huge thing with the main testing person or whatever it's called messing up like 5 thousand cases. So now I don't know what the heck to do. I have to go to court for like the 3rd time in another month, and when that happens they'll probably draw it out again because of the lab thing. Isn't there a due process thing? And how can i be charged with possession of class d marijuana if it's decriminalized and under the legal limit? This SUCKS.
They put it in the paper too, called my grinder something like a "pill case grinder" and made it sound like i was some kind of drug fiend. It was a GRINDER. WTF??????? And this is supposed to be a decriminalized state. I don't even want to think what will happen when they pass the medical bill come election. They'll probably take peoples plants and test them and return them after the plants are dead.
If i actually get to see my kids someday i can't have all this trumped up bs in the paper on me. I feel like I'm living in a soviet bloc.

Recently, I listened to a MMJ lawyer speak. If your lawyer, is not familiar, with MMJ. Please, try to get one that is. Seems, you really need to watch, every detail and be careful, very careful. Somehow, through, the process of the 'right to a fair and speedy...' They can and may, even try to make this issue, worse on you!

If you can not get a new lawyer, start reading and learning, all you possibly can. Protect yourself..and your family, first. jpt

You have my best wishes, make sure you ask your guy all the question about other similar cases, etc.

He's your guy, he will do what he can for you, but you also have to educate
yourself about how the law effects you.

Good luck and keep us posted, chin up!

I've been caught with pounds in your state. It sounds like you are in a small town and you rubbed these cops the wrong way. Court in MA drags on for a year. They continue it forever but nothing will happen to you. Its a slow process. Tell your lawyer to file a motion to supress because your under an ounce. It'll go through but they will charge you with something else for the grinder and you have a slim chance of probation. Continued without a finding is the worst that you'll get. I have a lot of friends in your state that get caught with pounds all the time and no one does any time. They always plea down to lesser charges. Its a good state for criminals. And your lawyer is a joke. He should have filed the motion by the 3rd date. A good lawyer in MA would charge $5,000 for your specific case if it was your first offense. If its not your first then it would be 7500+. I can reccomend you a real lawyer if you PM me.

Got ya. Mine was in Nevada after the decrim bill passed but before it went into effect. I remember those signs we had that said up to 20 years for a seed.

Definately somthing not being told.
I will say though the cops were pretty creative with the pill grinder and its probably a felony charge.
The law also states if the police think its possesion with intent to distibute even under 1z its an arrestable offense.

Well clearly you were going to break it up into 2 1-gram bags and sell it to minors. Why else would you have a grinder? They saw right through your facade and now your busted.

Mother F-er. That's just so messed up. If I go without cannabis for a day or two my mild headaches resume; I feel a light sense of agony in my head because my brain doesn't produce the necessary chemicals to make me feel good; and become frustrated and easily agitated.

I just can't believe any state would do this to a person for possessing small amounts of a harmless, sometimes healthy "drug". Imagine, they were willing to mark you for life, more or less and steal your freedom.

Yet, same state would have otherwise been happy if you had gone through "proper channels" and obtained some kind of drug via a physician, then a drug store, then back to the physician monthly for "observation".

Meanwhile, they would all happily overlook the lengthy list of dangerous, sometimes fatal, side effects the drug your doctor saw fit to prescribe because the FDA called it "safe and effective"; and he knows he would not likely be sued for prescribing it on behalf of the cute/sexy drug rep he wants to keep coming by after hours for a drug efficacy update and 30 minutes of her showing leg in his office.

I'm really starting to see the similarities between corrupt criminal organizations and my government. When it hits you like that it's almost life changing.
